Why killer Fulani herdsmen are terrorists – By Sonnie Ekwowusi

    By Sonnie Ekwowusi

Recently the Attorney-General of the Federation and Minister of Justice, Abubakar Malami (SAN) invoked the law and declared the bandits operating in Nigeria are terrorists. Because President Buhari has been running a totalitarian Fulani hegemonic regime that provides cover for killer Fulani herdsmen, he and Malami are turning a blind eye to the unspeakable acts of terrorism being committed in Nigeria by the killer Fulani herdsmen in violation of the Terrorism (Prevention) Act 2011, Terrorism (Prevention) (Amendment Act) 2013, Criminal Code Act Cap C38 Laws of the Federation of Nigeria 2004 and the international anti-terrorism instruments. Why shield criminals?. Sad. Last Sunday about five villagers were killed in a fight between the Fulani herders and local farmers in Idofa area of Imeko-Afon Local Council, Ondo State. The farmers accused the herders of destroying their farm lands through open grazing of their cows.

It is noteworthy that much of the international law of terrorism are in the form of multilateral treaties. These multilateral treaties include the International Convention Against the Taking of Hostages, the Convention for the Suppression of Unlawful Acts Against the Safety of Civil Aviation and the Convention on the Prevention and Punishment of Crimes Against Internationally Protected Persons, including Diplomatic Agents. Now, the aforesaid treaties other treaties on terrorism contain several important provisions in combating terrorism. These provisions which include articles that define particular acts of terrorism as criminal offenses for the purposes of the treaties oblige states parties to make the offenses punishable by appropriate penalties under their domestic laws. In Nigeria, the extant domestic laws under which terrorism is defined and punishable are the Terrorism (Prevention) Act 2011, Terrorism (Prevention) (Amendment Act) 2013), the Criminal Code Act Cap C38 Laws of the Federation of Nigeria 2004. Section 1 of the Terrorism (Prevention) Act 2011 states that— “A person who knowingly— (a) does, attempts or threatens to do an act preparatory to or in furtherance of an act of terrorism; (b) commits to do anything that is reasonably necessary to promote an act of terrorism; or (c) assists or facilitates the activities of persons engaged in an act of terrorism,, commits an offence under this Act.

Section 2 of the Act defines “act of terrorism” to mean as act which is deliberately done with malice, aforethought and which : (a) may seriously harm or damage a country or an international organization ; (b) is intended or can reasonably be regarded as having been intended to— i (unduly compel a government or international organization to perform or abstain from performing any act; (ii) seriously intimidate a population ; (iii) seriously destabilize, or destroy the fundamental political, constitutional, economic or social structures of a country or an international organization ; or, (iv) otherwise influence such government or international organization by intimidation or coercion; and (c) involves or causes, as the case may be—, (i) an attack upon a person’s life which may cause serious bodily harm or death: (ii) kidnapping of a person ; . (iii) destruction to a Government or public facility, a transport system, an infrastructure facility, including an information system, a fixed platform located on the continental shelf, a public place or private property, likely to endanger human life or result in major economic loss; (iv) the seizure of an aircraft, ship or other means of public or good transport and diversion or the use of such means of transportation for any of the purposes in paragraph (b ) (iv) of this subsection; (v) the manufacture, possession, acquisition, transport, supply of weapons, explosives or of nuclear, biological or chemical weapons as well as research into, and development of biological and chemical weapons without lawful authority; (vi) the release of dangerous substance or causing of fire, explosions or floods, the effect of which is to endanger human life ; (vii) interference with or disruption of the supply of water, power or any other fundamental natural resource, the effect of which is to endanger human life

Under the watch of the Buhari government the killer Fulani herdsmen have been committing unspeakable acts of terrorism in Nigeria and getting away with them. Apart from killing, maiming, kidnapping and raping their victims to death, the killer herders, in conspiracy with their cohorts from Niger Republic, have been aiding and abetting mutinous acts, threatening to levy war against Nigeria, forcing and compelling President Buhari and the National Assembly to change their measures and policies, destroying, encumbering and confiscating farmlands across Nigeria (resulting in the scarcity of foodstuffs and soaring prices of foodstuffs in Nigeria) in violation of Nigeria’s territorial sovereignty which is contrary to section 2 (a) (b) (i) (ii) (iii) (iv) and c (i), (ii) (iv) (vii) of the Terrorism (Prevention) Act 2011 (as amended). Nnamdi Kanu is being charged under sections 1 and 2 of the Terrorism (Prevention) Act 2011 (as amended) and sections 41, 44, 45 and 375 the Criminal Code Act for alleged acts of terrorism. Just last week they slammed terrorism charges against the Oyo traditional ruler Oba Solomon Akintola and 10 of his High Chiefs for allegedly invading Aagba Community in Oyo State and kidnapping three persons and injuring others. The pertinent question remains: Why is this Buhari government charging Nnamdi Kanu, Oyo Chiefs and others to court for alleged acts of terrorism while exonerating the Fulani herdsmen who have inciting the public in order to destabilize, or destroy the fundamental political, constitutional, economic or social structures of our country?

Explaining why the bandits were declared as terrorists, Malami, said, inter alia, “our assessment took into consideration that they are causing a major threat to territorial peaceful co-existence and causing a major threat to lives with weapons.” Are the murderous Fulani herdsmen not causing a major threat to Nigeria’s territorial peaceful co-existence? If the answer is in the affirmative, why are President Buhari and Malami conspiring to exonerate them from the heinous act of terrorism? Why have the duo acquiesced in the endless massacre of the innocent Nigerian citizens by the AK-47-carrying Fulani pastoralists and Miyetti Allah their sponsors? For example, in the aftermath of the massacre of about 200 villagers in Riyom, Barkin Ladi and Jos South local government areas of Plateau State in June 2018, Miyetti Allah quickly issued a statement accepting responsibility for the massacre. It admitted that it carried out the massacre in retaliation for alleged Fulani herdsmen who had been killed in the area. According to the then Chairman of the North Central zone of Miyetti Allah Danladi Ciroma, “These attacks are retaliatory Fulani herdsmen have lost about 300 cows in the last few weeks — 94 cows were rustled by armed Berom youth in Fan village, another 36 cows were killed by Berom youth. In addition to that, 174 cattle were rustled and the criminals disappeared with them to Mangu [Local Government]…Since these cows were not found, no one should expect peace in the areas”. Why didn’t the most excellent Abubakar Malami SAN and most righteous President Buhari dispatch the DSS to arrest or interrogate Ciroma for uttering the aforesaid inflammable terrorist statement in violation of sections 1 and 2 of the Terrorism (Prevention) Act 2011 (as amended) and sections 41,44, 45 and 375 the Criminal Code Act?.

Anyway, whether Buhari and Malami like it or not, the Global Terrorism Index (GTI) rates the Fulani herdsmen militia as the fourth deadliest terrorist organization in the world. The GTI has ranked Nigeria, for the sixth consecutive time since 2015, as the third country with the most impactful deadliest terrorist organization. The GTI says that in 2018 the killer Fulani herdsmen killed more Nigerians than Boko Haram. So why is the Buhari government refusing to tag the killer Fulani herdsmen as terrorists and treat them as such?

For Tinubu, What A Bad Week Last Week Was! …And The Igbos Are Coming

    By Mideno Bayagbon

    (mideno@thenewsguru.ng)

For frontline Presidential aspirant, Alhaji Ahmed Bola Tinubu, it was a bad start to his life long ambition to be president of the Federal Republic of Nigeria. It was a week better forgotten by him and his campaign managers. From unforced errors to downright spit on the face, the Tinubu campaign organisation recruited more people to dislike their aspirant than to like him.

Take the case of Honorable Jubril Abdulmumin, the self acclaimed DG of the Asiwaju Bola Tinubu Political Support Group. On AriseTV, Rufai Oseni, one of the anchors of the Morning Show asked two ordinarily simple questions: “How did your candidate make his staggering wealth? Secondly, there have been discrepancies about his age. Let me ask you, how old is he?” These questions so stunned the former House of Representative member, who at a time wanted to be speaker of the House that he could only attempt filibustering. He stuttered. He tried haranguing and bullying the anchorman, who stood resolute with demands for answers to the questions. Jubril Abdulmumin ended up doing more damage to the campaign dreams of the Tinubu group with the viral video, which soon went ballistic on social media. Any good the announcement of Bola Tinubu candidacy could have generated was frittered away. An enemy or rival could not have done worse.

To compound his woes, bad news also came from the home front. Afenifere, the pan Yoruba Social Cultural Group, came out boldly to voice their opposition to Tinubu’s candidacy. Also a seemingly orchestrated cacophony of voices, of mostly elite Yorubas, especially in the media, joined Bode George, Tinubu’s known traditional enemy, in standing up to register their rejection of his aspiration. Which must be a bit surprising to the Tinubu team which was busy up north, with their principal, trying to woo the northern political heavyweights to their side.

To add insult to injury, the Arewa Consultative Forum, in veiled reference to the rumoured health challenges of Asiwaju Tinubu and his age which has attracted so much debate, warned that Nigeria cannot afford to have another President with health challenges. As everyone remembers, of the four Presidents we have had since the return to democracy in 1999, two have had their tenures moderated by ill health. Indeed, one of them, Umaru Musa Yar’Adua actually transited while in office. The other, President Muhammadu Buhari has spent so much time attending to his health mostly in the United Kingdom that his tenure, in the final analysis, maybe classified by historians as one marred by ill health.

As it were, the Jagaban of Borgu, is currently living the saying: A man’s enemy could be members of his household. Most of the vitriols and attacks on his ambition have mainly come from the South West where he is regarded, by some, as the new Obafemi Awolowo, the renowned sage of the Yoruba nation. Even some of his known friends, like Professor Wole Soyinka, who some overzealous supporters of the Asiwaju had insinuated, have endorsed his ambition, have come out to denounce such.

Against expectation that the South West will queue behind his ambition, there have been discontents and open rebellion against his ambition. As it is, the South West is fragmented into at least three groups. There are those who support him overwhelmingly as opposed to those, especially of the younger elements, who are rooting for Vice President, Yemi Osinbajo and John Kayode Fayemi, the outgoing governor of Ekiti State. This is not to mention people like Tunde Fashola, Akinwunmi Adesina (President of the African Development Bank) and a few others hanging in the wings, scanning the impending scenario for an opportunity to jump into the presidential race.

Despite pretence to the contrary, the Tinubu campaign group could be heard last week expressing frustration at the perceived soft landing the mafia around President Buhari have given VP Osinbajo. Feeling betrayed, they were murmuring all over last week that Buhari and the people around him have not hidden their opposition to Bola Tinubu succeeding Muhammadu Buhari. They appear to be chumming up to the Vice President and to the one his followers call the Lion of Ubima, Transportation Minister, Rotimi Chibuike Amaechi. Then there is Fayemi also pulling weight among the President’s circle.

Nevertheless, unperturbed by the seeming gang up around the villa, Tinubu strategically continue to romance some leaders in the core north, with the hope they can come through for him when the dice is thrown and muscling hands are needed. It’s too early to call how the Jagaban, a veteran of sorts, in the Nigerian political firmament, will surmount the hurdles around Aso Rock, the unquenched rumours about his age and stupendous wealth and the growing opposition from his home front.

But the benefits of his foray into the northern political hemisphere are already yielding some good vibes as former Secretary to the Government of the Federation, Babachir Lawal, who was rumoured to be a parring partner to the Jagaban, before he fell from power, and some top notch politicians are beginning to queue behind him and are openly canvassing his candidature.

    …AND THE IGBOS ARE COMING

Like the Igbo proverb goes, all animals with horns were invited to a festival to which even the millipede and snail surprisingly showed up. That is almost the situation in Igbo land currently where every Emeka, Chidi and Ngozi are horning their dance steps to come into the presidential ring.

Former Senate President and Secretary to Government of Federation, Anyim Pius Anyim, was the first to brace the trail, throw his hat into the ring and dared all who cared to listen: whether the Peoples Democratic Party, to which he is a top member, zones the Presidential Spot to the South East or not, he will run…and win. He is, among top Igbos who have shown interest in the race, and who has been able to gather the leaders of PDP in the South East in one room to canvas their support. He it is, who has made the call by the Igbos for a compassionate consideration of a Nigerian of South East origin to vie for, and be the president of Nigeria. He has traversed the entire north, consulting and trying to build a coalition behind his ambition. He is currently pounding the pavements in the South South and South West.

Since the end of the Civil War 52 years ago, only Chief Alex Ekwueme, of blessed memory has come anywhere near the Presidential Villa, as Vice President to President Shehu Shagari. Their seeming marginalisation, which has crystallised into the badly managed IPOB, ESN and Nnamdi Kanu tomfoolery, is chalking up support for the call that people of South Eastern origin should be given the chance to also rule as President of Nigeria.

Another Igbo, the loud mouthed Nyesom Wike, Governor of Rivers State is also criss-crossing the states promoting his ambition to either be the presidential candidate or vice president to whoever eventually emerges the candidate of the PDP. He has the humongous revenue of his state behind his personal ambition, so does Ifeanyi Okowa, another Igbo and governor of Delta State.

On the side of the APC, the roll call is getting long too. The best positioned among them however, seems to be the Transportation Minister, Rotimi Chibuike Amaechi, another Igbo from Rivers state. Then there is Orji Uzoh Kalu, the billionaire ex governor of Abia State who was sprung from prison after being jailed for massive corruption perpetuated during his tenure as Governor of the State. Without doubt, he is well connected in the north and though he has not publicly declared his interest in the seat, his consultation drives across the country are all pointers.

Ebonyi state Governor, Dave Umahi, has also come out publicly to signify his ambition to occupy Aso Rock after President Buhari. A new comer to the All Progressives Congress, APC, Umahi appears to be positioning for other positions other than the presidency. He does not seem to have the national connection, the backing of critical stakeholders and cash to back his ambition. Coming from a back water state like Ebonyi, where he is even engaged in a war of attrition with some critical political leaders, his part seems strewn with pebbles.

Not so for Peter Obi who most people are still expecting to come into the race anytime from now. But being a strategic business and political thinker, it does appear that he wants to read the emerging political scenarios correctly before making the move to either contest for the Presidential seat or position for consideration as Vice President.

BREAKING: Presidency raises alarm of possible December terrorists attack in Abuja

The Presidency has raised an alarm of a possible attack by terrorists in Abuja, the Federal Capital Territory (FCT) this December.

TheNewsGuru.com (TNG) reports Office of the Secretary to the Government of the Federation (OSGF) made this known in letters addressed to security agencies in the country.

Consequently, the Federal Government has directed all security agencies in the country to beef up security arrangements this Christmas and New Year Holiday Season, with special emphasis on Abuja.

Following the directive, the Nigerian Immigration Service (NIS) has charged sector commanders to immediately deploy proactive measures against the identified potential threat, not just to prevent it, but to also arrest and prosecute the culprits.

According to a statement by the NIS, following the directive, the planned attack is expected to happen between 17 and 31 December, 2021.

The purported Abuja attack is said to be masterminded by one Drahmane Ould Ali, who also goes by the name, Mohammed Ould Sidat.

He is said to possess multiple passports, one of which is an Algerian diplomatic passport with the name; Najim Ould Ibrahim. He is suspected to be in the company of a Nigerien accomplice, one Zahid Aminon, who might also have a pseudonym.

The intelligence gathered also suggested that the terrorists are already in the West African sub region. They are suspected to be around the Mali-GAO-Niger Republic ambience. They are said to have collaborators on ground in Nigeria for the attacks planned for between 17th and 31st of December. They are said to have access to funds, logistics like vehicles and other supplies.

It was gathered that the prime actors of the Abuja terror plot are be likely to migrate into the country through land borders.

All Sector Commanders of Immigrations are therefore urged to intensify alert levels and response timing within their jurisdictions. It said all entry and exit points, including at Air, Land and Sea borders must be effectively and efficiently guarded at these times, as a measure to nip the terrorist’s plan in the bud.

The statement NIS reads: “The Office of the Ag CGI is in receipt of a Security Report (URGENT) from the Presidency (OSGF).

“The import is about a looming attack on Nigeria’s Capital City, Abuja, between 17 and 31 December, 2021.

“The planned attack is purportedly being led by one DRAHMANE, OULD ALI, aka Mohammed Ould Sidat, an Algerian national to be assisted by one Zahid Aminon, a Nigerien national.

“The report indicates the duo are enroute Nigeria from Mali through Gan and Niger Republic, riding a white Toyota Hilux van with Reg. No- AG157EKY. That these two had four Nigerian accomplices who are already embedded in the country.

“It is further reported that Ali holds Algerian Diplomatic Passport with the name Najim Ould Ibrahim.

“Consequently, I am directed to request you to intensify alert levels, emplace necessary counter measures at all our entry/exit points- Air, Land, Sea/Marine, including, but not limited to, surveillance, rigorous search on persons and vehicles, transhumance, to effectuate the immediate arrest of these terrorists/countervail this and any terrorist attacks in Abuja”.

Insecurity: Northern Elders warn against declaring all Fulanis terrorists

Northern Elders under the aegis of the Northern Elders Forum, have warned against any move targeted at designating all Fulani persons as terrorists.

The elders warned against the backdrop of a Federal High Court in Abuja, presided by Justice Taiwo had declared the bandits terrorising parts of the North as terrorists, saying their criminal activities were acts of terrorism.

The group in a statement issued on Monday by the Director Publicity and Advocacy of the forum, Dr Hakeem Baba-Ahmed, the group expressed concern that declaring bandits as terrorists may affect innocent Fulani people.

The group said only the criminal elements among the Fulani herdsmen should be made to face the wrath of the law.

The statement reads in part, “The Forum noted a judicial decision to label bandits and kidnappers as terrorists and recommends greater clarity in terms of the targets of this development. In any event, the Forum cautions against profiling and targeting all Fulani as terrorists.

“Millions of law-abiding Fulani’s exist who should be encouraged to stay on the side of the law, while those who have chosen to continue on the path of criminality should feel the full weight of the law”.

Terrorists planning to attack military bases in border towns nationwide – DSS warns

The Department of State Services (DSS) has raised an alarm over plans by terrorists to attack military bases in border towns across the country.

The secret agency also put the Nigeria Customs Service on red alert to avert the pending attacks by the insurgents on Ogun border communities and other border towns across the country, noting that the warning is based on intelligence it gathered.

In a leaked memo dated November 25, 2021 and addressed to the Customs Area Controller, Nigeria Customs Service, Ogun Area Command, Abeokuta, the DSS advised customs and other security agencies in the country to put counter-measures in place to frustrate the plot by the insurgents.

In the leaked memo was stamped and received by the CAC’s office the same day.

The Civilian Joint Task Force (CJTF) arrested one terrorist and killed three others on Friday.

The insurgents were caught in the act of stealing food items along Maiduguri-Damaturu Road in Borno.

They attacked farmers and were leaving with their loot when the security operatives engaged them.

The farmers, both siblings, had harvested their farm produce near Daiwa within the Damboa precinct.

A military source said the terrorists shot a number of people on their farmland, killing two and injuring one.

He said Saminu Audu, a CJTF commander, led the operation at Lamboa, between Minok-Janaka along the Damaturu-Maiduguri highway.

“After a fierce confrontation, three of the terrorists were killed, one was captured alive.

“The terrorists are remnants of Boko Haram under Abubakar Shekau faction.

  • FG reacts to court’s proscription of bandits as terrorists

FG reacts to court’s proscription of bandits as terrorists

The Minister of Justice, Abubakar Malami on Friday said the Federal Government will follow international standards in fighting banditry, terrorism, and other criminal activities in the country.

Justice Taiwo Taiwo of the Federal High Court Abuja had earlier proscribed bandit groups as terrorists, specifically noting that the activities of Yan Bindiga and Yan Ta’adda bandit groups, constitute acts of terrorism.

The ruling followed an ex parte motion the Federal Government filed through the Federal Ministry of Justice.

Malami in a statement by his media aide, by Dr. Umar Jibrilu Gwandu, reiterated the Federal Government’s determination to crush banditry.

He said the government’s commitment has remained unwavering following the recent court ruling that designated bandits’ groups as terrorists’ organisations.

According to him, the declaration is a demonstration of the determination of the office of the Attorney-General of the Federation and indeed the Federal Government in doing things in accordance with the rule of law.

“The development is a pointer to the commitment of the Federal Government to adhere to the international standards in respecting the rules of engagement in the fight against terrorism, separatists’ organisations, insurgency and banditry in the country,” Malami was quoted as saying.

By the declaration, Malami said the Muhammadu Buhari administration has taken bold steps to deal ruthlessly with all terrorist groups and their sponsors in order to bring a lasting solution to the myriad of insecurity challenges in the country.

In achieving peace across the country, he explained that there would be a collaboration with relevant government agencies including security operatives to do the needful to take full advantage of this declaration.

The Minister also said the government will gazette and publish the proscription order.

  • Declaring bandits as terrorists won’t change anything – Sheikh Gumi

Declaring bandits as terrorists won’t change anything – Sheikh Gumi

Islamic scholar, Sheikh Ahmad Gumi has described the declaration of bandits as terrorists as a decision taken for mere political expediency, which will not change anything.

According to him: “I think the Federal Government has succumbed to media blackmail by a section of the country. It will not have any practical value because even before the declaration they are being fought and treated as terrorists.”

In a statement by Malam Tukur Mamu, the Dan-Iyan Fika and Media Consultant to Sheikh Gumi, the Muslim scholar said: “So it’s just a nomenclature which I believe will not change the dynamics on ground.

“If you can remember IPOB was also declared a terrorist organisation, the declaration was even backed by the order of the Court but as you can see even the international community did not recognise FG’s declaration of IPOB. So it has failed to be effective or to achieve the desired results.”

“They have not been ban from travelling to other countries while their citizenship remains intact, it has not been denounced. So what type of declaration is that?

” I sincerely hope that Nigerians will not take the herdsmen as terrorists but should regard the criminality of the few among them against innocent people as acts of terrorism just as we see IPOB and their attacks on security agencies and other northern citizens as acts of terrorism. Very few herdsmen are bandits if you go through their population.”

“I hope this declaration will not give the license to people to be profiling herdsmen in general as terrorists and taking laws into their hands against them. It will cause more mayhem.

“The declaration will not change anything, it will not change the dynamics. Already the military is engaging them. It didn’t stop them from kidnappings and killings. The declaration will not end their aggression against the society.”

He added: “The Fulani banditry is a socio-economic problem. We have seen it, we interacted widely with them. We told the federal government the way out. It can only be won through engagement, dialogue and justice. That is why today there is relative peace in the Niger Delta because government have accepted the painful reality of rehabilitating and empowering them.”

“There has to be equitable distribution of wealth in Nigeria and justice for every one. People don’t want to accept it, before the issue of banditry that now affects all of us, the Fulanis have suffered so much.”

“They have lost their legitimate means of livelihood, I mean their cows through cattle rustling and extortion by security agencies. That has to be addressed as a means of genuine reconciliation and integration. They should have sense of belonging.”

  • Court proscribes two terror groups, declares bandits as terrorists

Court proscribes two terror groups, declares bandits as terrorists

A Federal High Court in Abuja has outlawed the activities of some groups linked to banditry and declared their activities as acts of terrorism.

In a ruling yesterday, the Abuja court specifically declared the activities of the “Yan Bindiga Group” and the “Yan Ta’adda Group” and other similar groups in any part of the country, especially in the Northwest and Northcentral geo-political zones, as “acts of terrorism and illegality”.

It equally proscribed the Yan Bindiga Group and the Yan Ta’adda Group as well as other similar groups in any part of Nigeria, especially in the Northwest and Northcentral geo-political zones, “either in groups or as individuals by whatever names they are called.”

The court restrained “any person or group of persons from participating in any manner whatsoever, in any form of activities involving or concerning the prosecution of the collective intention or otherwise of the Yan Bindiga Group and the Yan Ta’adda Group under any other name or platform however called or described.”

The court ordered the Federal Government to publish the prosecution order in the Official Gazette and two national dailies.

Justice Taiwo Taiwo gave the orders in a ruling after listening to Aminu Kayode Alilu, from the Federal Ministry of Justice, who argued the motion ex-parte filed by the Federal Government to that effect.

Justice Taiwo said he was convinced that such orders were necessary in view of the nefarious activities of bandits and their effects on the people and the nation’s economy.

The judge also proscribed all other groups in the country, irrespective of their names, but whose activities and objectives are similar to those of Yan Bindiga Group and the Yan Ta’adda Group.

Justice Taiwo listed terror activities to “include, but not limited to banditry, kidnappings for ransom, kidnapping for marriage, mass abductions of school children and other citizens, cattle rustling, enslavement, imprisonment, severe deprivation of physical liberty, torture, rape, sexual slavery, enforced prostitution, forced pregnancy, other forms of sexual violence, attacks and killings in communities and commuters and wanton destruction of lives and properties in Nigeria.”
