Tribunal: Rhodes-Vivour closes case against Sanwo-Olu, Hamzat

The Lagos State Labour Party governorship candidate, Gbadebo Rhodes-Vivour, on Tuesday, closed his case against the victory of Gov. Babajide Sanwo-Olu in the March 18 election before the election tribunal sitting in Ikeja.

The Labour Party governorship candidate is also challenging the eligibility of Hazmat to contest on the grounds that he allegedly renounced his Nigerian citizenship and swore allegiance to the United States of America.

At the resumed hearing on Tuesday, the petitioner’s counsel, Mr Idowu Benson, informed the three-justice tribunal headed by Arum Ashom that the petitioner was closing his case.

Ten witnesses had testified in the petition of the LP candidate.

The counsel also tendered a Certified True Copy (CTC) of the INEC Form EC9 – an affidavit containing the particulars of a candidate – which was hand-filled by Hamzat and had been front-loaded by the counsel for the fourth respondent, All Progressives Congress (APC), before the tribunal.

All the counsel for the four respondents objected to the admissibility of the document tendered by the petitioner.

The tribunal, however, admitted the document into evidence and marked it as Exhibit PE713.

The APC counsel, Mr Noris Quakers (SAN), said the CTC tendered by the petitioner was warehoused by the first respondent and did not form a part of the court records.

“It is not a document before this tribunal.

“It is only a document signed by the Independent National Electoral Commission that can be tendered.

“We will further argue on why this document should not be admitted in the final written address,” he said.

The INEC counsel, Mr Eric Obigor, informed the tribunal that he would pick a date to open their defence while commending the petitioner for closing his case.

The tribunal ordered that the first respondent should open his case on the next adjourned date but he prayed the court for more time to put his house in order.

“We will be taking a date to open our case and commend the petitioner for closing its case even though it was unexpected.

“At the moment, for me to secure the attendance of my witness, I can not get them by tomorrow.

“I will need to do consultations with the stakeholders of my client.

“A day will enable me to put my house in order,” Obigor said.

Counsel to Sanwo-Olu and Hamzat, Mr Bode Olanipekun (SAN), also commended the petitioner for closing its case while stating that they should have taken the wise retreat earlier.

The proceedings was stalled on Monday due to health reasons of LP witness.

The tribunal had on Monday adjourned the proceedings due to the ill health of a witness scheduled to testify in favour of Rhodes-Vivour.

Benson had mentioned that the witness was in court but had to leave for treatment before proceedings commenced.

The tribunal adjourned until July 5 for INEC to open its defence.

  • APC chieftain hails Sanwo-Olu, Ambode reconciliation

APC chieftain hails Sanwo-Olu, Ambode reconciliation

Mr. Bola Babarinde, a former chairman of the All Progressives Congress (APC), South Africa Chapter, has commended the reconciliatory effort of Gov. Babajide Sanwo-Olu of Lagos State and his immediate past predecessor, Akinwunmi Ambode.

Babarinde in a statement on Monday, commended Sanwo-Olu for attending Ambode’s 60th birthday party and praising him for his dedication to serving Lagos state as governor and civil servant.

He said the gesture was a significant step toward rebuilding bridges and fostering unity among political leaders, and peace loving Nigerians.

The relationship between Sanwo-Olu and Ambode collapsed in 2019 over his denial of second term by the All Progressives Congress (APC).

According to him, with such attitude, Sanwo-Olu has learnt the importance of forgiveness, togetherness and love from his mentor, President Bola Tinubu.

Babarinde, who noted that the road to the Presidency by Tinubu was rough and tough with many lessons learnt, said Tinubu was never deterred but was determined to achieve his life time ambition.

“He was betrayed, abused, denigrated, unjustly accused and demonised by friends and foes, but he was never deterred and trudged, but rather he was determined to achieve his long time ambition.

“Tinubu have many disciples which failed to measure up to 10 per cent of his political sagacity, humanitarian posture, forgiveness and of course ability to predict the future.

“One of his many mentees is Gov. Babajide Sanwo-Olu, who organised a reception for hosting of the Capo di tutti back to his home state.

“Where friends, acquaintances attended and also served as the reunion for the four governors that served Lagos from 1999 till date.

“Sanwo-Olu started the reconciliation move with Ambode, his predecessor when he eulogised him during his 60th birthday with big publicity for such magnanimity and humility,” he said.

Misunderstanding: Sanwo-Olu, Uzodimma set up c’ttee to reconcile yoruba, Igbo in Lagos

In order to seek lasting solutions to the recent raging misunderstanding between the Igbos and Yoruba in Lagos, governor Hope Uzodimma of Imo State and his Lagos State counterpart, Babajide Sanwo-Olu have set up a committee to broker peace in the Economic center of Nigeria.

In a communique issued at the end of a meeting between Lagos State Government and South East Governments, it was agreed that a peace and reconciliation committee will be empanelled to settle and douse the increasing tension between the two groups

While Sanwo-Olu endorsed for Lagos State Government, Uzodimma signed for the South East.

The communique further requested the suspension of demolition at Alaba International market with a review committee to ensure that no building that is not in contravention is demolished.

It was also agreed that compensation will be paid for any wrong demolition in Alaba International market, while taxes, rates and demand notice levied on Igbo real estate developers will be reviewed to ensure they are not outrageously prohibitive, punitive and seemingly targeted at them.

The communique recommended the establishment of “proper channels of communication and more robust engagement with organised Igbo leadership in Lagos as was the case during the tenures of Governors Tinubu, Fashola and Ambode, which engendered massive Igbo support for them.”

The communique acknowledged that Igbos have nothing against President Bola Ahmed Tinubu and Governor Sanwo-Olu and would continue to support them.

  • Jandor’s counsel accuses WAEC official of compromising evidence against Sanwo-Olu

Jandor’s counsel accuses WAEC official of compromising evidence against Sanwo-Olu

Mr. Clement Onwuenwunor (SAN), the lead counsel for the Peoples Democratic Party (PDP) governorship candidate in Lagos State, Mr Abdulazeez Adediran,  has accused the West African Examination Council (WAEC) official of compromising evidence in his testimony.

The official was subpoenaed by the court to give evidence on the controversy surrounding the qualification of Governor Babajide Sanwo-Olu.

Onwuenwunor accused Mr Olaolu Adekanmbi, the WAEC official, who was subpoenaed by the tribunal at his instance, of not being truthful in his evidence.

The petitioner’s counsel told the tribunal that the evidence of the witness was adverse to its earlier findings after a search on WAEC’s online result verification portal which had allegedly indicated the absence of the governor’s names and result on it.

Jandor’s counsel also applied to the tribunal for leave to cross examine the witness in order to challenge the accuracy of the WAEC official’s evidence.

“There is a major conflict between what the witness has just brought and what we earlier tendered which was also issued by WAEC.

“Our search before the polls had discovered that the governor had no result on WAEC’s portal and now this witness is bringing something different which contradicts their earlier position.

“He is not being a witness of truth.

“He has also refused to give more evidence on what he presented, and said the council does not produce hard copy of certificates or retain duplicate certificates,” he said.

Earlier, the witness had presented a document bearing a May/June O’level result with the name of the governor issued in 1981 by Ijebu Ife Community Grammar School.

Three member tribunal headed by Justice Arum Ashom admitted the document among the list of exhibits before it, into evidence.

The Independent National Electoral Commission (INEC) counsel, Mr Adetunji Oyeyipo (SAN), described the petitioner’s grouse as a storm in a teacup.

He said: “This witness has made two contradictory statements.

“There is nothing to warrant treating him as a hostile witness.

“At the very best, he has only given evidence not palatable to my learned friend.

“We urge you to refuse the application of the petitioner,”

Dr Muiz- Banire (SAN) representing Sanwo-Olu and his deputy, Obafemi Hamzat, who were the second and third respondents in the petition, also aligned himself with INEC’s position.

“Exhibit P36 is a product of one Ijebu Ife community Grammar School, not WAEC while exhibit b2 is a product of one Grandex Ventures Ltd., not WAEC.

“No one has led evidence to establish the authenticity of that portal so the attachment to it is totally unreliable.

“No witness has even testified on the said Grandex, section 230 of the Evidence Act does not avail the petitioner the right to seek leave of court to declare the witness hostile,” Banire said.

However, Labour party and its candidate, Gbadebo Rhodes-Vivour, urged the Tribunal to grant the petitioner’s request.

They argued that the witness was being hostile to the truth and exhibited animosity.

The Tribunal, in its ruling,  held that the petitioner could not cross-examine the witness and that the exhibit containing the findings from the portal could not be linked to WAEC directly.

The tribunal, thereafter, ordered other counsel to cross examine the WAEC official.

The witness told the tribunal during cross examination that the governor was found to have been entitled to a certificate issued by the school in question and that the online portal did  not exist as at 1981.

He said: “Since there was no portal in 1981, this master list of 581 candidates that sat for the exam at the school is the primary information that will be fed into the result verification portal.

“I think electronic registration of candidates started in 2004.

“For migrating results, we have three portals and the council does not retain duplicate copies of certificates.”

The tribunal adjourned until July 4 for continuation of hearing.

The governor described the sudden hike in petrol price and attendant queues as ‘unfair’, adding that Nigerians need to be sincere enough.

”I think it is so early in the day for people to begin to second-guess our new president.

“This is a pronouncement, and I think it is unfair on all of our major marketers to want to begin to seize opportunity in areas where there is none.

”We all need to be sincere in this country, if we really want to get things done, let us know that we might need to belt up a little bit, but it’s really so that we have a better life down the line.

”There is nothing that has changed in that pronouncement that should have caused the queue. I am sure that the Federal Government that we have would be able to rise up and be able to deal with it.

”I will encourage everyone to be law abiding, to go about their normal business, and things will certainly turn out for the better for us.”
