    Appeal Court nullifies sack of Ebonyi gov, Umahi, Deputy

    The Court of Appeal, on Friday, vacated the High Court judgment sacking Gov. David Umahi of Ebonyi and his Deputy, Dr  Eric Igwe, following their defection to the All Progressive Congress, APC.

    The appellate court, in a unanimous decision by a three-man panel led by Justice Haruna Tsanami, held that there was no constitutional provision for the removal of a serving governor or deputy governor that dumped the political party that sponsored them to power.

    The court held that the only option available to a political party aggrieved by the defection of a governor or deputy it sponsored to power, was for such party to explore the option of impeachment as provided in the Constitution.

    Consequently, the appellate court, voided the high court judgement that removed Umahi and his deputy from office.

    The appellate court further ordered the Peoples Democratic Party, PDP, to submit names of their replacement to the Independent National Electoral Commission, INEC.

    The News Agency of Nigeria (NAN) reports that Justice Inyang Ekwo of the Federal High Court in Abuja in his judgment on March 8, held that the total number of 393, 343 votes governor Umahi secured during the March 9, 2019 governorship contest in Ebonyi state, belonged to the Peoples Democratic Party, PDP, which sponsored his election.

    The trial court held that the said votes was not legally transferrable to the APC which governor and his deputy decamped to, stressing that the duo not only jettisoned the PDP, but also the votes that belonged to it.

    It held that the PDP was bound to retain the votes and mandate that was given to it by electorates in Ebonyi state.

    Ekwo held that having regard to section 221 of the 1999 Constitution, as amended, and the democratic system of governance operated in Nigeria, votes at the election and elections are won by political parties and not their candidates or the candidates sponsored at the election by the political parties.

    He further made a declaration, that “votes won or scored by a political party at an election is retained by the political party irrespective of the death or exit of the candidate it sponsored for the election, from the political party.

    “A declaration that candidate of a political party that won the majority votes at an election is not entitled to retain or continue to lay claims to the votes won by the political party after moving to another political party, rather, the candidate is bound to inherit, utilize or appropriate the votes won by the new political party he has adopted”.

    He directed PDP to submit to the INEC, the name of its candidates to replace the 3rd and 4th Defendants, the court, issued an order of perpetual injunction, restraining governor Umahi and his deputy from putting themselves out or parading themselves as Governor and Deputy Governor respectively of Ebonyi state.

    The trial court issued an order of perpetual injunction restraining APC from parading itself as the political party whose members occupy the offices of Governor and Deputy Governor respectively of Ebonyi state.

    However, dissatisfied with the judgement, both Umahi and his deputy took the matter to the appellate court.

    The appellants had argued that the trial court, in ordering them to vacate their offices based on the suit marked FHC/ABJ/CS/920/2021, which was brought against them by the PDP, attempted to overrule a subsisting decision of the Supreme Court in AG Federation v. Atiku Abubakar & 3 ORS (2007) LCN/3799 (SC).

    They contended that the apex court had in its decision, held that no constitutional provision prohibited a sitting President or Vice President, and invariably, the Governor or Deputy Governor, from defecting to another political party.

    Umahi and his deputy argued that there is no specific mention of Governor and Deputy Governor in the provisions of both sections 68 and 109 of the 1999 Constitution, as amended.

    They further argued that the trial court erred in law, when it restrained them from carrying on the duties in their offices as Governor and Deputy Governor of Ebonyi State, on the premise that they acted in breach of sections 177(c) and 221 of the Constitution.

    “Section 221 of the Constitution is not to the effect that votes cast during the Governorship election of March 9, 2019 belonged to the 1st Respondent (PDP), but rather to the Appellants.

    “Section 177 of the Constitution is all about qualification for a candidate to the Governorship election and has anything to do with punishment for defection”, they argued.

    They averred that the trial court erred in law, when it ordered the 1st Respondent (PDP) to submit to the 2nd Respondent (INEC), names of its candidates to replace the Appellants as Governor and Deputy Governor of Ebonyi .

    They argued that no law gave the court the power to declare anyone that did not participate in all stages of the election, as winner of the said election.

    Bobby Madley will referee an English Premier League (EPL) match for the first time in four years on Saturday after losing his job over a controversial video in 2018.

    Madley was sacked by the refereeing body Professional Game Match Officials Limited (PGMOL) after sending a video mocking a disabled person to a friend.

    He returned to English football in 2020, taking charge of matches at League One and League Two levels, and has officiated 10 games in the Championship this season.

    The 37-year-old is set to take charge of Brentford’s home game against Wolverhampton Wanderers, according to a list of officials for this weekend’s fixtures on the Premier League’s website.

    Madley’s brother Andy, who is also a referee, will take charge of Brighton & Hove Albion’s home game against Chelsea on the same day.

    BREAKING: Buhari fires NDDC sole administrator, Effiong Akwa

    President Muhamadu Buhari has sacked the Sole Administrator of the Niger Delta Development Commission (NDDC), Effiong Akwa.

    No reason was given for the removal of the NDDC boss, who was appointed in October.

    A statement issued on Thursday by the spokesperson of the Ministry of Niger Delta Affairs, Patricia Deworitshe, said Mr. Akwa’s sack, which has been approved by Mr. Buhari, takes effect from 20 October.

    The ministry supervises the activities of the NDDC.

    The statement said Mr. Akwa was appointed interim administrator for the duration of the forensic audit into the operations of the commission and that the audit has been concluded, apparently justifying his removal.

    “President Buhari has also approved the constitution of a new Management Team and Governing Board of the NDDC in line with Section 5(2) of the NDDC Act, 2000.

    “The names of the nominees for the new management team and Governing Board are to be transmitted to the National Assembly for approval,” the statement said.

    However, The Sun states that the cash-strapped club may find it too expensive to part with the Northern Irish manager.

    The source adds that Rodgers earns a salary of £10million-a-year, which makes him one of the highest-paid coaches in the Premier League.

    His contract still has three years to run, which means Leicester may have to pay the entire salary if they sack him.

    While a gardening leave option is possible, that would still involve paying Rodgers his salary, along with paying another head coach, until the former finds a new job.

    Chelsea midfielder Jorginho has refused to offer what the players think of Thomas Tuchel’s sacking.

    The German was sacked and replaced by Graham Potter last week.

    Speaking in his pre-match press conference ahead of Chelsea’s Champions League showdown with Austrian outfit Red Bull Salzburg, the Italian said: “It was a surprise of course for everyone. But what has been said between players, will stay there. I’m sorry.

    “Of course there is talking around what happened, but now we have games coming and life is quick so we don’t have time to keep thinking again and again. We talked, but now we need to concentrate and focus on what we need to do.”

    Tuchel questioned the mental strength of Chelsea’s players after the defeat at Dinamo Zagreb. Jorginho also said: “That was his feeling in that moment and he said that to us as well. We tried what we could to try and do our best.

    “But unfortunately it wasn’t working anymore and the new challenge is to rebuild that confidence because Chelsea are a big club and we have a lot of work to do. To do that we all need to be working in the same direction.”

    Delta: Reject posting and get sacked, govt warns newly recruited teachers

    The Delta Government has warned the newly employed teachers for the state’s technical colleges not to reject their postings in order not to forfeit the offer.

    The Commissioner for Technical Education, Mrs Shola Daibo, said this on Tuesday while handing out the employment letters to the recently recruited teachers for the three new technical colleges in Effurun, Asaba and Obiaruku.

    She urged the teachers to be committed and be dedicated to their jobs, and avoid engaging in side hustling during official hours.

    She said, “Over 28,000 persons applied for the job, out of which about 8,000 shortlisted for written and oral interviews and practicals.

    “It was strictly on merit, we did not conduct the exam, and the governor said he wanted to get the best, therefore, we had two consultants to conduct the employment process.

    “That was why the employment was delayed till now. It was really tedious because it took us almost a year to get here. They did exam, aptitude test, we did oral and practicals.”

    Daibo added that the new employees would be trained by experts, particularly, from the state-owned polytechnic in Ogwashi-Uku.

    “Graduates from the technical colleges will be self-reliant, thereby reducing unemployment and poverty,” he said.

    Paris Saint-Germain chiefs are ready to sack coach Mauricio Pochettino.

    The Ligue 1 champs are finalising the sacking of Pochettino in the coming days and announce the departure of director of Leonardo, as they begin to make changes.

    The former Tottenham boss is under contract with the French outfit until the end of next season, but speculation surrounding his future has been mounting for months, after the French giants disappointing exit from the Champions League.

    Despite winning the Ligue 1 league title, It has been reported that just one more meeting is needed for PSG to make an official decision on the Argentine’s future at the club.

    Transfer expert Fabrizio Romano reported: “Paris Saint-Germain are oriented to sacking Mauricio Pochettino in the coming days. One more meeting is needed to make an official decision – it will take place once Nasser Al Khelaifi’s back.

    Twitter reports 1st-Qtr earnings as two top managers quit

    Following Elon Musk’s $44 billion purchase of Twitter, two of its top managers have been fired, as the company reports first-quarter earnings.

    One Twitter General Manager, Kayvon Beykpour, is leaving after 7 years.

    In a series of tweets on Thursday, Beykpour said CEO Parag Agrawal “asked me to leave after letting me know that he wants to take the team in a different direction.”

    Bruce Falck, Twitter’s revenue and product lead, was also fired, according to a tweet that has since been deleted. His Twitter bio now says “unemployed.”

    “I dedicate this Tweet to those engineers and thank you ALL for the opportunity to serve alongside you. It’s been awesome. There is a lot more to do so get back to work, I can’t wait to see what you build,” Falck tweeted.

    Twitter confirmed both departures and said the company is pausing most hiring and except for business critical roles. In addition, it said in a statement, “we are pulling back on non-labor costs to ensure we are being responsible and efficient.”

    Beykpour was the general manager of consumer Twitter, leading design, research, product, engineering and customer service and operations teams, according to his Twitter bio.

    A co-founder of the live streaming app Periscope, Beykpour joined Twitter when the social media company bought his startup in 2015.

    “I hope and expect that Twitter’s best days are still ahead of it. Twitter is one of the most important, unique and impactful products in the world. With the right nurturing and stewardship, that impact will only grow,” he said on Twitter.

    Beykpour did not immediately respond to a message for comment.

    In a memo sent to employees and confirmed by Twitter, Agrawal said Twitter has not hit growthTwitter has not hit growth and revenue milestones after the company began to invest “aggressively” to expand its user base and revenue.

    Federal High Court sacks PDP Chairman

    Chairman of the Peoples Democratic Party (PDP) in Ebonyi, Mr Tochukwu Okorie, was not validly nominated to contest election into the position, the Federal High Court, Abuja, ruled on Wednesday.

    Delivering ruling in the suit filed by Mr Silas Onu, challenging the election of Okorie, Justice Ahmed Mohammed held that Okorie was indolent in submitting his nomination form and could not benefit from his wrongdoing.

    He declared that Okorie submitted his nomination form on Oct. 4, 2021; days after the Oct. 1, 2021 deadline stipulated in the guidelines on the conduct of congresses.

    Justice Mohammed stressed that Okorie could, therefore, not have been validly nominated and was not qualified to contest in the election held on Oct. 16, 2021.

    “It is the opinion of this court that the 2nd defendant (Okorie), was indolent in submitting his nomination form as provided in the guidelines issued by the PDP.

    “In spite of this failure, he was still returned and declared elected. He cannot be allowed to benefit from his wrong doing,’’ the judge declared,

    He consequently directed the PDP to hold that only Onu was lawfully nominated to participate in the election of Oct. 16, 2021.

    He also directed the party and to issue a Certificate of Return to Onu declaring him as the duly elected Chairman of PDP, Ebonyi chapter.

    The judge granted the prayer for a declaration that Okorie was not qualified to participate in the election for failing and refusing to submit his nomination form on or before the deadline of Oct. 1, 2021.

    He also granted the prayer for a declaration that the Okorie’s participation in the said election was contrary to the clear and unambiguous schedule for the conduct of state congresses, therefore rendering such participation null and void.

    The judge had earlier dismissed the preliminary objection filed by the PDP where it alleged that Onu did not exhaust internal mechanisms available for resolving party matters before heading to court.

    He ruled that PDP’s objection failed because the party was silent about the date Okorie submitted his nomination form.

    He declared that he found PDP’s failure to deny the allegation by Onu that Okorie submitted his nomination form on Oct. 4 instead of Oct. 1, 2021 as admission of wrongdoing.

    “The consequence is that Okorie’s nomination form submitted on Oct. 4, 2021 instead of Oct. 1, 2021 was submitted out of time,’’ Justice Mohammed insisted.

    Ebonyi chapter of the PDP elected Okorie as chairman on Oct. 16, 2021.

    Okorie polled 1,240 votes to defeat Onu, the former Publicity Secretary, who scored 260 votes.

    Dissatisfied with the outcome, Onu filed a suit challenging the process and listed the PDP Ebonyi chapter and Okorie as first and second defendants, respectively.

    Onu prayed the court to rule whether or not Okorie qualified to contest in the Oct. 16, 2021 election even after he did not submit his nomination form within the stipulated deadline of Oct. 1, 2021.
