    Why rapists should not be allowed to roam the Streets –Oluremi Tinubu

    Nigeria first Lady, Senator Oluremi Tinubu, has called for the appropriation and enforcement of stiffer laws and punishment for rapists and perpetrators of sexual abuse and other forms of gender-based violence in the country.

    The First Lady, who decried the alarming rate of Rape cases, said those involved should not be allowed to roam the street and hurt other persons.

    She made the call at the 1st gender and Social Norms Summit organized by the United Nations Population Fund, UNFPA in collaboration with the Office of the First Lady of Nigeria.

    According to her, “there must be improved legislation to give, and enforce appropriate punishment to perpetrators of rape, sexual abuse and other forms of gender based violence, who are dangerous and not deserving of roaming the streets. We have to speak not only firm and tough but act accordingly”.

    She decried the increased spate of rape cases and gender based violence, which she described as alarming, adding that “Every single day, we hear about rape cases, even our babies are violated. Do we allow this trend to continue or do we look the other way?

    “That is why I am calling on the law enforcement agencies, the Inspector General of Police, the Attorney General of the Federation and the Chairman of the National Assembly, who is the Senate President, to appropriate and enforce stiffer laws and punishment to perpetrators of rape, sexual abuse and other forms of gender based violence. No guilty party should be allowed to go free and start roaming the streets looking for the next victim”.

    United Nations Population Fund, Gender Analyst, Karima Bungudu, while presenting the works of the UNFPA in Nigeria based on situational Analysis pointed out that nearly one in three Nigerian women have experienced some form of gender-based violence including women with disabilities who are the more susceptible and vulnerable ones.

    The prevalence of harmful practices such as Female Genital Mutilation, child marriage, which, in some cases, leads to Vesicovaginal Fistula (VVF) and other forms of violence against girls and women remain unacceptably high.

    Police nab 3 suspected facebook scammers, kidnappers, rapists in Delta

    The Police Command in Delta says it has apprehended three suspected Facebook scammers, kidnappers, and rapists in the state.

    The spokesman of the command, DSP Bright Edafe disclosed this to newsmen on Wednesday in Warri.

    Edafe said that the suspects were nabbed on Monday by police operatives attached to Ufuoma Police Division in Ughelli North Local Government Area of the state.

    He said that the arrest followed a complaint from a lady (name withheld) that she saw one of the hoodlums that kidnapped her on Dec. 11, 2022.

    According to Edafe, the victim complained that the suspects held her hostage at a hotel in Iwherekpokpor community, Ughelli North, video and also took her nude pictures.

    Edafe said the victim reported that the suspects used the video and nude pictures to blackmail and demand for ransom from her parents.

    “On receipt of this complaint, the DPO Ufuoma Police Division immediately detailed a combined team of Police detectives and Ekiugbo Community vigilante members and arrested one Cornelius Emene.

    “During preliminary investigation, the suspect made useful statement that led to the arrest of two others, Nelson Aghogho and Ufuoma Tunde.

    “The suspects also gave account of how they kidnapped another student of the School of Health and Technology, Ofuoma in Ughelli North,” he said.

    Edafe said that the modus operandi of the syndicate was to lure unsuspecting young girls on facebook, took them to a hotel, drug and gang raped them.

    He added that the suspects thereafter held them hostage and demanded ransom from their parents to secure their release.

    According to the spokesman, the suspect’s phones contained numerous nude photos and video recordings of their previous victims which they used to blackmail the victims and their parents.

    Edafe said the investigation into the matter was ongoing.

    Police arrest two men who gang-raped 18-year-old female passenger

    Police operatives in Ogun State have arrested a commercial motorcyclist and his collaborators who gang-raped an 18-year-old female passenger in the State.

    It was gathered that the incident happened at the Ogijo area of Sagamu Local Government Area of the state on Tuesday, August 30th.

    The culprits whose names have been given as Emmanuel Thompson and Joshua Godwin are at the moment cooling off in police cell.

    The state police spokesman, Abimbola Oyeyemi, confirmed the incident and noted that the culprits are presently cooling off in police cell.

    The victim (name withheld) had told the police that she boarded a commercial motorcycle at about 8:00 am from the MRI company area to Ogijo bus stop on Tuesday; “but on the way going, the rider who carried another male passenger with her suddenly diverted to another route, while the other male passenger started threatening to kill her if she did not cooperate with them.”

    Oyeyemi said the teenager reported that “they forcefully took her to a room in one house in the area, where two other men were waiting for them.

    “On getting there, the two men they met in the room and the accompanied male passenger took turns to have sex with her forcefully.”

    On receiving the report. the District Police officer of Ogijo division, CSP onanufe Umoh said he drafted his men to arrest the culprits but noted that two other perpetrators vanished into thin air.

    “The two arrested suspects have confessed to the commission of the crime.”

    Meanwhile, the Commissioner of Police in Ogun, Lanre Bankole, has directed the transfer of the suspects to the State CIID for further investigation and diligent prosecution.

    Bankole assured that the other two fleeing culprits will be arrested in no time and be made to face the consequences.

    The Minister of Women Affairs and Social Development, Pauline Tallen, has recommended castration for rapists and sexual perverts in Nigeria.

    Tallen said that such people should be shamed and named to check the situation.

    She stated this on Sunday during a press conference organised to herald the hosting of the Executive Director of the United Nations Population Fund, Dr. Natalia Kanem.

    She said, “It is the worst crime against any child. It is not only the child that is badly traumatised and she will live with it for life, the mother too will remain traumatised for all her life and for that, we are advocating for a very stringent punishment for such cases of incest.

    “I commend the government of Kaduna state for amending the VAP law to include castration and I am advocating that for any perpetrator that is caught to be castrated.

    “If we do one or two, I believe the high burden of incest and rape will drop and that is why we are insisting that all states must domesticate the VAP Act and the Child Rights Act but not just domesticating it, but ensuring high implementation.

    “The naming and shaming of perpetrators will also help to stem down the cases of incest.”

    While urging women and girls who fall victims to rape and incest not to be coerced into silence especially by family members, Kanem advised the society to desist from laying blames on affected individuals, but rather, demand justice for the right, dignity and wellbeing of the victims who may end up traumatised.

    Rapists risk castration in Kaduna

    With the amended Penal Code 2020 signed into law on Wednesday by Kaduna State Governor Nasir El-Rufa’I, rapists risk surgical castration upon conviction.

     

    Besides, convicts’ names are to be listed on the Sex Offenders Register that will be published by the Attorney-General and Commissioner for Justice.

     

    The amended bill was passed into law last Thursday by the Kaduna State House of Assembly.

     

    The development was declared on El-Rufai’s official Twitter handle @GovKaduna Wednesday night.

     

    According to the Twitter post, “Malam Nasir @elrufai has signed the Kaduna State Penal Code (Amendment) Law 2020 which provides stiff penalties upon conviction for the rape of a child, including surgical castration for male convicts and bilateral salpingectomy for female convicts”

     

    Similarly, a statement posted on the governor’s Facebook wall said “the amendment updates the penalties for the offence of the rape of a child, which include the punishments of surgical castration and bilateral salpingectomy for male and female convicts of child rape, and death.

     

    According to the statement signed by the Governor’s Special Adviser on Media and Communication, Muyiwa Adekeye, said, the convicts will in addition, be listed in the Sex Offenders Register to be published by the Attorney-General of the state.

     

    He said: “Following Malam El-Rufai’s assent to the amended law on 11th September 2020, the new law has come into effect in Kaduna State. It introduces stricter punishments than the previous law which carried a maximum penalty of 21 years imprisonment for the rape of an adult and life imprisonment for the rape of a child.

     

    “Under the amended law, the punishment for the rape of a person older than 14 years will include surgical castration or removal of fallopian tubes, but the death penalty shall not apply. In cases where the rape convict is also a child, the court shall order an appropriate punishment under the Children and Young Persons Law Cap 26, Laws of Kaduna State 1991.

     

    “While commending the members of the Kaduna State House of Assembly for passing the amendments, the Governor stated that these drastic penalties are required to help further protect children from a serious crime.

     

    “The Kaduna State Penal Code (Amendment) Law 2020 amends the Penal Code Law (No.5) of Kaduna State, 2017 by substituting section 258 as follows:

     

    Whoever commits rape of a child below the age of fourteen (14) years shall on conviction, be punished with Surgical Castration and death;

    Whoever has sexual intercourse with a male child below the age of fourteen years shall be punished with surgical castration and death;

    Where a female adult is convicted for the offence of rape of a child, the Court shall punish the accused with Bilateral Salpingectomy and death;

    Where the victim is above fourteen years, the Court shall on conviction sentence the accused with a punishment of surgical castration and life imprisonment;

    Where the convict is a child, the Court shall order as appropriate under the Children and Young Person Law Cap 26 Laws of Kaduna State 1991;

    Where the victim is a child, the Court shall in addition to the conviction, order that the convict be listed in the Sex Offenders Register to be published by the Attorney General;

    Where the Court is trying the offence of rape involving a child below the age of fourteen years, corroboration of a medical report shall be necessary.”

    Outspoken actress, Halima Abubakar has averred that the panacea to curb rape is to castrate rapists.

    She added that it is up to us to protect our society by looking out for other people’s kids and not turning a blind eye when it’s someone else involved.

    Abubakar wrote on instagram:” The more we fight against rape and injustice is the more this evil act is on the rise. Protect your environment. Protect other people’s kids. Don’t say what’s my own.So many love to say that. Cut the penis off. Rapists are menace to the society”.

    In a recent interview, the actress noted that men who jump from one woman to another are likely gay.

    Hear her:” I know so many people who are married and they are bi-sexual. I’m saying this because it is the truth and those reacting are the guilty ones. Tell me why a man will change girls at random? What exactly are they looking for if it is not a man? Nigerians don’t accept the truth because half of us are hypocrites. I Halima Abubakar am telling you that a lot of people are bi-sexual. They should save the lives of future generations by coming out, if they don’t want to come out, they should not get married”.

    There is a rape epidemic ravaging the country. Media reports show that some men have gone crazy over illegal sex and have resorted to bestial actions with the other sex. Some prey on children. Some perpetrators are family. They prey on little girls, sometimes as young as three months. Daddies rape their daughters. For some daughters, it has become routine, having gone on for years. And the girl child involved becomes both as a victim and a partner of sorts because it continues into adulthood. There have also been shocking reports on social media about men raping and killing their victims, ostensibly to cover up the crime. A lady was killed in Ibadan because she refused to be raped! Groups have taken to the streets to protest the upsurge in rape cases. State governors have declared an emergency on rape matters. It is a serious matter now in a crisis mode. It deserves all the attention that the nation can give. Any father who has girls feels the fear of his dear daughter being violated someday by a pig of a man! It is not a good feeling!

    But there are some disturbing questions which we should answer now that the issue has caught national attention. Why the sudden upsurge in rape cases? Does it have any connection with the lockdown? Or has society simply become more aware and liberal as to report incidents which had always been hidden? Have we always reported rape cases? Have we done away with the stigma that comes with rape? How do families handle incestuous rapes? What has become of the idea of tabooed actions? How do rape victims deal with the often-traumatic experience?

    Rape has always been present in society. It comes in different forms. Any sexual activity between a man and a woman or between two persons without mutual consent is rape. Rape is a ‘type of sexual assault usually involving sexual intercourse or other forms of sexual penetration carried out against a person without that person’s consent’. Modern definitions add the fact that it ‘may be carried out by physical force, coercion, abuse of authority, or against a person who is incapable of giving valid consent, such as one who is unconscious, incapacitated, has an intellectual disability or is below the legal age of consent’. There is also the unusual occurrence of a woman raping a man, often a minor, or a gang of women raping a man. Whatever it is, rape is a crime, a defined by the law.

    There is also the angle of rape in a husband-wife relationship. While stating that a wife who is forced into sex by her husband is a victim of rape, no wife in Africa is likely to show up in court to report that her husband forced himself on her. To be sure, even her own family would ‘feel disgraced’. Which is one of the issues on rape cases: what will the family say, how will the family feel if this report comes out in the open? A variant of this is would the lady involved find a spouse later in life if it is known that she had once been raped? Sadly, the name or reputation of the family is considered more important than the feeling of the victim. I do not speak about women who naturally enjoy being forced by their partner anytime they need to have sex. That is another matter completely.

    Wikipedia states that ‘Southern Africa, Oceania and North America report the highest numbers of rape’ and that ‘500,000 rapes are committed annually in South Africa, once called ‘the world’s rape capital’. Rape is also on the rise in India, often carried out with impunity owing to some cultural beliefs in some areas that see women as property and less than human beings. It is also reported that ‘7 out of 10 cases of sexual assault involved a perpetrator known to the victim’. There is also the angle of blaming the victim. Why did the lady dress in a provocative manner? Why did she visit the man in an odd hour? Why did she sleep over if she knew she was not ready to have sex? Let us start by saying that anyone who blames the victim is not aware of the psychology of forced sex. I subscribe to the view that no lady should dress provocatively and visit a man in a secluded place. But the man who forces a girl or a boy into having sex is an offender. As WARIF Centre puts it, ‘it is important to always remember that rape can happen to anyone, but it is never the fault of the survivor, under any circumstances: it is ALWAYS the fault of the rapist’.

    One of the challenges of rape is the low level of prosecution despite the high number of media-reported cases. Some victims agree to ‘settle the matter’ with the active connivance or encouragement of law enforcers. Although the Penal Code of Nigeria (Section 282), the Criminal Laws of Lagos State (Section 258), and Violence Against Persons Prohibition Act (Section 1) all present rape as serious offence, one unconfirmed report states that there have been only eighteen convictions in Nigeria! Most rape cases are never reported. Even some ladies find it difficult or impossible to tell their parents or guardians!

    Rapists should be prosecuted and convicted. Victims identities should be protected. Known rapists should be named and tagged. A special anti-rape unit should be created in the Nigeria Police dominated by trained women. There have been too many cases of policemen blaming the victim. There should be more advocacy programmes on the subject. The law should not be a respecter of persons. Some of the very powerful men in institutions – universities and polytechnics, banks, corporate organizations, churches, and mosques- believe that their position is security to inflict pains on the opposite sex. Fathers who violate their toddler daughters fit into this category. We need scapegoats. We also need active shelters for ladies who may need a place of refuge once they go public with their story.

    No responsible man should rape a woman. Pastors who force themselves on vulnerable ladies should remember what Moses says in Deuteronomy 22: ‘if a man find a betrothed damsel in the field, and the man force her, and lie with her: then only the man that lay with her shall die’. Imams who violate girls should remember that ‘rape is committing zina (meaning illicit sexual intercourse) by force, hence rape is known as zina bi al-ikrah’. No sane society should tolerate or indulge rapists in any form. Stiff punishments should be meted out and publicized. This does not always serve as a deterrent to others which makes extremists suggest that a second time offender may need to forfeit his sexual organ to the state! No extant law has that provision in Nigeria. But is it worth considering?

    Imo declares battle as rapists kill victim

    The Imo State Government on Monday promised to fish out suspected ritualists who killed a 45-year-old woman, Mrs Susanna Iwuoha, after raping her.

     

    Iwuoha, a mother of four from Alaocha in Ihitte Uboma council of the state, was found dead with her face in a local stream days after she left home to harvest cassava from her farm.

     

    The woman whose undergarments were taken away, was discovered by a community search party after her children raised the alarm over her disappearance since June 3.

    A man identified as Bernard Ekeka, who is believed to have seen the assailants, was also killed.

     

    The woman’s alleged rape and murder, it was gathered, created fright in the community especially because two other women identified as Mrs Chidinma Nwokorie and Mrs Evelyn Duru were recently raped.

     

    Locals told newsmen that they believed the perpetrators were likely enemies within.

     

    Commissioner for Special Projects, Simon Ebegbulem, on Sunday appealed to residents to avail the police of information to aid the arrest of the perpetrators.

     

    Ebegbulem, community leaders and the divisional police officer (DPO), Etiti Division, Charles Njoku, have visited the community.

    The commissioner guaranteed the people that the Hope Uzodinma administration will ensure justice is served.

    Akwa Ibom detains 23 rapists

    The Akwa Ibom State Government said 23 rapists were jailed lately in the state.

    The state Commissioner of Agriculture and Women Affairs, Gloria Edet, who disclosed this while speaking with newsmen on Saturday, expressed shock over the increasing cases of rape and other various crimes against the feminine gender.

     

    She said, “We’ve received reports of rape cases in the country and Akwa Ibom State is not left out, even though in Akwa Ibom State, the law is being implemented and God has helped us to jail over twenty-three rapists.

     

    “The number of rape cases is becoming alarming every day and I am calling on the citizens to report incidences of rape and other violent crimes against the female gender to law enforcement agents and other relevant government agencies for prompt intervention.”

     

    Edet said the state government has approved the establishment of Gender-Based Violence Referral Centres in each of its three Senatorial Districts to address the growing menace of rape in the state.

     

  • Sexual violence: NAPTIP vows to publish names, photos of rapists

    The National Agency for the Prohibition of Trafficking in Persons has urged Nigerians to report cases of rape within their vicinity to the agency or the nearest police station.

    It said the names and photos of sex offenders in the country would soon be published.

    NAPTIP Director-General, Julie Okah-Donli, made this known on Thursday in Abuja following the rising cases of rape in the country.

    According to her, reporting cases of rape is the only way to curtail the abominable act, adding that the agency will act on reported cases.

    She said, “Rapists are now getting away with their illicit acts along with murder; these cases of domestic servitude are cases that take place behind closed doors.

    “Our job in NAPTIP is to protect Nigerian men and women, we are not going to compromise our work if they report such cases and we will ensure justice is done
