Kaduna guber: What APC lawyer said about tribunal judgement

Counsel to the All Progressives Congress (APC) in Kaduna State, Sanusi Musa has insisted that the State Governorship Election Petition Tribunal dismissed the petition of the People’s Democratic Party (PDP).

TheNewsGuru.com (TNG) reports both candidates of the APC, who is the Governor of Kaduna, Uba Sani and the PDP, Isa Ashiru claim the tribunal judgement to be in their favour.

According to Musa, the PDP wanted to be declared as the winner of the election but the tribunal ruled that they have not proven that.

“The tribunal has dismissed the petition filed by the PDP. That is the ruling of the tribunal in the morning.

“But by the provision of the Constitution, they required to also consider the petition on merit.

“So, on merit, two of them said that election was supposed to be conducted in 22 polling units because the number of the voters there exceed the margin.

“But the PDP wanted to be declared as the winner of the election but the tribunal said that they have not proved that.

“They alleged that there were corrupt practices perpetrated by the APC, they said they have not proved that.

“So, in essence, as at today, PDP petition is dismissed by the tribunal. Unless PDP appeal to the Court of Appeal, then, we will now know what will happen there. But the petition has been dismissed,” Musa said.

BREAKING: Tribunal judgement in my favour – Ashiru claims

Rt. Hon. Isa Mohammed Ashiru, candidate of the People’s Democratic Party (PDP) in the 2023 governorship that held in Kaduna State has said the judgement delivered by the election petition tribunal earlier today was in his favour.

TheNewsGuru.com (TNG) reports the judgement delivered by the Kaduna State Governorship Election Petition Tribunal on Thursday has been marked by confusion, following a reaction by the State Governor, Uba Sani.

According to Ashiru, the tribunal by a split decision of 2:1, nullified the election of Sani and ordered that the Certificate of Return be retrieved and fresh elections be conducted in some polling units in 4 LGAs and the outcome thereof be reckoned with before the declaration of the winner of the governorship election in Kaduna State.

A statement by the Kaduna State PDP Governorship Candidate reads: “First, I give glory to God Almighty for the progress made so far in our effort to reclaim the mandate given to us by the good people of Kaduna State. I also thank the people of the state for widely believing in me and the PDP.

“Also, given the ruling of the Kaduna state election tribunal, it has become necessary to share with our teaming supporters, the true position of the ruling.

“On the preliminary objection, the tribunal, based on the majority of 2:1 judges upheld the preliminary objection of the respondent to the effect that the application for pre-hearing was done prematurely i.e. before the service of the last set of petitioners’ reply to the 2nd respondent’s reply to the petition was served.

“However, the law enjoins the tribunal, as a trial court, to proceed to pronounce on the merit of the substantive suit so that in the event the court of appeal finds that the trial tribunal was wrong in its decision on the preliminary objection, it would have the benefit of pronouncing on the decision of the tribunal in the substantive matter.

“Accordingly, the trial tribunal finds merit in the aspect of the petitioner’s case relative to the margin of win between the two leading candidates.

“The tribunal by a split decision of 2:1 accordingly, nullified the election of the governor of Kaduna state, ordered that the Certificate of Return be retrieved and fresh elections be conducted in some polling units in 4 LGAs and the outcome thereof be reckoned with before the declaration of the winner of the governorship election in Kaduna state.

“I want to again thank the people of the state while urging them all to remain law abiding while we pursue the appeal process.

“One thing I can assure the good people of Kaduna State is that I will pursue this mandate you freely gave me to its logical conclusion and by the grace of God, victory on our side”.

Confusion trails Kaduna guber tribunal judgement

The judgement delivered by the Kaduna State Governorship Election Petition Tribunal on Thursday has been marked by confusion, following a reaction by the State Governor, Uba Sani.

According to Governor Sani, the tribunal judgement was a clear affirmation of the popular mandate given to him by the people of the State.

While some reports said the court affirmed Sani’s election after dismissing the petition filed by the Peoples Democratic Party, PDP, and its candidate, Isa Ashiru, other accounts of the judgement said the tribunal sacked the governor while declaring the election inclusive.

But in his reaction to the judgement, Uba hailed the ruling, saying he was extremely delighted.

“The judgement is an unequivocal affirmation of the popular mandate graciously given to me by the good people of Kaduna State,” he said in a statement he personally signed.

“I commend the Tribunal for their thoroughness and lucidity. They have enriched our jurisprudence and practice of electoral democracy.

“I also commend my dear brother, Hon. Isah Ashiru Kudan for approaching the Tribunal to ventilate his grievances.

“This is a clear demonstration of his belief in the principles of democracy and the imperative of civility in the conduct of political actors.

“I call on Hon. Isah Ashiru and members of the opposition parties in Kaduna State to join hands with us as we strive to move our dear state to a higher level.

“We are all stakeholders in PROJECT KADUNA. It is not about personal glory. Our people want all hands to be on deck to address the myriad challenges confronting the state. If political actors are united, a clear signal will be sent to our people that the quest for peace, security, progress and development of our state are the driving forces of our participation in politics.

“I call on our party faithful to moderate their celebration of this victory. They must individually and collectively extend an olive branch to our brothers and sisters in other political parties.

“Instead of celebrating, we should bow down in prayers to the Almighty God for His continued guidance and protection. Let us focus on the tasks ahead.”

Uba Sani reduces fees in Kaduna tertiary institutions

The Kaduna State Government has announced the downward review of tuition fees in state-owned tertiary institutions.

Gov. Uba Sani announced the measure during an interactive session with newsmen in Kaduna on Monday.

Sani said that the review was in response to public outcry over the current fees in state-owned tertiary institutions and their effects on school enrolment and retention.

Giving details of the review, he said that the N150,000 charged by the Kaduna State University was reviewed downward by 30 per cent to N105,000.

Others were Nuhu Bamalli Polytechnic from N100,000 to N50, 000.

For College of Education, Gidan Waya, the fee came down from N75,000 to N37,500.

The fee charged by Shehu Idris College of Health Sciences and Technology, Makarfi for Higher National Diploma courses was reviewed from N100,000 to N70,000.

In a similar vein, the fee for National Diploma courses in the same institution moved down from N75,000 to N52,000.

For Kaduna State College of Nursing, the fee was reviewed from N100,000 to N70,000.

The governor described the measure as his government’s palliatives to cushion the effect of the petroleum subsidy removal and its harsh economic effects on the people.

He said that the Heads of Tertiary Institutions, in conjunction with the Ministry of Education, obtained relevant information on the extant fee regime in state-owned tertiary institutions.

He said: “At the end of their assignment, they made the following observations and recommendations.

“That the extant fee regime in the state-owned tertiary institutions is burdensome and has led to a significant decline in student enrolment.

“That the extant fees have made many students to either abandon the pursuit of tertiary education or move to alternative institutions.’’

He said that to reverse the ugly trend, “it is imperative that a competitive fees model is adopted in our tertiary institutions”.

He said that the competitive fees model “responds to the current realities and promotes access to quality education”.

Sani reaffirmed his administration’s commitment to the welfare of the people.

“My administration will continue to take all the necessary measures to ensure access to free and quality education for every child in the state from primary to secondary school,” he said.

He also said that expanding access to higher education, enhancing teachers’ welfare and teaching standards as well as improved school infrastructure had built ICT competence in students from basic education level.

The governor further said that the State Government had intensified investment in technical and vocational education in the state.

Uba Sani will be a worthy successor – Gov El-Rufai

Gov. Nasir El Rufai has promised to relocate from Kaduna state on May 29, 2023, after handing over to his successor, so as not to interfere with the incoming administration.

The governor spoke at a Town-Hall meeting, organized by the central senatorial zone on Monday in Kaduna.

He expressed optimism that Sen Uba Sani will succeed him, saying that he will not make any input in the running of the next All Progressives Congress (APC) government.

El Rufai said that the next governor will be guided by God if he has a pure heart, adding that Senator Uba Sani is a good man who will also make an excellent governor.

He described Sen Uba Sani as a worthy successor who will take Kaduna state to greater heights when voted as governor.

He said that he has known the senator for over 20 years and he has proved his mettle politically.

El Rufai advised the people of Kaduna state not to inundate him with requests for notes to Uba Sani, to be given appointments or contracts when he becomes governor.

Speaking at the event, Senator Uba Sani said he has been a student of Malam Nasir El Rufai’s School of Governance and Policy in the last 20 years and he has acquired several ‘’degrees’’ as a result.

‘’In this school, there were some people who entered before me, people like the Secretary to the State Government, Malam Balarabe Abbas Lawal, who is my senior. However, the school has no graduation date. So, we are still learning,’’ he said.

The senator who promised to continue with the policies and programmes of the El Rufai administration, praised the governor for re-engineering governance in Kaduna state.

‘’Before the coming of this administration, government’s resources were being shared amongst a few elites, after payment of salaries. So, there was nothing left for development, in spite of the huge resources that Kaduna state was receiving as federal allocation.

‘’But Nasir El Rufai changed that narrative by improving education, revamping healthcare and building infrastructure that is benefitting the good people of Kaduna state, instead of a few people’’ he added.
