  • Can a man be raped? Francis Ewherido

    The debate started on my Facebook page. What prompted me to ask this question in my Facebook post was the story of a biology teacher, who was reportedly “raped” by five of his female students until he went into a “coma.”

    The report said he was just recovering from an undisclosed ailment, so it was easy for the five students to overpower him.

    The report did not state how the rape took place. Did the girls perform oral sex on him or in his sick state, he managed to muster an erection and had vaginal sex with one, some or all of them? Was he pinned down or he was in charge?

    The report also said he did not shout for help because neighbours had gone to work, but the neighbour, who found him was around and even heard “voices from his room, although faint because our rooms are far apart. I thought he was merely having some conversation. I also heard moans…” Was it rape or consensual sex?

    Did the girls threaten him with guns, machetes or other dangerous weapons? Couldn’t this have been an adventure gone awry? Until the police provide more information, I remain undecided.
    What is rape? “The crime, typically committed by a man, of forcing another person to have sexual intercourse with the offender against their will.”

    This definition seems narrow, so let us take a broader definition. “Rape is a type of sexual assault usually involving sexual intercourse or other forms of sexual penetration carried out against a person without that person’s consent.

    The act may be carried out by physical force, coercion, abuse of authority, or against a person who is incapable of giving valid consent, such as one who is unconscious, incapacitated, has an intellectual disability or is below the legal age of consent.

    The term rape is sometimes used interchangeably with the term sexual assault.” This definition also does not suffice.

    For instance, what is “sexual intercourse” and what is “sexual penetration?” Wikipedia says “Sexual intercourse (or coitus or copulation) is sexual activity typically involving the insertion and thrusting of the penis into the vagina for sexual pleasure, reproduction, or both. This is also known as vaginal intercourse or vaginal sex. Other forms of penetrative sexual intercourse include anal sex (penetration of the anus by the penis), oral sex (penetration of the mouth by the penis or oral penetration of the female genitalia), fingering (sexual penetration by the fingers), and penetration by use of a dildo (especially a strap-on dildo).”

    On the other hand, Wikipedia says “sexual penetration is the insertion of a body part or other object into a body orifice, such as the vagina, anus or mouth, as part of human sexual activity or animal sexual behavior.”

    You can see that over time the goal post has been shifted as far as definition of sex is concerned. The secular world and some sections of Christendom have extended the frontiers of sex from heterosexual to include LGBT (lesbians, gay, bi-sexual and transgender) and the frontiers keep expanding.

    We now have pansexual, omnisexual, etc. these extensions have also led to the modification of the definition of rape. In the United States, for instance, until 2012, the Federal Bureau of Investigation (FBI) considered rape a crime solely committed by men against women. In 2012, the FBI changed the definition from “The carnal knowledge of a female forcibly and against her will” to “The penetration, no matter how slight, of the vagina or anus with any body part or object, or oral penetration by a sex organ of another person, without the consent of the victim.”

    The implication is that in the US, at least since 2012, men can be raped.
    A story broke out in the US about four years ago, which one source later said was fake news. Two burglars allegedly broke into the home of a notorious gay rapist and got more than they bargained for. The gay rapist is 6.7 feet of flesh and muscles. He easily overpowered the burglars, tied them up and sodomised them for five days. The tabloids termed the incident as rape, but if it had happened before 2012, it would probably have been termed as just sexual assault.

    But the same incident cannot be described as rape in Nigeria. The only rape recognized in Nigeria is sexual assault against women. Our Criminal Code states that a man commits rape when he has carnal knowledge of a woman against her will, without her consent, or if that consent was gotten by coercion. So those five girls could not have raped their teacher, even if they sexually assaulted him or took advantage of his weak state, as far our laws are concerned.

    But a bill to amend the Criminal Code Act Cap C38 Laws of the Federation of Nigeria, 2004, passed through second reading in the senate last November. The bill, sponsored by Senator Oluremi Tinubu, seeks to delete portions of Sections 218 and 221 and amend the definition of rape as contained in Section 357. When passed into law, rape in Nigeria, like America, will now be recognized as a sexual crime against both men and women. But until our criminal code is amended, Nigerian-based men should know that they cannot be raped, no matter the level of sexual assault and onslaught.

    So mind the company you keep. Also, since rape scarcely occurs in public, mind those you share private moments with.
    The amendment of the criminal code will provide legal recourse for many men. In homes and offices, drivers, domestic male staff, junior staff and agile and handsome young men are being allegedly sexually exploited by oga madam at the top, but they suffer in silence.

    I have heard of male staff, who were victimised because they refused to sleep with their female bosses. These are clearly cases of sexual harassments. But like women, who are sexually assaulted, they prefer to be silent. Is it because of stigmatisation or they fear nobody will believe them. When the bill is passed and signed into law, will male victims of sex abuse be encouraged to come forward?

    Law or no law, it would be more difficult for men to establish a case of rape. I can imagine lawyers tearing their cases to shreds in court. The definition of rape includes penetration. A man musters an erection and penetrates a woman, yet he is the rape victim; lawyers will probe deeper. Was there physical force, coercion, abuse of authority? Was the man tied or chained? Was a gun pointed at him or a knife pressed against his throat? In that case he should be in a state of fear for his life? Is it possible for a man in a state of fear to have an erection? Instead the penis would usually shrink. While the amendment is welcome, the problem of men is far from over as far as rape (of men) is concerned.

    Controversial ex-housemate of the Big Brother Naija, Ifu Ennada has said she would remain a “virgin” in 2020, since her future husband did not show up.

    The reality TV star made this known via her social media page on Monday, in a series of new year messages to her fans.

    Ennada stated that while her “future husband” did not make himself available, the fact that she still remains a “virgin” is worthy of note.

    “Happy New Year to my Lovers that missed me! I was busy enjoying real life. I was also hoping to get some “Oko Nla” abi “Nla Kofe”, but sadly the future Husband Man didn’t make himself available. So 2020 I remain a Virgin, praise Jesus!” she wrote on Instagram.

    TheNewsGuru recalls that in time past, Ennada had made the headlines for several of her posts centred on rape.

    In 2019, she had stated she would reveal the man who sexually abused her at the right time.

    In 2018, she had also released ‘Tears of a Broken Virgin’, a short film raising awareness on rape culture in the society.

     

  • Herdsman arrested for raping 56-yr-old woman to death

    The police in Ebonyi State have arrested a suspected herdsman for allegedly raping a 56-year-old woman to death.

    Although details of the incident were sketchy last night, a source in the community said the suspected herdsman allegedly carried out the act on December 28 at Ufuezeraku, Ugwulangwu in Ohaozara Local Government.

    Police spokesperson Loveth Odah confirmed the incident.

    6 men sentenced to death for raping, killing student

    A court in north-western Vietnam sentenced six men to death for raping and murdering 22-year-old student Cao My Duyen in a case that shocked the country earlier this year, state media reported on Monday.

    On Feb. 2, gang leader Vi Van Toan told his gang members that the student’s mother owed him nearly 13,000 dollars for buying about 700 grams of heroin in May 2017.

    He said he wanted them to help him kidnap her daughter and blackmail her.

    In return, Toan would give them money and drugs, the online newspaper Tien Phong reported.

    One of the gang members went to Muong Thanh market in the city of Dien Bien Phu, where Duyen was helping her mother sell chickens, according to the Vnexpress online newspaper.

    He then asked her to deliver 13 chickens to a specific address in town.

    When she arrived, the group kidnapped her, took the chickens and the bike and kept her at the house of another gang member.

    Toan then called to the student’s mother to ask her to pay him, but the mother refused to do so.

    Five men had in turns raped her for three days then decided to strangle her to death on early Feb. 7.

    Toan and the five men were sentenced to death on Sunday.

    Two men and one woman were each sentenced to between three and 10 years in prison for their involvement in the case.

    Duyen’s mother was sentenced to 20 years in prison in November 2018 for her involvement in the drug ring.

    The court found the 44-year-old mother guilty of storing, transporting and illegally purchasing narcotics.

  • Rape: Former Spanish footballers sentenced to prison

    Three former Spanish football players were each sentenced on Thursday to 38 years in prison for gang-raping a minor in 2017, the latest high-profile sexual violence case in Spain.

    The three men at the time played for fourth division club Arandina FC.

    “They knew that the victim was underage when they raped her in their apartment in Aranda de Duero in northcentral Spain,’’ the judge said.

    The issue of sexual violence has been thrust in the spotlight in Spain in the wake of several trials, including the so-called Wolf Pack case.

    In this case, five men were sentenced for raping a teenage girl during Pamplona’s annual bull-running festival.

    At issue in the Wolf Pack trial, as well as a string of others, was the fact that Spanish law currently does not legally recognise rape.

    It only looks into it if physical violence or intimidation is employed.

    The Socialist government has appointed a panel to review relevant parts of the penal code.

    In the sentencing of the football players, the judge said the girl, who was less than 16 years at the time, was unable to react to the assault.

    He said this was due to the disparity in age and physical strength between her and the attackers.

    The attack took place with the lights off, taking the victim by surprise and creating an atmosphere of intimidation, the judge added.

    The victim had initially told friends and relatives on social networks that she was not raped.

    But the court said it accepted her subsequent statement that she did not submit voluntarily to the men.

    The three men were convicted for rape and for helping the other two take part.

    Olga Navarro, the players’ lawyer, called the sentence “embarrassing” and said the court was imprisoning three innocent young men, who have denied any wrongdoing.

    The men insist the girl was lying.

    “We’re not rapists. We were naive and they’re trying to screw up our lives,” one of the men, Carlos Cuadrado, said after the sentence.

    Another, Victor Rodriguez, said the sentence was the result of social and media pressure.

    The sentence can be appealed.

    Rape: 6 secondary school students denied bail

    An Iwo Road Magistrates’ Court in Ibadan on Friday denied bail to six secondary school students who were alleged to have raped a female colleague.

    The students: Akeem Abee, 17, Olaiya Faruq, 16, Kazeem Awal, 16, Ajao Waris, 17, Alamu Boluwatife, 17, and Dauda Mubarak, 17, are facing trial for conspiracy and rape.

    The News Agency of Nigeria (NAN) reports that the Chief Magistrate, Mr Taiwo Oladiran, said the magistrate court does not have jurisdiction to hear the case.

    Oladiran said : ” We all have powers; the issue of their age range of between 16 and 17 years is very important.

    ” If we have a very good correctional centre for minors where they can be corrected, they would have been held there.

    ” Even though the defendants are minors, they are to be remanded at Agugu police station pending receipt of legal advice from the Oyo State Directorate of Public Prosecution,” he said.

    The magistrate , thereafter, adjourned the matter till Dec 13 for mention.

    Earlier, the defence counsel, Mrs Christy Gbadeyanka, had asked the court to take the pleas of the defendants and grant them bail, citing some precedents.

    She argued that defendants were minors and keeping them with criminals would affect them negatively.

    Gbadeyanka said the defendants had learnt their lesson while in the police custody.

    She added that the defendants would not jump bail if released to reliable sureties, adding that the sureties would ensure they were available for their trial.

    The defence counsel also submitted that the defendants were first time offenders and had no previous criminal records.

    At the arraignment of the students, the Prosecutor, ASP Sunday Ogunremi, had alleged that the defendants on Nov. 17 at 6.00pm at Lagelu Grammar School, Ibadan, had unlawful carnal knowledge of one female student.

    He said that the offences contravened Sections 516 and 485 of the Criminal Code Cap 38, Vol. II, Laws of Oyo State, 2000.

  • 464 women raped on Uber

    Uber, the ride-hailing service, has released its highly-anticipated safety report, which revealed 464 incidents of rape in two years in the United States alone.

    In total, there were 5,981 reports of sexual assault in 2017 and 2018,

    In 2018, more than 3,000 sexual assaults were reported during its U.S. rides.

    That figure includes 229 rapes across the company’s 1.3 billion rides.

    In 2017, the company counted 2,936 reported sexual assaults during 1 billion U.S. trips. Uber bases its numbers on reports from riders and drivers, meaning the actual numbers could be much higher. Sexual assaults commonly go unreported.

    The company noted that drivers and riders were both attacked, and that some assaults occurred between riders.

    The Thursday report, which Uber UBER, touted as the first of its kind, provides a rare look into the traffic deaths, murders and reported sexual assaults that took place during billions of annual rides arranged in the U.S. using Uber’s service. It is part of the company’s effort to be more transparent after years of criticism over its safety record.

    “I suspect many people will be surprised at how rare these incidents are; others will understandably think they’re still too common,” Uber CEO Dara Khosrowshahi tweeted about the report. “Some people will appreciate how much we’ve done on safety; others will say we have more work to do. They will all be right.”

    Uber’s share price dropped more than 1% in after-hours trading.

    Uber and competitor Lyft LYFT, have faced harsh criticism for not doing enough to protect the safety of their riders and drivers. Dozens of women are suing Lyft, claiming the company should have done more to protect them from driver assaults. A Connecticut woman sued Uber last month, claiming she was sexually assaulted by her driver.

    Popular comedian, Bright Okpocha a.k.a Basketmouth has apologized over a joke he shared on rape years ago.

    The comedian took to his Instagram page on Monday, December 2, 2019, where he shared photos of the women who according to him are the most important people in his life.

    “Almost every morning in the blogs, on the news, there’s a picture of a man sitting on the floor pleading, the caption is usually in the line of ‘its the devils’ handwork’ and the topic is from underage defilement, rape or brutality against a woman or minor. I live in this same world with my most prized possessions my wife, my two daughters, my sisters and women who have built me into the man I am.

     

    “I was recently presented an opportunity to create awareness on the efforts of the EU to bring support to fighting this scourge, it was a no-brainer for me. I refused any compensation for it and volunteered to lend my voice because… it’s our fight, it’s not for the EU…its for my girls’ future. Unfortunately, a few years ago I shared up a Facebook post that I thought was shedding light through humor to the entitled crude and very present behavioral patterns of some African men who equate spending to sexual favors, but I also realized then that women actually have to face this daily and it’s harrowing and I deeply apologized for it,” he said.

    He also thanked women for being who they are and for the sacrifices they make to support men.

    “I sincerely pray that this does not take away from the most important fight of our lives….the fight to secure our future…because the girl child is our future. I strongly appreciate the EU for this amazing platform to improve our lot, as long as the message reaches the ears of those who need it, then it’s a win. To every woman – our mothers, sisters, lovers, wives, crowns, supporters, prayer partners, foundation, life…. thank you for being who you are. So many times you sacrifice who you are for a man to become who he wants to be. It’s time we all love and also support you as you do us….cos in your light, we all shine,” he concluded.

     

    TheNewsGuru recalls that back in in 2004, Basketmouth reportedly joked that after a second date with a woman and she is still not giving to sex, her partner should resort to rape.

    Following the social media outrage, Basketmouth apologized for the insensitivity of the joke. back in 2014.

    However, when Basketmouth was included as one of the influencers for European Union’s campaign on rape, Nigerians on social media noted that the comedian isn’t fit to be one of them, making reference to his 2014 joke.

    The EU in a statement acknowledged the concerns raised, stressing that it further strengthens their resolve.

    “We have been made aware of specific concerns regarding some of our influencers. We welcome the passionate engagement these conversations have evoked, which further strengthens our resolve to bring issues of sexual and gender based violence in our society to the fore.

    “The #HerStoryOurStory campaign is hinged on one of the core principles of the EU, which is Zero Tolerance for all forms of abuse against women. The campaign is one component of a wider engagement with stakeholders including institutions, civil society and ordinary citizens who are working on the front lines to completely eliminate sexual and gender based violence in Nigeria. “To this end, we remain committed, along with our partners to promoting conversations that challenge the status quo, while helping further the conversations to ensure a society free from all forms of gender based violence,” the statement said.

  • Court remands 72-yr-old man for allegedly raping, impregnating daughter

    The Chief Magistrates’ Court 10 in Gombe, on Monday remanded 72-year-old Ibrahim Yunusa in prison custody for allegedly raping and impregnating his biological daughter.

    Yunusa of Dadinkowa, Yamaltu/Deba Local Government, Gombe State had on arraignment pleaded not guilty to the charge.

    The Chief Magistrate, Daura Sikkam ordered the remand of the accused person and adjourned the case to Nov. 13 for further mention to enable police complete investigation.

    Earlier, reading the police First Information Report (FIR) Dalaky Wanma, the court clerk, said the accused committed the offences several times between Dec. 2018 and Jan. 2019.

    He said Yunusa forcefully had carnal knowledge of his 17-year-old biological daughter (name withheld) and impregnated her in his house.

    The clerk said the offence is contrary to sections 390 and 282 of penal code.

    The Police Prosecutor, Sgt. Bako Shekari, also told the court that police had just commenced investigations into the matter.

    He therefore asked the court for adjournment to enable the police complete investigations and seek legal advice from the Ministry of Justice

  • Nepal Police arrest former speaker over rape allegations

    Police Officials on Monday in Nepal said it has arrested the former parliamentary speaker over rape allegations by a government worker.

    Krishna Mahara, the speaker of House of Representatives, resigned from his job after the woman accused him of sexually assaulting her at her apartment in Kathmandu last week.

    “We received a complaint of attempted rape against him from the woman. We have also investigated the incident,’’ said Uttam Subedi, the head of the police in Kathmandu.

    Subedi said police took the former speaker into custody late Sunday and he would be presented before the court next week, due to the annual Dashain festival holiday.

    Mahara initially denied the allegations, but on Tuesday said he was stepping down to facilitate an impartial and fair investigation into the allegations.

    Mahara is the highest profile politician to face charges of rape in Nepal.

    If convicted, he faces up to five years in jail.
