    BREAKING! Appeal Court finally bars FRSC from seizing licences, vehicles

    The Court of Appeal sitting in Owerri, Imo State, has ruled that the Federal Road Safety Corps (FRSC) has no legal authority to seize drivers’ licences, vehicles, or related documents without lawful justification.

    The ruling was delivered in Appeal No: CA/OW/199/2022, filed by the FRSC, the Corps Marshal, and an officer identified by Uniform No. COSS 35 (as 1st to 3rd Appellants) against Dr. Emmanuel Ugochukwu Shebbs (Respondent).

    The appellate court upheld the earlier judgment of the Abia State High Court, which had declared the actions of the FRSC as a violation of Shebbs’ fundamental human rights.

    In a unanimous decision, Justices Amina Audi Wambai, M. Lawal Abubakar, and Ntong F. Ntong affirmed the liability of the FRSC, stating that its actions were unlawful. However, the appellate court reduced the damages initially awarded from N30 million to N10 million, covering both general and exemplary damages.

    The case originated from a 2020 incident during the COVID-19 lockdown when FRSC officers stopped Dr. Shebbs along Bende Road in Umuahia. He alleged that after an initial inspection of his vehicle found no fault, the officers demanded a bribe. Upon his refusal, they conducted a second inspection, accused him of having a worn-out tyre, and seized his driver’s licence while issuing a N3,000 fine.

    Instead of paying the fine, Shebbs approached the Abia High Court, arguing that the seizure of his licence without due process violated his fundamental rights—a claim both the High Court and the Court of Appeal have now upheld.

    The Lagos State Traffic Management Authority (LASTMA) says it impounds commercial vehicles sometimes outside the area where their drivers commit offences as a matter of strategy.

    The Director, Public Affairs and Enlightenment Department of LASTMA Mr Adebayo Taofiq, said this in an interview with NAN on Tuesday, in Lagos.

    He said that the belief that commercial buses were ignored many times when committing offences was wrong, as the authorities had strategies to bring them to book.

    “The fact remains that at the point few of them are committing these traffic infractions, as noticed by private car owners, they’re not apprehended, does not mean that we don’t have any plan of impounding them.

    “For example, if you have a commercial bus coming from like Mile 12 going to Onipanu, if it commits any traffic infraction in Ketu, we have to be strategic if we want to arrest and impound a commercial bus, unlike the car owners.

    “They don’t care for their vehicle to be arrested, they even get rid of anything ahead of them just to escape with their bus.

    “In such case, our officers have to use their discretion in order not to cause any havoc.

    “We use the new system that government gave us, which is the CMS camera, which is the traffic management device, and at times, officers use their phones to capture them,” he said.

    Taofiq said that by the time such vehicles are captured while on transit by LASTMA officers ahead, due to the vehicle features taken and forwarded to be looked out for, passengers in the vehicle would not be aware of the driver’s offence.

    He urged the public, especially passengers, to understand such situation and not believe such drivers were innocent.

    “We see some passengers coming down from the bus and descending on our officers and some of them have been harmed and beaten up in the process.

    “The passengers claim that the bus driver had not done anything without them having prior notice that the driver had committed an infraction previously.

    “We just don’t pounce on these persons, an infraction had already been committed and we will not continue to tolerate these abuses on our officers, ” he said.

    He, however, urged LASTMA officers to apply their discretion wisely in such instances, so that the passengers on board would not suffer unduly.

    Taofiq said that discretionary measures could be to ensure that passengers are refunded their transport fares or even taken to the nearest bus stop so as to get buses to their destination.

    “Using our discretion is part of training given to LASTMA officers to ensure safety of passengers which is paramount.

    “Once a vehicle contravenes any section of the Lagos State Transport Sector Reform Law, such vehicle stands to be contravened and be in a position for LASTMA to impound it,” he said.

    He said that traffic infractions by commercial buses had to be checked by LASTMA officers.

    He urged the public to disregard insinuation in some quarters that LASTMA officers only concentrate on private cars, noting that there was no basic truth in that.

    Taofiq said that since the new Area Manager, Mr Olalekan Bakare, assumed office on Nov. 20, 2023, there had been a lot of training and retraining of officers for them to be more prudent, civil and be empathetic on the road.

    “Equally, the Special Adviser to the Governor on Transportation, Mr Sola Giwa has been of immense help towards having a new face of LASTMA,” he said.

    We’ll impound vehicles transporting human beings with animals – FRSC

    The Ogun Command of  the Federal Road Safety Corps (FRSC) says it will impound any vehicle found carrying human beings together with animals.

    Mr Anthony Uga, FRSC Sector Commander Ogun, disclosed this to NAN on Friday in Ota, Ogun.

    Uga said the warning became necessary due to the ways drivers now transported human beings together with animals regardless of the obvious consequences.

    The sector commander said that the practice resulted to road accident fatality.

    He said the FRSC had met with animal dealers at Kara area on Lagos-Ibadan expressway to enlighten them on the dangers.

    Uga said that findings by the FRSC showed that most drivers violated the rule without the knowledge of the owners of animals they were transporting, adding that anybody caught would be penalised.

    “Anybody caught will be punished and his vehicle impounded,” he said.

    Just In: FRSC orders immediate clampdown on rickety vehicles nationwide

    The Corps Marshal, FRSC, Dauda Biu, has ordered immediate clampdown on all old and rickety vehicles across the country.

    Biu gave the directives in a statement by the Corps Public Education Officer (CPEO), Assistant Corps Marshal (ACM), Mr Bisi Kazeem, on Thursday in Abuja.

    The FRSC Corps Marshal said the directives became necessary due to a trending video of an old car with three worn-out tyres plying the highway in Sagamu, Ogun State.

    He, however, ordered immediate clampdown of the vehicle and arrest of the owner as the act could endanger the lives and property of the public.

    According to him, the attention of the Corps was drawn to the trending video of the old vehicle with mechanical issues plying the expressway.

    “The vehicle with registration number, Lagos AA07AG was not only old but was plying the highway with just three worn-out tyres.

    “The personnel of the agency are directed to be on the lookout for the car and other unstable vehicles plying major roads in Nigeria.

    “The operation will be conducted nationwide and severe punishment awaits the owner and anyone using such vehicles, ” he said.

    Biu said that the new order was part of a continued effort by the FRSC to reduce the occurrence of road accidents on Nigerian roads.

    He said that all Sector Commanders and Zonal Commanding officers of FRSC were to begin enforcing the new order with immediate effect.

    “As a matter of fact, FRSC officials are now authorised to arrest and prosecute anyone who operates rickety vehicles on Nigerian roads.

    “The officials are also allowed to impound such vehicles and tow them to the nearby FRSC office, ” he said.

    The FRSC boss appealed to the general public to work with the corps and report when such vehicle was sighted, to ensure the safety of lives and property.

    Police in Nasarawa State on Monday warned motorists to stop picking up strangers on the highway as criminals now posed as commuters to snatch vehicles from unsuspecting motorists at gunpoint.

    Police spokesman in the state, DSP Ramhan Nansel, stated in Lafia that the criminals usually posed as commuters and stopped vehicles on the Lafia-Abuja and Akwanga-Keffi routes to perpetrate the act.

    The police also warned the travelling public to ensure to go to authorised motor parks to board vehicles so as not to fall victims of criminal elements.

    Nansel assured in the statement that the police were determined to end the menace.

    He called on members of the public to telephone numbers: 09115629178, 09067877096, 08112692680, and 08104441179 when in distress.

    Zamfara: Police returns ex-gov Matawalle’s vehicles

    Zamfara state police Command on Saturday said it had returned all vehicles seized from former governor of the state, Bello Matawalle.

    The command’s Police Public Relations Officer, ASP Yazid Abubakar confirmed the development on Saturday via telephone conversation with News Agency of Nigeria.

    Abubakar said the vehicles were returned in compliance with the order of Federal High Court sitting in Gusau.

    The court, presided by Justice Aminu Bappah-Aliyu had on June 15, ordered all security agencies that removed the vehicles from Matawalle’s houses in Gusau and Maradun, to return them within 48 hours.

    Recall that security operatives removed the vehicles from the two houses on the order of the State government.

    The court gave all parties involved in the invasion of the former governor’s houses 48 hours to comply with the order.

    “Yes, the police command has complied with the court order as regards to returning of all vehicles belonging to the former governor, Bello Matawalle.

    “We have returned all the vehicles to the premises of Federal High Court, Gusau, as I speak to you now, no single vehicle is in police custody,” Abubakar said.

    The court also gave an order of interim injunction restraining the respondents in the suit filed by Matawalle from taking any further action in connection with the matter.

    The respondents include the Inspector-General of Police, Nigeria Police Force and Commissioner of Police, Zamfara.

    Others are the Department of State Services (DSS) and Nigeria Security and Civil Defense Corps (NSCDC).

    The court further ordered the security agencies to stay away from all actions, pending the hearing and determination of the matter before it.

    The Cross River State government has urged citizens in the state with government vehicles both officially and unofficially attached to return all to the transport officer.

    The government on Tuesday in a notice issued by the state taskforce  on vehicle recovery urged citizens involved to bring the vehicles within 24 hours.

    The notice signed by Odey Ochicha, chairman taskforce committee and
    Barr. Emmanuel Eyo, Secretary, said failure to comply will be revisited with further necessary action.

    The statement reads: “This is to inform the general public that those with Government Vehicle(s) officially or unofficially attached to them should please return all the vehicles to the transport officer, Governor’s office within 24hrs as failure to comply with this notice will be revisited with further necessary action”.

    Jamaica plans to source vehicles from Nigeria

    The Jamaican High Commissioner to Nigeria, Mr. Esmond Reid, says plans are underway for his country to start sourcing for vehicles from Innoson Vehicles Manufacturing (IVM), in Nigeria.

    Reid, in company of the Minister of Foreign Affairs, Mr Geoffrey Onyeama, made this known during a facility tour of IVM plant in Nnewi, Anambra on Saturday.

    He said: ” For us, it is a tremendous opportunity to witness vehicle manufacturing taking place here in Nigeria, which is one of our brothers in the South.

    “It is also a chance to be able to discuss commercial opportunities for sourcing vehicles from Nigeria.

    “This is my first visit. I will go and consult with my stakeholders back home to look at the timeline and determine the negotiations and engagements and when we will start the business of sourcing the vehicles”.

    Assessing the plant, the high commissioner described it as top class, promising to encourage Jamaican citizens to come and see for themselves.

    “I congratulate the management of this company and I’m very grateful to the minister for making this visit possible for me. This can become the start of something great,” he said.

    Commenting, Onyeama called for strict enforcement of the Presidential Executive Order mandating government officials to buy and use Nigeria.

    “I’m very proud. This plant is world class compared to some of the vehicles manufacturing companies I have seen in some other countries. Innoson is doing well.

    “Left to me, every government official should be obliged to buy and use a Nigerian manufactured car. There is a Presidential Executive Order that requires government officials to buy Nigeria.

    “That order has to be imposed and made mandatory. In France, it is impossible to see a French Government official driving a non French car, same in Japan, Korea, UK, and U.S.

    “We have to do the same here. This will encourage and support our citizens and demystify technology,” he said.

    The minister said he facilitated the visit to IVM when the Jamaican High Commissioner requested to see the impressive things going on in Nigeria.

    “We consider these Caribbean countries as our brothers and sisters and we want to increase the level of trade and collaboration among ourselves, ” he said.

    In his remarks, Chief Innocent Chukwuma, the Chairman of IVM, appreciated the Federal Government for supporting manufacturing companies in the country.

    Chukwuma urged Nigerians to always patronise his products, assuring them of quality and durable vehicles.

    Also, Chief Honfery Nkeonadi, the South-East President, Chamber of Commerce, Industry, Mine and Agriculture, lauded Innoson for making Africans proud with such innovation.(

    NDLEA intercepts drugs concealed in sculpture, imported vehicle

    The National Drug Law Enforcement Agency (NDLEA), on Sunday, said it intercepted a consignment of illicit drugs about to be brought into the country by suspected criminals.

    The Director, of Media, and Advocacy, NDLEA, Mr. Femi Babafemi, said in a statement in Abuja that the suspects used disingenuous modes of concealment to import the consignment.

    Babafemi said NDLEA operatives also foiled attempts to export drugs to the United Kingdom and the United Arab Emirate through the Murtala Muhammed International Airport (MMIA), Ikeja, and Tincan Port in Lagos.

    He said a freight agent, Ogunsina Damilare, was arrested on Jan. 6, following a bid to export 1.5 kilograms of skunk, hidden in foodstuffs, to Dubai, UAE, through the Skyway Aviation Handling Company.

    He said the agency also frustrated an attempt to ship to the United Kingdom 11.5kgs of the same substance concealed in a giant wooden sculpture at a courier company in Lagos.

    The director also said a shipment of 24.5kilograms of cannabis sativa imported to Nigeria from Montreal, Canada was intercepted by operatives at the Tincan Port.

    “Also, N8 million bribe offered to NDLEA officers by the importer has been secured in an account for the prosecution of the case.

    “The importer, Cedrick Maduweke, is still at large; one of his accomplices, Steve Isioma Adigwe, has been arrested.

    “The consignment was hidden in a used Toyota Sienna vehicle that arrived the port along with three other cars in a container marked MSMU 5082733,” he said.

    Babafemi quoted the Chairman, NDLEA, Brig.-Gen. Buba Marwa (rtd.) as commending the officers and men of Lagos, Kaduna, Kano, and Imo Commands for the arrests and seizures.

    He said Marwa charged the officers and their compatriots across the country to intensify the heat on drug cartels in Nigeria, while balancing their efforts on supply reduction with drug demand reduction activities.

    Osun govt. directs Gboyega, wife, others to return official cars

    Former governor of Osun state, Gboyega Oyetola and his wife Sherifat have been directed by the Osun state government to return all official vehicles belonging to the state government in their possession.

    The government also gave same directives to other former appointees of the state.

    This was contained in a statement released by Governor Ademola Adeleke’s media aide, Olawale Rasheed on Friday.

    The statement read; “The Assets Recovery Panel of the Osun State Government has directed former Governor Gboyega Oyetola, his wife, Hajia Kafayat Oyetola, and other former appointees to immediately return assorted vehicles valued at N2.9 billion presently illegally in their possession.

    “Due diligence has been conducted and the committee has concluded that the affected past officials should return government vehicles in their possession.

    “This is the first batch of vehicles to be retrieved. We will soon come up with the second batch.

    “All affected officials should return the vehicles in their possession immediately to avoid coercive procedures for recovery of state assets.

    “In the list of affected officials, Governor Oyetola alone has 11 vehicles ranging from Lexus Jeep, Toyota Prado jeeps and assorted models of costly vehicles. The wife, Mrs Kafayat, also has in her possession several brands of government vehicles which were taken away against provisions of the law.”

    “The former Deputy Governor has more than seven government vehicles in his custody contrary to the provisions of the law.

    “A serving Senator, Oriolowo, is also directed to return to the Osun State Agricultural Development Programme five machines, namely a motor grader, bulldozer, soil compactor machine, among others.

    “All affected ex-officials are to urgently comply with the above request or risk enforcement procedures.”

    Other politicians accused of keeping government properties include; Charles Akinola, former chief of staff; and Abdullahi Binuyo, former deputy chief of staff.

    Those who served as special advisers, local government caretakers, board chairpersons, commissioners, and secretary to the state government were also accused of keeping state vehicles.
