Ebonyi: It will be unjust to hand over to my brother, says Umahi

Gov. David Umahi of Ebonyi has said that it will be unjust for him to hand over to his brother from the same Ebonyi South Senatorial District as his successor.

Umahi said this on Friday at an APC campaign rally in Abakaliki Local Area (LGA) of the state.

He was referring to the PDP Governorship Candidate, Dr. Chukwuma Odii, who also hails from Ebonyi South.

The governor said that “equity and justice would be negated if such happens”.

“It will be wrong, if after eight years, I hand over to my brother from the next door Local Government Area.

“This will violate the peace, equity, justice, understanding of our founding fathers and everything that binds us,” Umahi said.

He said it was time to reciprocate the gestures of the Ebonyi North Senatorial District, especially the Izzi clan, which massively supported him in 2015.

“The Izzi people in the same spirit of equity, supported me in 2015 because it was the turn of the southern district to rule.

“Power should return to the north where it all began and precisely, the Izzi clan.

“The Speaker of the State House of Assembly, Chief Francis Nwifuru, should be supported,” he said.

According to him, anyone fighting for what does not belong to him, is fighting God.

He, therefore, urged the people to vote for all the APC candidates at all levels, saying that the party had performed well in the state.

“Vote for Ahmed Tinubu for President because he took care of Igbos as Lagos governor and will take care of us as president.

“I want to inform the opposition that they cannot negotiate 25 per cent of votes in Ebonyi because the state is totally for APC,” Umahi said.

In a speech, the APC governorship candidate thanked the governor for ensuring that the charter of equity was respected.

He said that the people would remain eternally grateful to him for supporting equity.

“When some stakeholders of the state decided to oppose this arrangement, you decided to stand by it and bequeath peace on the land.

“We came to show capacity of delivering and demonstrate that Ebonyi is totally for APC,” Nwifuru said.

In an address of welcome, the Chairman of Abakaliki LGA, Mr Ebere Nwogba, pledged that his people would deliver APC at the polls.

All the candidates from the area and some stakeholders took turn to affirm their commitment to secure victory for the party at the polls.

Umahi denies supporting PDP guber candidate for 2023

Gov. David Umahi of Ebonyi, has refuted claims that he is supporting the state governorship candidate of the Peoples Democratic Party (PDP) Dr. IfeanyiChukwuma Odi for 2023 poll.

This is contained in a statement in Abakaliki by Mr. Chooks Oko, his Special Assistant on Media.

Oko said that the governor said this at his hometown Uburu, in Ohaozara Local Government Area (LGA) of the state, when he received members of the Christian Association of Nigeria (CAN).

Umahi, also Ebonyi South senate candidate of the All Progressives Congress (APC), said the insinuations were far from the truth.

“Those who are saying that Odii is a tool in our hand are very wrong. If they know the attack I face every day, they won’t say that.

“If I were to support, I would prefer someone else, who came from a tiny constituency, not someone, who came from my own zone,” he added.

Umahi admonished CAN, elders, founding fathers and all stakeholders to support zoning and power rotation, for sustainable peace in the state.

“When we were contesting in 2015, the North and Central supported us; their leaders stood with us,” Umahi added.

The News Agency of Nigeria (NAN) reports that Odii, Ebonyi PDP governorship candidate for 2023 poll shared the same zone with Umahi.

Rev. Father Abraham Nwali, chairman of CAN in southeast, said the visit was in the spirit of Christmas to felicitate the governor.

Christmas Party: Umahi orders arrest of caterer over poor food quality

Gov. David Umahi of Ebonyi on Thursday, ordered the arrest of the caterer who allegedly served poor quality food during the Christmas party for widows and the aged in the state.

Umahi, who did not disclose the name of the caterer, said it was terrible for someone to give others what he or she could not consume.

The governor said that the police would follow due process in investigating the cook for her to refund the funds given to her to prepare the food.

“We are therefore, going to repeat this party as we should celebrate our fathers and mothers well.

“The bible enjoins us to honour our fathers and mothers so that our days would be long on earth.

“I want my days to be long because I have suffered from the youth.,” he said.

He declared that he would inspect the food to be served the widows and elders during the repeat celebration scheduled to hold on Dec. 21.

“I have directed the deputy governor and my senior special adviser on religion and welfare matters, to make adequate preparations.

“The celebration must be held on Dec.20 or 21 as anyone who takes what belongs to these category of people is taking trouble,” he said.

Umahi also expressed dismay over the quality of wrappers given to the widows and elders, describing it as low in quality.

“We gave the civil servants high quality of wrapper and they were happy.

“The people who supplied those of the civil servants should be ready to supply 10,000 highest quality wrappers, to the widows and elders,”.

He advised parents to inculcate good morals in their children to check the social vices being witnessed in the country especially in the south east zone.

“When I declared that the mode of agitation some people propagated in the zone would be uncontrollable if not checked, people didn’t take it serious.

“Ebonyi will never be part of any agitation which leads to the killing of our people and unwarranted destruction of property,” he said.

  • Appeal Court nullifies sack of Ebonyi gov, Umahi, Deputy

Appeal Court nullifies sack of Ebonyi gov, Umahi, Deputy

The Court of Appeal, on Friday, vacated the High Court judgment sacking Gov. David Umahi of Ebonyi and his Deputy, Dr  Eric Igwe, following their defection to the All Progressive Congress, APC.

The appellate court, in a unanimous decision by a three-man panel led by Justice Haruna Tsanami, held that there was no constitutional provision for the removal of a serving governor or deputy governor that dumped the political party that sponsored them to power.

The court held that the only option available to a political party aggrieved by the defection of a governor or deputy it sponsored to power, was for such party to explore the option of impeachment as provided in the Constitution.

Consequently, the appellate court, voided the high court judgement that removed Umahi and his deputy from office.

The appellate court further ordered the Peoples Democratic Party, PDP, to submit names of their replacement to the Independent National Electoral Commission, INEC.

The News Agency of Nigeria (NAN) reports that Justice Inyang Ekwo of the Federal High Court in Abuja in his judgment on March 8, held that the total number of 393, 343 votes governor Umahi secured during the March 9, 2019 governorship contest in Ebonyi state, belonged to the Peoples Democratic Party, PDP, which sponsored his election.

The trial court held that the said votes was not legally transferrable to the APC which governor and his deputy decamped to, stressing that the duo not only jettisoned the PDP, but also the votes that belonged to it.

It held that the PDP was bound to retain the votes and mandate that was given to it by electorates in Ebonyi state.

Ekwo held that having regard to section 221 of the 1999 Constitution, as amended, and the democratic system of governance operated in Nigeria, votes at the election and elections are won by political parties and not their candidates or the candidates sponsored at the election by the political parties.

He further made a declaration, that “votes won or scored by a political party at an election is retained by the political party irrespective of the death or exit of the candidate it sponsored for the election, from the political party.

“A declaration that candidate of a political party that won the majority votes at an election is not entitled to retain or continue to lay claims to the votes won by the political party after moving to another political party, rather, the candidate is bound to inherit, utilize or appropriate the votes won by the new political party he has adopted”.

He directed PDP to submit to the INEC, the name of its candidates to replace the 3rd and 4th Defendants, the court, issued an order of perpetual injunction, restraining governor Umahi and his deputy from putting themselves out or parading themselves as Governor and Deputy Governor respectively of Ebonyi state.

The trial court issued an order of perpetual injunction restraining APC from parading itself as the political party whose members occupy the offices of Governor and Deputy Governor respectively of Ebonyi state.

However, dissatisfied with the judgement, both Umahi and his deputy took the matter to the appellate court.

The appellants had argued that the trial court, in ordering them to vacate their offices based on the suit marked FHC/ABJ/CS/920/2021, which was brought against them by the PDP, attempted to overrule a subsisting decision of the Supreme Court in AG Federation v. Atiku Abubakar & 3 ORS (2007) LCN/3799 (SC).

They contended that the apex court had in its decision, held that no constitutional provision prohibited a sitting President or Vice President, and invariably, the Governor or Deputy Governor, from defecting to another political party.

Umahi and his deputy argued that there is no specific mention of Governor and Deputy Governor in the provisions of both sections 68 and 109 of the 1999 Constitution, as amended.

They further argued that the trial court erred in law, when it restrained them from carrying on the duties in their offices as Governor and Deputy Governor of Ebonyi State, on the premise that they acted in breach of sections 177(c) and 221 of the Constitution.

“Section 221 of the Constitution is not to the effect that votes cast during the Governorship election of March 9, 2019 belonged to the 1st Respondent (PDP), but rather to the Appellants.

“Section 177 of the Constitution is all about qualification for a candidate to the Governorship election and has anything to do with punishment for defection”, they argued.

They averred that the trial court erred in law, when it ordered the 1st Respondent (PDP) to submit to the 2nd Respondent (INEC), names of its candidates to replace the Appellants as Governor and Deputy Governor of Ebonyi .

They argued that no law gave the court the power to declare anyone that did not participate in all stages of the election, as winner of the said election.

The Governor said: “I commend the President, National Assembly people for the Initiative.

“The level of arms in the society is so terrible.

“I think you would also turn your eyes to the borders and then these locally manufactured weapons.

So, this will work and it will be very helpful.”

Governor Umahi further advocated for the reinvigoration of the federal character principle in allocation of positions in the country, adding that such would help reduce tension and agitations.

“I will continue to say that we have Federal character and nobody should shy away from saying that.

“Those who intentionally exclude South East from the affairs of the Nation should remember that it must not end the way they wish it.

“We should try to be fair in this Country if we say that we are brothers and sisters.

Governor Umahi, during the event, also set up a 10-man Committee to work with the National Taskforce/ Commission in the State to facilitate the enlistment of over 4,000 Ebonyians.

  • Ebonyi: Why Umahi is afraid of losing APC senatorial ticket

Ebonyi: Why Umahi is afraid of losing APC senatorial ticket

Princess Ann Agom-Eze, who is challenging Governor David Umahi’s emergence as the  APC Ebonyi South Senatorial Zone candidate, on Sunday, said the governor is afraid of being defeated by a woman.

Agom-Eze made this known while responding to her alleged sack from APC by the party’s zonal leadership at Afikpo North Local Government Area headquarters. She argued that the zonal leadership has no such right to sack her, hence the matter is pending at the appeal court sitting in Enugu State.

She denied committing any crime against the party to warrant her sack other than her persistence to reclaim her senatorial ticket mandate, which according to her, is being forcefully taken away by Umahi.

Agom-Eze insisted that Umahi has utilized his opportunity by contesting for President and cannot contest again in this electoral year.

“This matter is pending at the Court of Appeal, Enugu. How can I be suspended at the APC zonal office? What is my crime? Insisting on the mandate right? Or because Governor Umahi wants the ticket? Where will he take it to? By contesting for the President, he has used his opportunity for this electoral year. He needs to accept the truth.

“Their action in Afikpo Is a show of desperation. Being afraid of being defeated by a woman, so he has decided to cut corners thinking that is the easiest way of achieving a result he can never get.

“The 2022 electoral process is his biggest problem and he cannot even win this, after spending Ebonyi money on bribe, can’t change the law. He should be a law abiding citizen and wait for the judgment of the appeal court rather than resorting to intimidation and harassment. No matter what he does the law must take its cause because no one is above the law,” she said.
