  • FG insists on continuing Onnoghen’s trial despite resignation

    Indications emerged on Wednesday that the Federal Government has opted to continue with the trial of the outgoing Chief Justice of Nigeria, Justice Walter Onnoghen at the Code of Conduct Tribunal (CCT).

    It was confirmed on Wednesday at the CCT that Onnoghen’s lawyers have filed their final address.

    The prosecution team is expected to submit its final address on Thursday (today).

    Justice Onnoghen is said to have bungled his chances to meet with President Buhari to resolve the impasse amicably in the interest of the Executive and the Judiciary.

    After Justice Onnoghen’s resignation, it was not immediately clear whether or not President Muhammadu Buhari would direct that his trial at the Code of Conduct Tribunal be stopped.

    While some government officials wanted the trial concluded, some members of the Bench and the Bar insisted on the decision of the National Judicial Council (NJC) to retire Justice Onnoghen.

    Although the President was said to be weighing options on the NJC’s report, which made recommendations on Justice Onnoghen’s future, a government official who spoke anonymously said his trial will be concluded.

    The source said: “The government will not withdraw the case against Onnoghen in CCT in order not to set a bad precedent.

    “We want the case to run its lifespan for posterity and to avoid reading of political meanings into it. When this case started, there was much uproar, that it was politically motivated by the presidency. We want the tribunal to decide the case on merit.

    “The NJC’s report also did not say that the trial be halted. It only demanded the retirement of Onnoghen. This is why no directive has been given to the Code of Conduct Tribunal, which is prosecuting the case, to withdraw the charges against the CJN.”

    The source, who stressed that there was no deal with Justice Onnoghen over his trial, claimed that the CJN bungled his chances to decide his fate in the interest of the Judiciary.

    The source added: “There were moves to prevail on the President not to allow the CJN to be on trial in CCT. The first window came from the Nigerian Bar Association(NBA) which sent a delegation to Vice President Yemi Osinbajo. The NBA team wanted soft-landing for Onnoghen. Some terms were agreed upon, including resignation or voluntary retirement by Onnoghen.

    “The NBA team was mandated to prevail on him to quit honourably in view of some overwhelming allegations and investigative reports on him. The CJN, who was initially amenable to reconciliation, later backed out.

    “The second mediation was about another proposed confidential session between President Buhari and Onnoghen, which was facilitated by some highly-placed Nigerians. They wanted the President to hear from Onnoghen to pave the way for his quiet retirement from office without subjecting him to trial.

    “The CJN consented to the session with the President but he aborted it at the last minute without any justifiable cause.

    “Onnoghen had over-relied on the outcome of NJC’s investigation – that it would be in his favour. He had no choice than to throw in the towel when the NJC advised Buhari to retire him. It was at this stage he chose to voluntarily leave office.”

    Speaking with in an interview with The Nation on Wednesday night, the Chairman of the Code of Conduct Bureau, Dr. Muhammed Isah, said: “We have not received any directive from the Chief Law Officer of the Federation, Mallam Abubakar Malami(SAN), who is the Attorney-General of the Federation and Minister of Justice, to discontinue the case.”

     

  • APC reacts to Onnoghen’s resignation

    The ruling All Progressives Congress (APC) on Friday said the resignation of the suspended Chief Justice of Nigeria, Justice Walter Onnoghen has vindicated the action taken against him by President Muhammadu Buhari as well as the party’s earlier call for his resignation.

    Justice Onnoghen’s resignation came a few hours after the National Judicial Council reportedly recommended him to President Buhari for retirement with full benefits.

    The National Publicity Secretary of APC, Mallam Lanre Issa-Onilu, told newsmen in his office that the resignation of the suspended CJN should have been the first step for him to take when it became obvious that he made the mistake of not properly declaring his assets as required by law.

    He said with the CJN standing trial for non-declaration of assets and the previous trial of the Senate President for the same purpose, it is gradually becoming clear to public office holders that there is nobody above the law in the country.

    Onilu said a time is coming when a President who misbehaves will also be docked for wrongdoing, stressing that all those who criticised the President for obeying the ruling of the Code of Conduct Tribunal will now realise that their action was not in the interest of the country.

    Onilu said: “The issue we have in this country is that many people, especially those who have been part of the impunity of the past, are struggling badly to adjust to the reality of rule of law.

    There is so much struggle to allow the past. It is not good enough for us as a country to allow it go. All of us must rise and face the future; a future of promise and a future of change, so that we can move to the ‘Next Level’.

    When this happened, the PDP and some of their allies in the civil societies read the barometer of politics, and we do know that until we rise above sentiments, no matter what part of the divide you find yourself, we must realise that this is an issue that has to do with our country. That is the only way we can progress.

    We knew right from the beginning that the allegations against the former Chief Justice of Nigeria were too serious to be swept under the carpet, and we know that the President does not act on frivolities.

    He must have done his background checks and must have gotten good information to have taken the action he took, especially when there was basis for the action that can be legally proven.

    Those lawyers, so-called Senior Advocates of Nigeria, who had over the years dipped their hands along with some of these judicial officers into the till of this country, continued to lampoon the President, lampoon the APC and blame this government that is doing its best to right several of the wrongs that we have been used to.

    We were actually the one trying to deepen democracy. And this party rose in the defence of the President because we understand what the President was doing and that he meant well, and we know the real purpose that drives his actions.

    Now, events have proven the President right. Events have proven the party, APC, right. Events have proven those Nigerians who believe Nigeria first and any other things after – events have proven them right.

    We all can only be hiding behind one finger. Otherwise, we knew Nigerians, reasonable Nigerians, knew from the word go that those allegations were not cooked up, and if they were real, the next thing for the CJN to have done was to have stepped aside.

    If he had done that, the question of he wouldn’t be the only one, why him, should not have arisen. There is nowhere in the world where judgment is passed on every sinner at once.

    It is not every armed robber you can catch the same day. And even some of you know the slow pace of justice may not catch up with them immediately.

    But we must continue to see evidence that we are moving towards that sanity and that we are making progressive efforts and sending strong signals to people who think this country must continue as long as they are comfortable and the rest of Nigerians are suffering.

    We must send that signal to them that it is not going to be business as usual.

    Now, you have seen the head of National Assembly, Senate President, in the dock. Now, you have seen the CJN in the dock. So, one day, we will see a President that also misbehaves in the dock, which now shows that nobody is above the law and that we are all equal before the law.

    So, anybody who finds himself in any position should now begin to look closely at his own actions, knowing full well that today may protect him but tomorrow may expose him.”

  • Presidency keeps mum on status of Onnoghen’s resignation letter to Buhari

    The presidency has yet to confirm the receipt of a letter of resignation by the suspended Chief Justice of the Federation, Justice Walter Onnoghen, 24 hours after the speculation went viral.

    According to reports, Onnoghen’s resignation letter was submitted to the Chief of Staff to the President, Malam Abba Kyari, by some Justices of the apex court.

    The Justices according to presidential sources arrived at the presidential villa few minutes after President Muhammadu Buhari left Abuja for Jordan to participate in the World Economic Forum (WEF) on Thursday.

    A presidency source confirmed that President Buhari had, before his departure, received the National Judicial Council’s recommendations on the petitions written against Onnoghen and the acting CJN, Justice Tanko Muhammad.

    The report was submitted to the president by his Chief of Staff, Mallam Abba Kyari, who was accompanied by the Attorney-General and Minister of Justice, Abubalar Malami, at about 2:20 p.m on the day.

    The Director, Information, NJC, Mr Soji Oye, on Wednesday in a statement, confirmed that the council had sent its report to President Buhari after the conclusion of its investigation into the petitions against Onnoghen and the acting CJN.

    All efforts to speak to presidential spokesmen, Mr Femi Adesina and Mallam Garba Shehu, on the matter proved abortive as the duo were outside the country on official and private engagements.

    While Adesina is currently on President Buhari’s entourage to Jordan, Shehu is in Saudi Arabia on pilgrimage.

    Meanwhile, lawyer to Onnoghen, Adegboyega Awomolo (SAN) has explained why his client resigned. Awomolo, while confirming that Onnoghen resigned on Thursday, said he (Onnoghe) said he acted in the interest of the judiciary.

    The lawyer said: “I have just spoken with him. He confirmed to me that he resigned yesterday.

    He said he resigned in the interest of the Judiciary.

    Onnoghen’s humble rise to the peak

    Onneghen was born on the Dec. 22, 1950 at Okurike Town, Biase Local Government Area of Cross Rivers.

    He began his primary school education at the Presbyterian Primary School, Okurike Town between 1959 and 1965.

    Before his appointment as the Chief Justice of the Federation, he worked with the Ministry of Justice, Ikeja, Lagos, Ogun, between 1978 and 1979, as the Pupil State Counsel.

    Between 1989 – 1998, he was a High Court Judge of Cross River Judiciary.

    During his time as the High Court Judge of Cross River, he was made the Chairman of Cross River State Armed Robbery and Firm Arms Tribunal and he held the post for 3 years from 1990 – 1993.

    Sometime in 1996 while still holding the post of High Court Judge of Cross River, he was appointed the Chairman, Judicial Enquiry into the Crisis between Students of the University of Calabar and Obufa Esuk Orok Community, Calabar.

    In 1998, he was the Chairman, Failed Banks Tribunal, Ibadan Zone.

    Between 1992 and 2004, he served as the Judge, High Court of Rivers, while from 1998 to 2005, he served as Justice of the Court of Appeal.

    In 2007, Justice Onnoghen played a huge role in 2007 election which saw the Late Umaru Yar’adua as President of Nigeria.

    He had a dissenting judgment that indeed annulled the presidential election. His position was however a minority judgment.

    After being nominated as the Chief Justice of the Supreme Court of Nigeria by the Acting President, Professor Yemi Osinbajo, he was confirmed by the Senate on March 1, 2017, and sworn in on March 7.

    Suspension and trial at CCT

    Onnoghen’s trials for false assets declaration started when a petition was filed by the civil rights group at the Code of Conduct Bureau (CCB), alleging that he owned sundry accounts.

    It alleged the accounts were primarily funded through cash deposits made by himself up to as recently as August 10, 2016, which appeared to have been run in a manner inconsistent with financial transparency and the code of conduct for public officials.

    The trial began on Jan. 14 at Code of Conduct Tribunal but Onnoghen was absent.

    Also on Wednesday, the National Judicial Council abstained from considering allegations relating to the assets declaration that were levelled against Onnoghen.

    On Feb. 11, the council set up a preliminary complaints assessment committee to review the responses given to it by Onnoghen, and Muhammad who is acting in his stead.

    Onnoghen is accused of failing to fully declare his assets, while Muhammad is facing allegations of misconduct.

    The NJC said it reconvened and resolved to constitute into the Preliminary Complaints Assessment Committee in accordance with Regulation 17 of the National Judicial Council Judicial Discipline Regulations, 2017.

    Falae officially writes INEC over retirement as SDP chairman

    Former Secretary to the Government of the Federation and presidential candidate of the Alliance for Democracy in 1999 elections, Chief Olu Falae has officially written to the Chairman of the Independent National Electoral Commission (INEC), Prof Mahmood Yakubu, on his retirement as Chairman of the Social Democratic Party (SDP).

    According to the letter dated February 19, 2019, and made available to The Nation on Thursday by the SDP’s Director, Media and Publicity, Hon Yemi Akinbode, Falae said the Deputy National Chairman 1 from his Zone, Prof. Tunde Adeniran assumes the position of National Chairman in an acting capacity for the rest of his tenure which expires in March 2020.

    The letter reads in part: “I write to inform you that I have retired voluntarily from active partisan politics with effect from February 8, 2019, and therefore ceased to be the chairman of the Social Democratic Party (SDP), from that date. In accordance with the provision of Section 13.2 (ii) of our party’s constitution, Professor Tunde Adeniran, the Deputy National Chairman 1 from the chairman’s Zone, assumes the post of National Chairman in an acting capacity for the rest of his tenure which expires in March 2020.

    I wish to thank you, your fellow commissioners and other staff for the courtesies you always extended to me while I served as the National Chairman of the Social Democratic Party.”

    The National Chairman of the Peoples Democratic Party, PDP, Prince Uche Secondus has said that shoddy arrangement for this election by the Independent National Electoral Commission, INEC, is a deliberate pre determined agenda of President Muhammadu Buhari to cling on to power even when it’s obvious to him that Nigerians want him out.
    Prince Secondus said that the postponement which is part of a grand design by the All Progressives Congress, APC, to thwart the will of Nigerians at all cost, clearly exposes INEC as a failure and calls on the Chairman of the Commission, Prof Mahmood Yakubu to resign immediately.
    The PDP leader warns that the party will not accept anything short of a well organized electoral process devoid of manipulation, harassment and intimidation of voters and the opposition particularly members of the PDP.
    Having failed in all their nefarious options to enable them cling on to power, the APC and the INEC came up with the idea of shifting election an action that is dangerous to our democracy and unacceptable.
    The National Chairman said that the APC in connivance with the INEC have been trying all options including but not limited to burning down INEC offices in some states and destroying of electoral materials to create artificial problems upon which to stand for their dubious act.
    According to a statement from the National Chairman’s media office signed by Ike Abonyi, Prince Secondus said that the party is privy to all the pressures from the APC and the federal government to arm twist the INEC, to dance to their new strategy after their earlier ones failed.
    “With several of their rigging options failing, they have to force INEC to agree to a shift in the election or a staggered election with flimsy excuses pre manufactured for the purpose.
    “For the avoidance of doubt the PDP sees this action as wicked and we are also aware of other dubious designs like the deployment of hooded security operatives who would be ruthless on the people ostensibly to scare them away.
    He said that by the action of the President he has further demonstrated his insensitivity costing the huge cost after Nigerians including those who came home from abroad have all mobilized to their various constituencies.
    The National Chairman recalls that the PDP had earlier alerted Nigerians that the APC was coming up with lined up rigging strategies including burning down of INEC offices and engineering crisis in PDP strong hold areas to scare away the people.
    Prince Secondus said that the wicked killing of over 60 persons mostly women and children in Southern Kaduna on the eve of election is a copious ploy by the APC to frighten the people away from voting knowing too well that they were not going to record any vote from the area.
    “Recall that the Governor of Kaduna state, Mallam Nasir el rufai had earlier threatened international election observers of going to their country in body bags and with the fatal violence in the state on the eve of election, it’s clear what the motives are, to frighten the observers from the state so that he can carry out his nefarious acts.
    The National Chairman also drew the attention of all lovers of democracy to the statement of President Buhari on the international media that nobody can unseat him from office as an indication of what he wants to do.
    Prince Secondus also regretted that President Buhari who made a promise at the signing of peace accord that the election will be conducted in a fair and transparent atmosphere has gone ahead in breach of the peace agreements to send soldiers and other security agencies to arrest, harass and intimidate opponents in Rivers, Akwa Ibom, Kwara, Kano, Kaduna states.

  • Suspended CJN Onnoghen speaks on alleged resignation

    Embattled Chief Justice of Nigeria, Justice Walter Onnoghen on Monday denied reports making the rounds that he has officially resigned.

    Recall that President Muhammadu Buhari last Friday suspended the CJN replacing him with Justice Tanko Mohammed, as Acting CJN.

    The denial was contained in a statement signed and released by the CJN’s media aide, Awassam Bassey on Monday.

    Bassey described the CJN’s rumoured resignation as “fake news circulated by mischief makers.”

    Mischief makers are still circulating this fake news. Once again, no truth in it whatsoever. The Hon CJN, Hon Justice Walter Samuel Nkanu Onnoghen, GCON, has not resigned,” Bassey said.

    The rumour came less than 24 hours to the emergency meeting summoned by the National Judicial Council to deliberate on Onnoghen’s suspension and Muhammad’s emergence as the Acting CJN.

     

  • BREAKING: World Bank President Jim Yong Kim announces resignation, names successor

    In a surprise move, World Bank President Jim Yong Kim on Monday announced that he will step down from his position on February 1 much before the end of his term in 2022.


    Kim, 58, has been in this position for over six years now.

    The president of the Washington-based World Bank has always been an American citizen nominated by the United States, which is the largest shareholder of this multilateral financial institution.

    “It has been a great honour to serve as President of this remarkable institution, full of passionate individuals dedicated to the mission of ending extreme poverty in our lifetime,” Kim said.

    Kristalina Georgieva, World Bank CEO, will assume the role of interim President effective February 1.
    “The work of the World Bank Group is more important now than ever as the aspirations of the poor rise all over the world, and problems like climate change, pandemics, famine and refugees continue to grow in both their scale and complexity, Kim was quoted as saying in a World Bank press release.

    “Serving as President and helping position the institution squarely in the middle of all these challenges has been a great privilege,” Kim said.

    During his term as World Bank President beginning July 2012, Kim emphasised that one of the greatest needs in the developing world is infrastructure finance and he pushed the Bank Group to maximize finance for development by working with a new cadre of private sector partners committed to building sustainable, climate-smart infrastructure in developing nations, the release said.

    To that end, Kim announced that, immediately after his departure, he will join a firm and focus on increasing infrastructure investments in developing countries, it said, adding that the details of this new position will be announced shortly.

    Under his leadership, the World Bank established two goals: to end extreme poverty by 2030; and to boost shared prosperity, focusing on the bottom 40 percent of the population in developing countries. These goals now guide and inform the institution in its daily work around the globe, it said.

    In addition, shareholders strongly supported measures to ensure that the Bank Group be even better positioned to respond to the development needs of clients: The Bank Group’s Fund for the Poorest, IDA, achieved two successive, record replenishments, which enabled the institution to increase its work in areas suffering from fragility, conflict, and violence.

    In April 2018, the Bank Group’s Governors overwhelmingly approved a historic USD 13 billion capital increase for IBRD and IFC that will allow the Bank Group to support countries in reaching their development goals while responding to crises such as climate change, pandemics, fragility, and underinvestment in human capital around the world.

    “Over the past 6+ years, the institutions of the World Bank Group have provided financing at levels never seen outside of a financial crisis, the bank said.

    Recognising the power of capital markets to transform development finance, the Bank Group during Kim’s tenure also launched several new innovative financial instruments, including facilities to address infrastructure needs, prevent pandemics, and help the millions of people forcibly displaced from their homes by climate shocks, conflict, and violence.

    The Bank is also working with the United Nations and leading technology companies to implement the Famine Action Mechanism, to detect warning signs earlier and prevent famines before they begin.

    Alleged N1.4b fraud: NBA president speaks on alleged ‘resignation’ plans

    The President of the Nigerian Bar Association (NBA), Paul Usoro has said he would not resign his position despite the pending fraud case against him.

    The EFCC, last week, filed an alleged N1.4 billion fraud charge against Usoro before the Federal High Court in Lagos.

    It was announced that Usoro will be arraigned today.

    But, addressing reporters in Abuja at the weekend, the NBA president said he would remain in office despite attempt to force him to quit.

    Usoro, who said he was presenting the communique of the just held NBA National Executive Committee (NBA) meeting, assured that he would attend court today, when the case against him is fixed for hearing.

    Saying he has not been served with the charge, the NBA President added that he was not comfortable about the leakage of the charge against him to the media.

    Usoro, who addressed the news conference alone, did not dispute the existence of the charge against him. He said he is innocent and that the case is intended to force him out of office.

    The NBA president, in a reaction to the question whether he will resign in view of the charge against him, said: “I will not resign. No, I am not in doubt that a charge has been filed against me. I only said, in my earlier statement, that I have not been served with the charge. I do not doubt the existence of the charge.

    This matter was presented before the National Executive Committee (NEC) of the NBA and we had a very successful meeting. And nobody raised the issue as regard whether I should leave.

    I have already made it quite clear, if you have read my statement on what my position is as far as this matter is concerned. The National Executive Committee adopted that my address, as far as that matter is concerned, and they believed that that matter is rested.

    You see, I have seen it happened a number of times, and I believe all of you have also seen it happened, that some of these incidents are hyped up simply to drive people out of office. You are aware of that. And this has happened, not once, not twice.

    We have seen it happened in the case of the Senate President (Bukola Saraki). Ultimately, what happened? The Senate President was absolved of any criminality. What would have happened assuming the Senate President had resigned?

    We have also seen it happened and somebody was hounded that way, and he resigned. And at the end, he was found not to have done it. It is also very possible that in this particular instance, that was what the people wanted and that was why that was that hype. All of you are aware of it that there were plenty of leakages in regard to this matter, just before the NEC meeting.

    I am personally convinced that the reason why there was so much of the leakage was to instigate NEC possibly to get me out of office. Well, that did not succeed. So, we went to NEC and I presented the things that we want to do as the national officers are concerned.

    NEC is quite happy with it.

    The lawyers are very happy with it. And we are focused on delivering those things that we want to do as far as the NBA is concerned. We will continue to do those things that would elevate the welfare and the essence of our lawyers, as well as promoting and preserving the rule of law. And that is what we will continue to do,” Usoro said.

    The Lagos State chapter of the All Progressives Congress says it had always known that Governor Akinwunmi Ambode’s commissioner, Olawale Olowo, who defected to the Peoples Democratic Party on Wednesday, was a mole for the opposition party.

    The Publicity Secretary of Lagos APC, Mr. Joe Igbokwe, said Oluwo, who has since resigned from his position as the Commissioner for Energy and Mineral Resources, was a traitor.

    The APC said Oluwo who is an ally of former lawmaker, Senator Tokunbo Afikuyomi, had gone with Afikuyomi when the latter dumped the party to pursue his failed governorship bid in 2007.

    The party said when Afikuyomi returned to the party, he and Oluwo were reabsorbed into the APC and were given appointments under the then Governor, Babatunde Fashola (SAN).

    It said rather than remain loyal to the party for its magnanimity, Oluwo decided to return to his old ways.

    The statement read in part, “It has been necessary to put this in true context so as to dismiss the false and capricious insinuation that his resignation was in principled objection to the party’s last primaries. Far from it! He was only playing true to type, seeking as he had done in 2007 to reap from the primaries.

    He has further showed that he has been a mole of the PDP and has been working to undermine the APC. His exit is a signal to other like minds who may wish to follow his trail.”

    The party described Oluwo as an opportunist who only used the APC to achieve his selfish motives.

    According to the APC, the former commissioner attempted to install his wife as a local government chairman by all means but was stopped by the party leadership.

    The statement added, “Oluwo had hardly resumed as the commissioner when he began his plot to use that office to advance his quest for political fiefdom. The object of his ambition was the positioning of his wife as the chairman of a local government.

    However, alert party men and women raised the alarm about his anti-party antecedents wondering why someone who recently joined the party would want to use his position as commissioner to impose his wife on the constituency.”

    The National Secretariat of the ruling All Progressive Congress (APC) said it is yet to officially receive the resignation letter of Senator representing Kaduna Central Senatorial District, Shehu Sani.
    The party insisted that it learnt about Sani’s alleged defection from the media.

    The party, through its National Publicity Secretary, Mallam Lanre Issa-Onilu, promised to make a formal pronouncement about the issue when it received further clarification.

    The party leadership will relate with all the facts concerning the reported defection and react appropriately in due course,” he added.

    Recall that the embattled senator announced his resignation on Saturday.

    The senator, in a letter dated October 19 and addressed to the Chairman of the APC in Ward 6, Tundun Wada North, Kaduna, and copied the party’s National Chairman, Mr. Adams Oshiomhole, did not give reasons for his action.

    The letter reads, “I present to you highest compliments and wish by this communication to formally offer to you my resignation from the All Progressives Congress.

    I had joined the APC and remained with it against all odds with the belief that it will constitute a veritable platform for the realisation of those democratic ideals which I hold very dear.

    (I had hoped) that honour and integrity will be the ultimate ethos of the party and, most importantly, that internal party democracy will always be the norm.

    However, only posterity can affirm the extent to which the APC has committed to and reflected these values.

    As I exit the APC at this point in time, I wish to formally thank the party for availing me the platform upon which I am currently serving this country in the honoured capacity of Senator of the Federal Republic.

    I wish the party well in all its future endeavours and ask, Sir, that you please accept the assurances of my highest considerations.”

    A source, close to the senator confided in newsmen on Saturday that Sani would announce his next political move, latest on Tuesday.

    He said, “The senator wants to keep his political enemies guessing and in suspense for now. He will definitely make his next move public latest by Tuesday.”
