Appeal Court affirms Olaoye as Soun of Ogbomoso

The Court of Appeal sitting in Ibadan on Tuesday affirmed the selection and installation of Oba Ghandi Olaoye as the Soun of Ogbomoso.

Recall that Justice K. A. Adedokun of the Oyo State High Court sitting in Ogbomoso had, on Oct. 25, 2023, nullified the selection and installation of Olaoye as the Soun of Ogbomoso.

The lower court asserted that the procedure of Olaoye’s nomination was “irregular, null and void”.

It added that the process did not comply with the provisions of the Soun Chieftaincy Declaration of 1958.

Delivering judgment on the appeal filed by Olaoye, Justice Yargata Nimpar, who led a three-member panel of justices, resolved the appeal in favour of Olaoye.

Nimpar said that the lower court had no jurisdiction to entertain the case.

According to the judge, the respondents failed to comply with the administrative procedure of writing the government about their dissatisfaction with the selection before approaching the court.

Nimpar, therefore, set aside the lower court’s judgment and affirmed the selection and installation of Olaoye as the Soun of Ogbomoso.

Speaking with newsmen after the judgment, the respondents’ lead counsel, Mr Abiodun Ogunjumi, said his client was dissatisfied with the judgment of the Court of Appeal.

Ogunjumi said he was ready to file notice and grounds of the appeal to attack the judgment of the Court of Appeal at the Supreme Court.

NAN reports that the respondents are Prince Muhammed Olaore and six others.

Mr Kolawole Fatoye stood in for Olaoye’s counsel, Mr Yusuf Ali, a Senior Advocate of Nigeria (SAN).

RCCG Pastor officially receives staff of office as Soun of Ogbomoso

The installation process of the 21st Soun of Ogbomoso, on Tuesday, climaxed with the presentation of staff of office/instrument of office to Oba Ghandi Olaoye by Gov. Seyi Makinde of Oyo State.

TheNewsGuru.com (TNG) reports Oba Olaoye is a former Pastor with the Redeemed Christian Church of God (RCCG).

The presentation of the Soun of Ogbomoso staff of office comes after a protracted legal tussle.

Makinde, in his remarks, urged the 62-year-old traditional ruler to take steps that would ensure unity in Ogbomoso land.

He also enjoined the new Soun of Ogbomoso to embark on activities that would fast-track development in the ancient town.

The governor, who noted that there wasn’t a central traditional council in the state, said that the new royal father should work toward ensuring that there was unity among traditional rulers in the state.

He particularly called on Oba Olaoye to work assiduously to ensure that the State Council of Traditional Rulers became functional again.

Makinde said that his administration would soon reconstruct the House of Chiefs within the secretariat complex to allow the traditional rulers to hold their meetings in a conducive atmosphere.

He called other contestants to the Soun throne to put the experience behind them and support the new traditional ruler.

“I’m looking forward to seeing those who went to court to challenge the new oba withdrawing their cases as a show of love for Ogbomosoland,” he said.

In his address, Oba Olaoye appealed to all the stakeholders in the Ogbomoso land project to join hands with him to ensure that the ancient town attained its great potential.

“It is a well known fact that the sons and daughters of Ogbomoso land are among the most industrious entrepreneurs in this country.

“No community can embark on any significant development that we want for Ogbomoso land without government’s inputs.

“We are thankful for the roles that the governments at all levels – federal, state and local governments – are playing in the development of Ogbomoso land,” he said.

He particularly appreciated the Makinde-led administration for the attention given to Ogbomoso since its inception.

The historic installation ceremony, which kick-started Oba Olaoye’s reign, was held at Ogbomoso Stadium.

A galaxy of dignitaries from all walks of life, including former Vice-President Yemi Osibajo, Gov. Ademola Adeleke of Osun and Kwara Deputy Governor, Mr Kayode Alabi, witnessed the event.

Secretary to the Government of the Federation (SGF), Sen. George Akume, was represented at the occasion by Mr Olusekun Adekunle, while the Ooni of Ife, Oba Enitan Ogunwusi, Olu of Warri, Ogiame Atuwatse and Oluwo of Iwo, Oba Adewale Akanbi were also present.

Recall that the Soun stool became vacant after the passing away of Oba Jimoh Ajagungbade in December 2021 at the age of 95, after reigning for 48 years.

Olaoye family drops details on Soun of Ogbomoso tussle

The Head of Olaoye family in Ogbomoso, Chief Amos Olaoye, has said that Prince Afolabi Olaoye’s name was not smuggled into the list of those aspiring for the seat of Soun of Ogbomoso.

Olaoye, while speaking with newsmen in Ogbomoso on Monday, said that those spreading such rumours were only being economical with the truth.

“The fact remains that Prince Afolabi is a bona fide member of the family and he is, therefore, qualified like other members of the family to vie for the vacant stool of Soun.

“Contrary to rumours making the rounds, Prince Afolabi Olaoye’s name was not smuggled into the list of the aspirants contesting for the Soun of Ogbomoso stool.

“Those behind the rumours are naysayers and they are being economical with the truth,” he said.

He said that Prince Olaoye obtained the nomination form like any other aspirant and that the money was paid into the family account.

“Though he came late, he was not the only person who obtained late form.

“He was screened by the committee set up by the family and when they could not come up with a concrete resolution on the selection process, we submitted all the names to the kingmakers who screened them again.

“In fact, some of those who did not obtain form but signified interest were screened by the kingmakers.

“The selection of Prince Olaoye as Soun of Ogbomoso is not shrouded in secrecy or imposed by government, as being projected, all because they don’t want him to be king due to reasons best known to them.

“Olaoye’s selection followed due process, while he never bribed anybody or use his influence to emerge.

“Those spreading the rumours are being influenced by external factors. It is understandable that they want to be king but they have forgotten that it is only God that enthrones.

“What is happening now is normal and expected because not everybody will be on the same page on issues like this. But, I want to appeal to those who are aggrieved to please come and let us work together as brothers.

“They shouldn’t allow external factors to set us against one other,” he said.

On the court judgment that removed Olaoye as Soun of Ogbomoso, the family head said that stakeholders were already working on it and that necessary steps were being taken to ensure amicable resolution.

He assured that everything would be settled and that the family would come out of it more united.

Why court nullified former RCCG pastor as Soun

A High Court sitting in Ogbomoso in Oyo State on Wednesday nullified the selection and installation of Oba Afolabi Ghandi Olaoye as the new Soun of Ogbomoso.

The presiding judge, Justice K.A. Adedokun, nullified his selection and installation while ruling on an ex-parte motion filed by Prince Kabir Olaoye, one of the contenders to the stool.

Olaoye, a former pastor with the Redeemed Christian Church of God (RCCG) and international businessman, was selected few weeks ago by the kingmakers as the new Soun of Ogbomoso.

His selection was then approved by the Oyo State governor, Seyi Makinde, on Sept. 2, and he was installed by the kingmakers on Sept. 8.

The stool had become vacant after the demise of Oba Jimoh Oyewumi, Ajagungbade III, in December 2021 at the age of 95 after he reigned for 48 years.

However, Prince Kabir Olaoye had dragged the matter to court, saying Afolabi Olaoye was not eligible for the position of Soun of Ogbomoso.

Justice Adedokun, in his ruling, went on to restrain Gov. Makinde, the Attorney-General and the Commissioner for Local Governments and Chieftaincy Matters in Oyo State.

He said: “Either by themselves, agents or officials, they are restrained from presenting any instrument of office in any form of ceremony or issuance of certificate of installation to Afolabi pending the hearing and final determination of the mandatory injunction already filed before the court.”

Kabir Olaoye had contended that the selection of Afolabi Olaoye did not follow due process and the Ogbomoso Chieftaincy Declaration.

He then prayed the court to nullify the selection and installation, as well as order the kingmakers to commence a fresh selection process.

The judge then nullified the selection and installation of Afolabi as Soun of Ogbomoso and granted Kabir Olaoye’s prayers for a fresh selection process.

“I want to enjoin you all and our people, in general, to live in peace and celebrate the coming in of the new Soun moderately, and extend hands of fellowship to the aggrieved in the process of selecting a new Soun.

“Today is for thanksgiving and prayers, and I thank God we are able to witness today,” he said.

Also, a student of Ladoke Akintola University (LAUTECH), Ogbomoso, Miss Omolara Fatilewa, called on everyone to maintain peace and live together as one family.

“Everyone must avoid anything that can threaten peace in the town and we must not emphasise religious differences, but rather promote religious tolerance.

  • Lunacy, religion and terrorism in a challenged nation – By Owei Lakemfa

Lunacy, religion and terrorism in a challenged nation – By Owei Lakemfa

AS the new Soun of Ogbomosho, Prince Afolabi Ghandhi Olaoye, emerged on Saturday, September 2, a major issue in the selection process caught my attention. The kingmakers extracted a pledge from the 23 claimants to the stool that whoever is crowned would embrace the three main religions in the ancient kingdom: the Traditional, Christianity and Islam. This pledge, a reflection of the time-tested tradition of the Yorubas who tolerate all religions, reminds me of my growing up in Lagos.

Lagos accommodated all religions and it was not uncommon to find adherents of the three main religions in a single  family. The Yoruba saying that whoever is alive during a festival should rejoice and participate in the festivities (Eniti odun ba ba laye, ko yo) was observed in spirit and practice. They also add that only God  knows who worships Him in truth. So the people, irrespective of their personal religious beliefs, participated in all festivals especially Sallah, Easter, Christmas, and the various traditional festivals, including Egungun, Eyo and Igunnu. If anybody  tried to be sanctimonious, they respond by saying such a person is mixing lunacy with religion (O gba were mesin).

That was the Lagos I grew up in, and that shaped my attitude to religion. So, I was not prepared for the event in Ilorin when 15 clerics led by one Sala Ayodeji invaded the shop of a couple, the Tajudeens, selling television sets and accused the lady of being an adherent of traditional religion. They threatened to destroy the shop and the television sets unless the lady vacated the city within  seven days. The invaders ruled that the lady as a believer in traditional religion can only be allowed to trade and live outside the city. Ayodeji also instructed the shop’s landlord, the Alaran Family, to refund the couple’s rent and evict them within seven days otherwise their property will be invaded.

Ayodeji who appeared possessed or under the influence of substances, claimed the Kwara State Commissioner of Police, Ebunoluwa Rotimi Adelesi, was aware of the group’s visit to the couple, reiterated: “The Commissioner of Police is aware of our visit…so leave our town.” The video went viral and an incensed the police commissioner in whose name the suspects invaded the shop. He declared Ayodeji wanted for terrorism. The prime suspect went on the run. On Monday, August 28, 2023,  the police commissioner visited the couple and the family of Ayodeji where she gave his family three days within which to produce him. She described  his behaviour as criminal and cable of causing a breakdown of law and order. The police boss also lashed out at the Alaran family for evicting the couple from the shop and refunding their rent.

The next day, the police smoked Ayodeji out of his hideout in Ilorin. The suspect confessed that he lied about the police commissioner endorsing his invasion of the shop. He also claimed not to have known that his actions were criminal. Well, what he may also not know is that ignorance of the law is no excuse. If the accusation of terrorism by the commissioner of police were to be sustained, Ayodeji and his fellow invaders might be eyeing life imprisonment. Terrorism under Section 1 of the Terrorism Act 2000 is defined as “the use or threat of actions where the action involves violence against the person, damage to property, endangers a person’s life, creates risk to public health or safety or interferes with an electronic system.”

The law further states that: “Any person who engages in any conduct in preparation to commit acts of terrorism or assisting another person to commit an act of terrorism commits an offence and is liable on conviction to life imprisonment.” Ayodeji might simply have been trying to project himself as a defender of faith as a way of promoting the Islamic schools he runs in Ilorin and Ogbomosho. This raises the question whether such a man is a fit and proper person to run a school. He might also be an example of a person the Yoruba say, mixes religion and lunacy in which case, the police would need to send him for psychiatric evaluation.

Another person I am worried about is my old friend, Professor Ishaq Akintola, who runs the Muslim Rights Concern, MURIC. He is a person I had over the decades shared ideas with, especially on the emancipation of Nigeria. To find such a man begin to starve his thoughts and comments of any form of intellectualism is quite disturbing. Last Wednesday, there was a palace coup in Gabon. In his reaction to the coup, rather than a straight forward condemnation of any attempt to truncate our hard fought Civilian Rule in Nigeria, he wrote: “A military coup against the current Muslim-Muslim ticket will be interpreted as a direct attack on Muslims in the country in view of the deep religious sentiment which pervaded the controversy surrounding the Muslim-Muslim ticket.” What? Is it the religious belief of the President and Vice President that is the issue or that Nigerians should stoutly  resist any attempt to truncate the constitutional order in the country?

As a new monarch is crowned in Ogbomoso with a warning that he must be a father to all and be tolerant of all religions, one monarch that exhibits worse traits than the Ilorin fanatic, is Oba Abdulrasheed Adewale Akanbi, the Oluwo of Iwo, who has pronounced traditional religion a criminal enterprise whose adherents should be punished, if necessary by jungle justice. Akanbi, known popularly as ‘Oba tin yin banga’ (The king that throws fire crackers) is a ruler that neither respects tradition nor is commonly associated with good conduct. For instance, traditionally, the crown is regarded as sacred and only the king wears it. But when he got to the throne, he duplicated his crown and gave one to his then wife, Chanel Chin, a Jamaican, to wear in public. He also pronounced himself an Emir, not an Oba as is the tradition in Yorubaland.

On February 14, 2020,  the Assistant Inspector General of Police, Zone 11, Bashir Makama, called some traditional rulers in Osun State to a peace meeting following a dispute amongst them. During the meeting Oba Akanbi allegedly attacked the Agbowu of Ogbaagba, Oba Dhirulahi, physically, leading to the latter’s hospitalisation. Consequently, the Council of traditional kings, suspended Akanbi for misconduct. Last month, he illegally and unconstitutionally banned traditional worship, scrapped the annual Oro festival and ordered that whoever is found observing the festival should be seized and brought to him. He claimed traditional religion adherents worship gods and deities, not God. As in Ilorin, unless as a powerful elite, he is above the law, the police should charge Oba Akanbi with terrorism.
