    Court admits evidence by video-link, first time in Nigeria

    The Federal High Court, Abuja, on Wednesday, admitted the Economic and Financial Crimes Commission (EFCC)’s application to take its principal witness, one Kobis, who is abroad, via video-link.

    It was the first time that a Nigerian court will allow evidence to be given in such a technology-driven way.

    Justice Okon Abang, who gave the ruling, adjourned the matter till Nov. 5 for continuation of trial.

    News Agency of Nigeria (NAN) reports that Justice Abang had, on Tuesday, reserved ruling on the matter and adjourned till today.

    EFCC’s Counsel, Rotimi Jacob, SAN, had made the application before the court to allow the witness to testify via video link in the alleged N40 billion fraud case against former Governor of Adamawa, Murtala Nyako and others.

    The EFCC had arraigned the former governor and his son, Sen. Abdulaziz Nyako, along with others, over the allegation N40 billion fraud.

    They were arraigned on a 37-count charge bordering on money laundering allegedly perpetrated while Nyako was Adamawa governor.

    Others who were arraigned along with them were Zulkifik Abba and Abubakar Aliyu.

    Firms allegedly used to perpetrate the fraud which were joined as the 5th to the 9th defendants were Blue Opal Ltd, Pagoda Fortunes Ltd, Tower Assets Management Ltd and Crust Energy Ltd.

    New B’Haram video on kidnapped aid workers disturbing —Presidency

    The Presidency said on Thursday that a new video released by Boko Haram, showing captives was disturbing and called for urgent action by the relevant security agencies.
    It said urgent efforts must be made to secure the release of the captives, including Leah Sharibu and the last of the Dapchi schoolgirls still being held by the terrorist group.
    In a statement by the Senior Special Assistant to the President on Media and Publicity, Mr Garba Shehu, the Presidency noted that the captives included humanitarian aid workers and a religious leader.
    It stated, “The Presidency has been briefed by the responsible government agency about the disturbing video showing our citizens, the humanitarian aid workers held captive.
    “Presidency has been given assurances that contact is being made and the captors are being talked to.
    “Besides these aid workers, there are some others about whom this engagement is about — Leah Sharibu, a religious leader and all the others.
    “These discussions have been ongoing even before this time and what this latest incident has done is to bring urgency to the efforts that the secret service is making.
    “Government is making contacts, in the hope that the captors will see reason to not visit hardship or even harm on these innocent individuals. Government is working.”
    Sharibu was among the 112 girls kidnapped from the Girls Technical College, Dapchi, Yobe State by Boko Haram members on February 19, 2018.

    The Presidential Election Petition Tribunal (PEPT) yesterday suspended proceedings for President Muhammadu Buhari’s lawyer to provide the equipment needed to play a digital video disc (DVD) clip where Independent National Electoral Commission (INEC) Chairman Mahmoud Yakubu ruled out the adoption of electronic transmission of results of the last general elections.
    The five-member tribunal,led by Justice Mohammed Garba, adjourned till today, shortly after Buhari’s lawyer, Alex Izinyon (SAN), sought to be allowed to bring equipment to play the DVD after the lawyer to Atiku Abubakar and the Peoples Democratic Party (PDP), Chris Uche (SAN) objected to the use of their television set and DVD player for the disc the second respondent’s lawyer sought to play.
    It was the eighth of the 10 days allocated to Atiku and the PDP, who are, by their petition, challenging the outcome of the last presidential election won by President Buhari of the All Progressives Congress (APC).
    Atiku and his party claimed, in their petition, to have won the last presidential election, going by results they got from a purported INEC server.
    The petitioners, who proposed to call about 400 witnesses, have so far called 40, having called four yesterday.
    The petitioners proceeded to call its fourth witness for the day, Segun Showunmi, through whom they tendered the CDs and a certificate of compliance. Showunmi introduced himself as the media Adviser to Atiku.
    Although lawyers to the respondents – Yunus Usman (SAN) for INEC; Izinyon, and Adeniyi Akintola (SAN), for the APC objected to the admission of the CD in evidence, the tribunal, in a ruling, overruled the respondents’ objection.
    Justice Garba said the CDs were part of exhibits covered by the pre-election agreement by parties, which the tribunal adopted.
    Upon the ruling, Uche applied that some of the videos be played. Three of the CDs were played.
    The first was a recording of a television programme – “Sunday Politics” – which featured an interview with an INEC official, Mike Igini.
    In the video, Igini gave details of INEC’s preparation for the last general elections, stressing the planned use of card reader for accreditation and electronic transmission of election results through a central server.
    The second video showed an official of the Army, who claimed not to have neither original, photocopy or statement of the West Africa Examinations Council (WAEC) in President Buhari’s personal file.
    The third video INEC’s chairman at a meeting with some members of the Computer Registration Council of Nigeria (CRCN) during which he, among others, spoke about INEC’s plan to deploy technology, particularly a new platform for electronic collation and transmission of results.
    Under cross-examination by Usman, Showunmi admitted being aware of other interviews granted by the INEC chairman, particularly those of February 6 and 8, where he spoke about the impossibility of transmitting results electronically.
    When asked if he could produce his letter of appointment as Atiku’s media aide, the witness said he was not with the letter, but that it could be in his house in Lagos.
    Showunmi said he knew Igini, and agreed with the INEC lawyer that, in the video marked Exhibit P74, Prof. Yakubu only hoped that “election results may be transmitted electronically ,not that it will be transmitted electronically.”
    The witness also agreed with Usman that the interviews, contained in the videos showing Igini and Yakubu, were all done before the election.
    Under-cross examination by Izinyon, Showunmi said he was aware of the INEC chairman’s interview of February 6, 2019 where he said electronic transmission would not be possible.
    Izinyon brought out a CD, which he wanted to play for the witness to confirm if that was the interview he said he was aware of.
    Uche promptly interjected and objected to playing of the video through his witness.
    Upon the intervention of the tribunal Chairman, Uche said the respondent should bring their gadgets to play their video.
    “My lord, these are our equipment,” said Uche, pointing to the flat screen television and CD player. “We brought them to play our CDs. They should bring their own.”
    “In digital world, there is what they call virus that may affect our gadgets if the CD is played on it,”Uche said, following which Izinyon sought an adjournment till the next day to enable him fetch his own equipment.
    The three witnesses were called by the petitioners, before Showunmi made sundry claims about malpractices allegedly perpetrated by APC’s agents during the election.
    One of the witnesses, Suleiman Mohammed Bulama, admitted that he and PDP paid N10,000 to some soldiers during the last general election.
    Bulama, who said he acted as the PDP’s ward collation agent in Jika Local Government, gave the information about the N10,000 payment in his written statement, which he admitted on Monday before the tribunal.
    During cross-examination by Izinyon, Bulama, who was the petitioners’ witness, said he stood by his claim that they (he and his party) paid the N10,000 to soldiers during the last presidential election.
    When confronted by Izinyon that by their action they were bribing security officials, the witness said “no, we did “not pay bribe”.

    The Synagogue Church of All Nations, SCOAN, has reacted to a viral video where a lady identified as Bisola Johnson accused its founder, Prophet T. B Joshua of rape.
    The leadership of the church described the lady as mentally ill in a statement made available to newsmen.
    The statement read, “Since the beginning of the week, one of the topic that hasn’t left the mouth of the public is the rape issue happening everywhere, there has been allegations on men of God and one of the most recent is that of Prophet TB Joshua, the founder of Synagogue church of all nations.
    “A lady, identified as Bisola Johnson has been parading herself as a victim of rape by the man of God, in the light of Biodun Fatoyinbo’s case.
    “She revealed that she was kept captive in SCOAN for 14 years and was raped for same 14 years by Prophet TB Joshua.
    “In response to this, the church has released a video of the said woman during her first appearance in the church, she made it known in the video that she willingly came to SCOAN for deliverance from the spirit of death and after some time, she vanished.
    “It will also be recalled that she came up some years back to make same allegations but because of the unbelievable story, she didn’t get the attention of people which is why she came up now with her story now that rape is trending.”

    Social network traffic is expected to rise 22 percent annually over the next 6 years, according to Ericsson Mobility Report.

    However, its relative share of traffic will decline from 11 percent in 2018 to around 8 percent in 2024, because of the stronger growth of video.

    According to the report, video traffic in mobile networks is forecast to grow by around 34 percent annually up to 2024 to account for nearly three-quarters of mobile data traffic, from approximately 60 percent in 2018.

    Mobile video traffic growth is driven by the increase of embedded video in many online applications, growth of video-on-demand (VoD) streaming services in terms of both subscribers and viewing time per subscriber, and the perpetual evolution towards higher screen resolutions on smart devices.

    All of these factors, according to the report, have been influenced by the increasing penetration of video-capable smart devices.

    The report reveals users are spending more time streaming and sharing video, and this is expected to continue, as video is embedded in all types of online content.

    In addition, surveys of smartphone users worldwide indicate that they expect 5G to bring the network performance needed for immersive media formats and applications.

    Streaming 360-degree video and augmented/virtual reality should start to be a significant factor in mobile traffic growth while enhancing user experience as 5G is rolled out, and compatible devices are successively introduced.

    Abuja: Apo transmission station catches fire [Video]

    There was a fire outbreak at the Apo transmission station in Abuja on Sunday – the fire was later put out.

    A 45MVA transformer, based on preliminary information was lost to the fire.

    The Abuja Electricity Distribution Company (AEDC) Head Corporate Communication, Mr. Oyebode Fadipe, disclosed.

    He noted that “Our technical team is right now working with the TCN engineers to see how to absorb the load on the 45MVA transformer that was affected by the fire.”

    The Minister of Power Works and Housing, Babatunde Fashola that was said to have responded to the incident, said that he was that the technical staff were already working to redistribute the power from the station.

    He was quoted as saying that “I am aware of the Apo Fire incident which occurred today (Sunday) affecting the Transmission Transformer and our staff are at site & on ground . The fire has been put out.

    “Damages is being assessed and plans underway to redistribute Power to Communities served by the burnt damaged Transformer at Apo Transmission Sub Station.”

  • Court admits video of cleric confessing to beheading woman for N4000

    A Lagos High Court in Igbosere Tuesday admitted in evidence a video showing an Islamic cleric, Taofeek Adamu, confessing to beheading a member of his mosque for N4, 000.

    Adamu, 61, of Masinowe Compound, Ikoga in Badagry, is facing a two-count charge of conspiracy and murder, preferred against him by the Lagos State Government.

    Prosecuting Counsel Mrs O. F. Fagbai alleged that Adamu, alias Kiekie, severed the head of Oluwakemi Afolabi, 38, at about 4pm on March 19, 2017 at Waterside, Ikoga-Zebbe in Badagry.

    She said the deceased went to seek spiritual help from the cleric, but “the defendant beheaded the deceased before chopping off her other parts for ritual purposes.

    He was apprehended when members of the community saw him carrying a sack soaked with blood.”

    The alleged offences contravened sections 222 and 233 of the Criminal Law of Lagos State, 2015, the court heard.

    At the last adjourned date on April 9, the prosecution sought to tender the video through the police as electronically generated evidence, but this was opposed by the defence counsel Mrs A. O Ajayi.

    According to the prosecution, the video, found on the internet, showed Adamu confessing to the crime, during a press interview conducted by former Commissioner of Police in Lagos State, Fatai Owoseni.

    The video was then copied by the police, transferred to a compact disc via a Hewlett Packard (HP) laptop on January 25, 2019.

    But the defence prayed the court to reject the video, arguing among others that the document does not indicate the name of the officer that produced it.

    Ajayi added: “The compact disc itself says interview conducted by the press. When it comes to computer generated documents, it tells you how it was produced. But in this case,… it also does not state the name of the officer, this is not permissible…”

    In her response Fagbai argued that the paramount thing to consider is whether the actual document is relevant.

    The prosecution has complied, I urge you lordship, to discountenance the objection the defence raised, as this document we sought to tender is very important and the original is before the court, “Fagbai said.

    In her ruling yesterday, Justice Akinkugbe upheld the prosecution’s argument.

    She held that the electronically generated document complied with Section 84 of the Evidence Act and “is therefore admissible”.

    Section 84 provides that a computer generated document shall be admissible as evidence of any fact stated in it of which direct oral evidence would be admissible and the period, in which the document was generated, the computer was operating properly.

    The case continues on May 21.

    Nigerian comedienne, Etinosa seem to have moved from the drama that surrounded her now famous Instagram live video with MC Galaxy .

    The beautiful actress in a new Instagram post noted that she cannot kill herself over the issue.

    Etinosa revealed that she has been able to move on from the drama surrounding the video and hold her head up high.

    “Holding Your Head Up High and Standing Tall Through Your Mess. A lot of people were shocked I was already a cover girl to a magazine granting interviews and hosting shows outside Lagos- Back to work. They did not expect me to rise and shine. At least not so soon they said. They would feel better if I hide my head in shame, lay low and disappear for the rest of my life. However, I will be a bigger disappointment to the girls who look up to me if I do not show them how they could also rise above their mistakes:- Own your mess up.

     

    “Do not let some of the greatest weapons of failure- shame and fear keep you down… And then depression sets in… Low self-esteem and the feeling you will never be anything great comes in. -Don’t listen to that voice in your head or that acclaimed adviser Nowamagbe who constantly drums it into your ear that you have messed up and it’s the end of the road. Those people who take joy in analyzing your mess up and how it will affect you rather than discussing way forward or just minding their own business all together. Cut them off. -The proof of a strong man is not the absence of wounds but exactly how he heals and rises for the next battle. Se ogun laye ni? Yes! Ogun l’awa!!” she said.

     

    Speaking further, she added that she has taught people who see her as a role model how to fall and rise again.

     

    “The absence of wounds only show a child who has never been in battle -As casual as this sounds “I cannot come and kill myself” it is one of the strongest tools of motivation against suicide and other regret related reactions. -Even a righteous man shall fall several times and rise up again. So don’t beat yourself up. From recent events, I have come to realise a lot of people look up to me. Wow. Also, a lot of people dealing with shame and rejection from family and friends as well.

     

    “A lot of people who have been tagged useless and worthless. Also the black sheep of families. At first I said please I’m human go and look up to Jesus Christ but then again God uses humans. As a role model I have shown you how to fall. Now, permit me to show you how to rise again like an eagle, like the Queen you are, like the Luxurious BOSS that I am.   • More trouble for R.Kelly as video of sexual assault emerges

    Lawyer Michael Avenatti, has released a video tape which allegedly shows R. Kelly sexually assaulting a minor girl.

    Avenatti on Thursday took to Twitter and claimed that he has handed over the video to police in which the “Ignition” hit maker is seen having sex with the 14-year-old girl

    “My client knows the identity of the girl and R. Kelly. He identified the two of them on the videotape. He worked for and has known R. Kelly for decades, and he met the girl on a number of occasions,” said Avenatti, who is reportedly representing an individual who the attorney describes as a whistle-blower against Kelly.

    Recall that Kelly was previously arrested in 2002 for his alleged involvement in a child pornography tape that featured similar sexual acts.

    Following the new allegations, Kelly’s lawyer Steve Greenberg said: “We are unaware of any new information involving Mr. Kelly. We have not been contacted by anyone. We have not been informed about any new information by anyone and we have not been contacted by law enforcement.”

     

  • Fear of forfeiture: Patience Jonathan submits video ‘evidence’ to prove source of $8.4m, N7.4b

    Former First Lady Dame Patience Jonathan’s lawyers yesterday played five videos to prove the source of $8.4 million and N7.4 billion, which the Economic and Financial Crimes Commission (EFCC) seeks to forfeit to the Federal Government.

    The videos were projected before Justice Mojisola Olatoregun of the Federal High Court in Lagos.

    The judge had last April 20 ordered temporary forfeiture of the funds, which EFCC said were suspected to be proceeds of crime.

    Mrs. Jonathan, Globus Integrated Services Ltd, Finchley Top Homes Ltd., Am-Pm Global Network Ltd, Pagmat Oil and Gas Ltd and Magel Resort Ltd and Esther Oba are the respondents.

    Among the temporarily forfeited sums are N1.085 billion and N226.3 million found in Finchley’s Ecobank account and N39.4 million found in its Diamond Bank account, as well as N55.9 million found in Pagmat Oil and Gas’ Diamond Bank account, among others.

    EFCC’s counsel Rotimi Oyedepo had urged the court to order the money’s final forfeiture to the Federal Government.

    But, Mrs. Jonathan’s lawyer Chief Ifedayo Adedipe (SAN) opposed the application.

    He urged the court to refuse it on the basis that sufficient facts were not placed before the court to warrant a final forfeiture order.

    The SAN argued that Mrs. Jonathan was neither invited by the commission to explain the sources of the funds nor was she charged with any offence.

    Adedipe contended that the depositions by the applicant that the funds represented proceeds of unlawful activities were not substantiated.

    The companies’ counsel, Chief Mike Ozekhome (SAN), argued that going by the provisions of the Advanced Fee Fraud Act, EFCC’s motion for final forfeiture was premature.

    He argued that it was only when the companies’ affidavits to show cause are argued, and the court finds no merit in them, that the final forfeiture application could be justified.

    According to him, his clients filed affidavits to show cause, adding that one of the companies exhibited its certificate of incorporation, its board resolution that Patience Jonathan be made a signatory to it, and bank documents showing its account are signed by other persons who are also signatories.

    Besides, Ozekhome told the court that one of the companies makes money from selling items such as groceries, drinks, lighting, among others, adding that there was a video clip exhibit of various outfits legitimately run by the company.

    The first video, which lasted 25 minutes, showed business outlets and products of Finchley Homes Ltd. They include interior and exterior home decorations, household utensils, textiles, drinks, noodles, furniture, a warehouse, as well as various pickup vans said to belong to the company.

    The second video clip, which ran for four minutes, showed the business outfit of the Otuoke, Bayelsa State based Magel Resort Ltd, which comprised a luxurious hotel equipped IT centres.

    Adedipe also exhibited three videos showing activities of the Women for Change Initiative, a non-governmental organisation linked to Mrs. Jonathan.

    The first 10-minute video showed the flag off of the initiative’s campaign.

    It was followed by another 10-minute clip showing aspects of the initiative’s empowerment of women through the distribution of food items.

    The final video of seven minutes duration showed Mrs. Jonathan visiting Katsina State for the initiative’s flag-off.

    The hearing continues today.
