How 13-year-old girl was allegedly gang-raped by 7 men

A medical doctor, Mistura Shogunle, on Wednesday narrated before an Ikeja Domestic Violence and Sexual Offences Court how a 13-year-old girl was allegedly gang-raped by seven men in her neighbourhood.

Shogunle testified at the trial of a 20-year-old fashion designer, Rasheed Fashola, for conspiracy and defilement of a child.

Fashola had pleaded not guilty to the two-count charge.

Led in evidence by state counsel, Mrs Olasunbo Abiodun-Muniru, the doctor working at the Mirabel Centre (a sexual assault referral centre), said that the minor came to the centre to seek medical attention on Sept. 28, 2020, a day after she was allegedly defiled.

“The client said that on Sept. 27, 2020 which was a Sunday, her father sent her on an errand, and seven boys in the neighbourhood stopped her.

“They dragged her into an uncompleted building, her mouth was covered with a handkerchief and they took turns to rape her through unprotected penile intercourse into her vagina,” Shogunle said.

The doctor said that the survivor was calm and clinically stable during the medical examination and that she had no obvious physical injuries.

“There were, however, significant genital findings. The labia majora was normal while the labia minora (inner lips of the genital) had a bruise.

“The natural covering of the vagina, called the hymen, was absent. There were no significant anal findings.

“The general findings are in keeping with recent blunt force penetration into her vagina which could have been caused by penile vagina penetration as declared verbally by the client,” she said.

The doctor, also a certified forensic sexual assault examiner, testified that she asked the survivor’s father, who accompanied her, to throw more light on what happened to his daughter.

She said that the father informed her that he sent his daughter on an errand and expected her to return home early but instead, saw her with two men who came to his residence to tell him that his daughter had been defiled.

Shogunle said that the minor did not tell her the names of the men who allegedly defiled her.

During cross-examination by defence counsel, Mr O.O. Ogunjimi, the witness said that she did not find any semen when she examined the survivor.

“It was not the day the incident happened that the client visited the Mirabel Centre.

“The client did not tell me whether she had taken her bath or not,” Shogunle said.

According to prosecution, Fashola, alongside others at large, committed the offence at 8. 00 p.m. on Sept. 27, 2020, in an uncompleted building at Oluwashina Junction, Itire, Lagos State.

“The defendant and his accomplices had unlawful sexual intercourse with the 13-year-old in the uncompleted building.

“The offences contravene Sections 137 and 411 of the Criminal Law of Lagos State, 2015,” Abiodun-Muniru said.

Justice Rahman Oshodi adjourned the case until May 6 for continuation of trial.

  • Alleged rape: Princess directed me to kiss, suck breast of minor – Baba Ijesha

Alleged rape: Princess directed me to kiss, suck breast of minor – Baba Ijesha

Nollywood actor, Olarewaju James, alias Baba Ijesha, on Friday testified before an Ikeja Special Offences Court that he was acting a script in the viral video with a minor.

Baba Ijesha made this revelation while being led in evidence by the defence counsel, Dada Awosika (SAN).

Baba Ijesha told the court that the foster mother of the minor, Ms Damilola Adekoya, a comedian also known as Princess, had called and requested him to be part of the movie production.

“On April 19, 2021, Princess sent me a message that she wanted to start a production and she would like me to play the role of a lover boy which I replied ‘okay’.

“She said I was to play the role of a lover boy adding that she wanted to surprise people that I can also play normal roles.

“She said the story is about rape and she wanted to tell the story in another dimension,” he said.

The defence counsel tendered before the court, a printout of WhatsApps message between Princess and the defendant, which was admitted into evidence by Justice Oluwatoyin Taiwo.

The embattled actor said he asked Princess for the movie location but she told him to come over to her house.

“Before I entered, Princess met me at the balcony that the movie production was a Lagos State project, adding that the state wanted her to be the face of ‘anti child molestation.’

“She told me to improvise and create a story by myself. I told her the house was dark when I entered. She said we should rehearse that she would use her phone.

“Princess told me to kiss and suck the breast of the child, adding that the dress the girl was wearing was purposely for the role the girl wanted to play.

“She would leave the room so that the child would not be shy to play out the role.

“All those things we are seeing in that video is just acting. My lord check my record when it comes to acting, I can kill myself and die for acting. She was the one directing and filming my angles,” he said.

Baba Ijesha told the court that himself and Princess were directors of the movie, adding that she told him he could act out the scene in the kitchen as well.

“She told me I could go into the kitchen as well. She told the girl in question you remember what I told you, when I leave the room now, act out your role perfectly.

“The girl removed my shoe and I started acting out my role. I romanced her based on the movie role Princess gave me.

“As I was acting with the girl, kissing and licking her fingers, I was also whispering to her ‘hey do not look at the camera’.

“Suddenly, I saw like eight people including Princess, entered the room and started beating the girl.

“I even thought it was part of acting. She beat her and said ‘idiot is that what I asked you to do’. One of the men gave me a blow and alleged that I raped the girl,” he said.

The defendant further told the court that he was shocked when he was being beaten and thought that the men who meted out the beating were amateur actors because they are not meant to use actual physical violence in movie scenes.

Baba Ijesha said that he was forced in one of the viral videos by Princess to admit that he defiled the minor.

“Princess said “you know I love you, just tell me that seven years ago you used your car key to disvirgin the girl” that she would allow me to go if I said so.

“I had to accept under pressure so that the men would not injure me the more, after Princess invited one police officer named Abigail, before I was taken to Sabo Police Station after,” he told the court.

The defendant said he was forced to sign a statement which was not written by him at the police station.

“The statement in question profiled me because I have all my information online and Princess knows all my information as well.

“Immediately, Abigail asked me to sign and I did just that, she took me back to the cell and I stayed there till the following morning,” he said.

Under cross-examination by the Lagos State Director of Public Prosecutions, Dr Babajide Martins, the defendant admitted to have known the girl since she was seven.

He added that he did not inform the Police at Sabo and Panti, respectively that they were acting.

“I did not inform the policemen that we were acting because I was not myself.

“I also did not inform them at the two police stations that Princess and I were in a relationship,” he said.

Probing Baba Ijesha further, Martins said: “While you were being beaten, you said you thought that they were amateur actors because of the actual violence.

“Since you said it was a movie script, so you are not meant to mimic sexual assault on an underage child?”

Baba Ijesha in his response said the scenes he acted with the minor were appropriate.

The defendant is facing a six-count charge bordering on indecent treatment of a child, sexual assault, attempted sexual assault by penetration and sexual assault by penetration.

Justice Oluwatoyin Taiwo adjourned the case until March 11 for continuation of defence.

Ronaldo’s lawyers allegedly threatens to sue his rape accuser

Lawyers to Manchester United striker, Cristiano Ronaldo, have allegedly threatened his rape accuser with “public exposure” and “humiliation” if she continued speaking to police investigating her claim.

Kathryn Mayorga had reported the alleged rape in a Las Vegas hotel room to police and also sued the Manchester United ace.

It was gathered that the rape accuser accepted a £276,000 pay-out from Ronaldo.

But it’s alleged that top lawyers representing Ronaldo and handling the civil case warned her that if she continues to talk to the police they wouldn’t continue settlement and would publicly accuse her of extortion.

The bombshell claim was revealed in a court transcript.

Mayorga‘s attorney, Leslie Mark Stovall, told the US District Court in September last year that Ronaldo’s lawyers had done their homework on Mayorga and knew she was “vulnerable to a very powerful individual and she was frightened of publicity.”

Stovall cited emails between Ronaldo’s lawyers which were exposed by whistleblowing website Football Leaks and said they “worked that angle”.

“What they did is they – and you’ll see it throughout the negotiations – ‘Well, if you continue to talk to Metro, we’re not going to continue settlement and we are going to publically (sic) accuse you of extortion, that you had consensual sex and that you’re now trying to extort money from this famous, well-known person.’

“And she was terrified of that. And that continued to be repeated and repeated and repeated throughout their correspondence. There was a threat.”

  • Italy request extradition of Robinho from Brazil over rape conviction

Italy request extradition of Robinho from Brazil over rape conviction

Italy is requesting the extradition of former football star Robinho from Brazil.

The ex-AC Milan winger was sentenced to nine years in prison in Italy for allegedly raping a woman in a discotheque with five other men in 2013.

Robinho, who won the Copa America in 2007 with Brazil, denies the accusations.

A final appeal by the footballer was rejected in January and on Tuesday; the Milan prosecutor’s office sent an international arrest warrant and extradition request to the Ministry of Justice in Rome.

From there, the documents will be forwarded to Brazil, the ANSA news agency reported.

However, the 38-year-old will probably not have to serve the sentence in Italy, because Brazil is not allowed to extradite him according to its constitution.

Robinho can only be arrested if he travels abroad and the international arrest warrant would then take effect.

In October 2020, Robinho wanted to make a comeback with his hometown club Santos, but because of pressure from sponsors and fans due to his conviction, the contract was quickly terminated. He then retired.

  • After repeatedly raping a nun, court sets Catholic Bishop free

After repeatedly raping a nun, court sets Catholic Bishop free

An Indian court has acquitted a Catholic bishop who was charged with raping a nun in a case that sparked widespread outrage and protests.

Bishop Franco Mulakkal, 54, was acquitted by a court in the southern Indian state of Kerala on Friday, which said the prosecution had failed to prove any of the charges against him.

The nun, whose identity is protected under Indian law, had alleged that Mulakkal, who was the bishop of a diocese in Jalandhar in the northern state of Punjab at the time, raped her 13 times between 2014 and 2016 when he would visit the convent where she lived in southern state of Kerala.

The convent, Missionaries of Jesus, is part of the Jalandhar diocese. The nun faced “harassment” and “threats” from the bishop for two years in a bid to keep her silent about the alleged rape, but she “finally gathered courage in 2016” to come forward, she told CBS News in an off-camera interview in 2019.

The Vatican did not immediately reply on Friday to CBS News’ request for comment on the case.

Her allegations against the bishop became public in 2018, when she petitioned the Vatican and wrote an open letter to Pope Francis’ representative in the Indian capital of Delhi. When her story emerged, it led to major protests led by a group of nuns supporting her, as well as activists who added their voices to demands for justice and the arrest of the bishop. He was arrested later that year.

Five nuns, close associates of the woman who alleged the rapes, accused the church in Kerala of ignoring the allegations and instead pressuring them to withdraw the case.

“Father James Erthayil offered 10 acres of land and a separate convent for six of us if we withdrew the case,” Sister Neena Rose, a close associate of the nun who made the rape allegations, told CBS News in 2019. She said someone had offered the purported rape survivor $675,000 to keep quiet.

The nuns even wrote to Pope Francis directly in 2019, when he was hosting a landmark summit on clergy sex abuse, but they say their letters have never been answered.

“At least the pope should see our tears,” Sister Alphy Pallasseril, one of the five nuns publicly supporting the claimant, told CBS News in an emotionally charged interview in 2019. “We have no words to say how much we are suffering.”

Pallasseril, along with the other nuns who participated in the protests, later faced harassment including threats of disciplinary action, transfers and expulsion from the congregation, they told CBS News.

The bishop’s acquittal surprised the nuns, and the lawyers fighting the case.

“We would definitely challenge the verdict in a higher court after going through the order in detail,” Special Public Prosecutor Jithesh J. Babu told CBS News on Friday.

“The verdict is shocking, the victim has been denied justice, but we take it as a challenge,” Sister Lucy Kalappura, another close associate of the nun in question, told CBS News. “We are all with our sister to support her… this is just a step in the legal process, we will fight the case in a higher court.”

Kalappura was expelled from the Franciscan Clarist Congregation (FCC) of Kerala in 2019.

Indian TV showed the bishop smiling as he walked out of the court in Kerala state on Friday. His legal team told CBS News partner network BBC News that it had “shattered the entire evidence” against him.

3 teenagers in court for allegedly raping 15-year-old girl

Three teenage boys on Friday appeared before an Ikeja Chief Magistrates’ Court for allegedly gang raping a 15-year-old girl.

The defendants, Pelumi Osho, 17; Oluwafemi Shobayo, 17, and Victor Elijah, 17, who all live in Akowonjo, Lagos State, are facing a two-count charge of conspiracy and rape to which they pleaded not guilty.

The Prosecutor, ASP. Victor Eruada, told the court that the defendants committed the offences with some others still at large on Dec. 25, 2021 at Victoria Hotel, Akowonjo.

Eruada said the defendants lured the victim to the hotel and gang raped her without her consent.

“The case was reported to the police and the defendants were arrested,” the prosecutor said.

According to the prosecutor, the offences contravene Sections 411 and 260 of the Criminal Law of Lagos State, 2015.

The Chief Magistrate, Mr Lateef Owolabi, granted all the defendants bail in the sum of N500, 000 with two sureties in like sum.

Owolabi said the sureties should be gainfully employed with evidence of two years’ tax payment to the Lagos State government.

He adjourned the case until Feb. 15, for mention.
