    Alh. Abdullahi Bello, Chairman, Kogi All Progressive Congress (APC) has denied reports that Gov. Yahaya Bello has conceded the positions of the party’s National Working Committee (NWC) on appointments of some national officers.

    Bello, who made the rebuttal in a statement in Lokoja on Friday said: “It’s falsehood being circulated by enemies of our party.”

    Recalled that Kogi APC objected to the appointment of Duro Meseko (Kogi) as the Deputy National Publicity Secretary and Ikani Shuaibu Okolo (Kogi) as New Zonal Organising Secretary, North Central Zonal chapter of the party.

    The state chapter claimed that the names of the officers,  unanimously agreed upon and sent to national party secretariat were discarded for unknown persons in Weseko and Okolo.

    The chairman added, “The purported compromise being circulated by enemies of APC in Kogi to the effect that the governor has been told to produce the zonal organising secretary and concede the deputy national publicity secretary is false.

    “There is no iota of truth in that report. We know the people behind such misinformation and falsehood but we remain committed to the position of the National Chairman of the party and we know all of us will ensure that the Constitution of the party is protected and preserved.

    “Nothing was discussed about concessions because it will be a violation of the constitution of our party and due process for which our party is known.

    “Gov. Yahaya Bello is a loyal party man, who will only accept what is constitutional. He has great respect for the President and the leadership of the party, ” he said.

    He went on to reveal that the matter of the party was almost resolved as all parties had agreed to honour the constitution of the party.

    “Our governor is only acting on behalf of hundreds of thousands of APC members in Kogi  and has nothing personal against any individual.”

    A Special Adviser to the Governor on Internal and Corporate Affairs, Hon. Abdulkarim Isah, popularly known as ECOMOG, has renounced the All Progressives Congress, APC and the policies in the State as he resigned from his appointment and joined the Social Democratic Party (SDP).

    ECOMOG, who was an elected local government chairman, was removed and later appointed as a special adviser to the governor.

    In his letter of resignation dated August 16, 2023, ECOMOG indicated that his interest and participation in politics was for the sole aim of serving his people.

    “So, the question is whether I have been able to fulfil this right of my people over me. I do not need to think twice before answering, hence the decision to move on to explore other avenues in the service and interest of those same people,” he said.

    In a statement made available to newsmen, ECOMOG said it would be counter-productive for Kogi, which had always been in the limelight, to remain in “doom” as it is under Alh. Yahaya Bello.

    “It is sad that the APC is dead in the state due to Alh. Yahaya Bello’s decision to impose Ododo as the APC candidate. Therefore, we need to align ourselves to a political party that will bring visible development to our people.

    “We are going to a political party that will receive and help us to realise our dreams,” the statement quoted him as saying.

    Governor Yahaya Bello of Kogi says his style of leadership keeps attracting more defectors from the opposition parties in to All Progressives Congress (APC) in the state.

    Bello described the situation as a “plus” and “blessing” to the APC in its quest for victory in the upcoming Nov. 11 governorship election in the state.

    A statement issued by his media aide on Monday, Mr Onogwu Mohammed in Lokoja, said that the governor made the remark while receiving PDP defectors from Adavi Local Government Area of the state.

    Bello also attributed the increasing defections to the infrastructure development his administration has brought to Kogi.

    Thrilled by the overwhelming new entrants into APC, the governor expressed optimism of clear victory of the APC flagbearer, Alhaji Usman Ododo.

    He, however, encouraged the defectors to rally support for the APC candidate for a victory in the governorship election.

    “You should know that retaining the APC leadership in the state will elevate the state’s political standing at the national level and attract more federal government presence and development,” he said.

    Earlier, the leader of the defectors, Mr Bello Unwaha, applauded the governor’s investments in education, health, rural development and road infrastructure that endeared them to APC.

    Unwaha specifically highlighted the rehabilitation of Itakpe-Okene road, Itakpe-Kuroko-Ehika road and other township roads in Okene, Adavi and Okehi Local Government Areas as spectacular performance of Bello’s administration.

    While commending the governor for his impartial distribution of resources and infrastructure, Unwaha pledged the group’s commitment and support to the APC in the upcoming governorship poll.

    The Kogi Government on Tuesday described the Nov. 11 governorship election in the state as a referendum on the administration of Alhaji Yahaya Bello.

    The state Commissioner for Information, Mr Kingsley Fanwo, made this known while receiving the leadership of the Ododo Support Organisation led by its Director General, Dr Aminu Adaira, in his office in Lokoja.

    Fanwo expressed gratitude to the organisation for finding him worthy of the task of being the Patron of such “a noble organisation that is clearly the most organised among all the independent platforms campaigning for our Governorship Candidate, Alhaji Usman Ododo”.

    He described Ododo as a detribalised leader full of capacity and good leadership qualities to lead the state forward.

    “Apart from the excellent leadership qualities of Alhaji Ododo, Nov. 11 will be a referendum on the administration of Alhaji Yahaya Bello.

    “Kogites will respond to the need for continuity with resounding affirmation.

    “GYB has performed excellently in the areas of education, healthcare, civil service reforms, agriculture, capacity building, youths and women inclusion, security and many others,” Fanwo said.

    “Ododo was a member of his administration and a member of his political family. He will consolidate on his achievements.

    “With due respect to the opposition party, they stand no chance in the coming poll because PDP that is supposed to be the main opposition party is already deserted and desolate.

    “SDP, which keeps burning their own office for public sympathy is completely in disarray,” he said.

    “Peace is our watchword in APC and our leader, Gov. Yahaya Bello is a man known for peace and security. We won’t allow anyone disrupt the peace of the state before, during and after the election.

    “We are not unaware of those vandalising their office just to win public sympathy. They have forgotten that a tree without roots can never stand,” he stated.

    Earlier, Adaira assured that the organisation has put structures in place to garner over 400,000 votes for Ododo.

    The director-general said that the APC flagbearer has all it takes to consolidate on the achievements of Bello.

    State Govs pledge to complement FG’s relief initiatives for Nigerians

    State Governors in the country have pledged to complement the Federal Government’s initiatives aimed at providing relief to Nigerians.

    Gov. Yahaya Bello of Kogi State disclosed this after a meeting with President Bola Tinubu on Friday in Lagos State.

    Governor Bello said the successful implementation of the succour pledged by the Federal Government to cushion the negative effect of the fuel subsidy removal must be matched by all tiers of government.

    “Now we have a leader who has clearly spelt out his policy direction for revamping the economy and he needs all our support.

    “That support will be complemented by the state governors.

    “We are all ready to provide relief for our people. We feel their pains and trust the people to be patient in this trying phase, so that they will reap the benefits of the new government’s economic initiatives.

    “We shall not let the President down and we shall not let our people down in this phase of new economic journey to a stronger and resilient nation.

    “The President has given us that full assurance of being people-friendly,” the governor said.

    Similarly, Rev. Fr. Hyacinth Alia of Benue said already his government has marshalled out an action plan to restore the lost glory of the state “after the long drought”.

    He said the state government has worked out immediate policies to stimulate both the civil service and agriculture sector as remedial interventions towards a vibrant Benue.

    “The people of Benue, and indeed all Nigerians, can be rest assured that a new dawn is coming to Benue.

    “I have started by working on the welfare of the civil servants. That is not even a project that ordinarly one should state. But it’s a way forward due to what we met on ground.

    “Other agricultural incentives for farmers are in the pipeline and will be unfolded very soon.

    “I want to restore Benue to its position of being the food basket of Nigeria. Agricultural potential in the state is worth more than crude oil,” Alia said.

    State governors in the country have national, zonal and local fora, irrespective of party affiliations, where they meet to harmonise policies and programmes.

    The Nigeria Governors Forum, the Progressive Governors Forum and the six zonal chairmen of governors are all systems put in place for such meetings of minds.

    Kogi Central Peoples Democratic Party (PDP) Senatorial Candidate in Kogi Natasha Akpoti-Uduaghan has alleged that the recent attack on Gov. Yahaya Bello’s convoy is politically motivated.

    “It is a smear campaign against the Social Democratic Party (SDP) Governorship Murtala Yakubu-Ajaka”, she alleged in a statement issued in Lokoja on Sunday.

    She urged the appropriate authorities to investigate the crisis.

    She noted that both Bello and Ajaka are already accusing each other of assassination attempt, calling for investigation before it would go out of control.

    She recalled further that the attack occurred on June 3 on Lokoja-Abuja highway.

    “The attack was a ploy in to implicate Ajaka to be disqualified by INEC in the forthcoming Nov. 11 governorship election,” she alleged.

    But Mr. Kingsley Fanwo, the state  Commissioner for Information, said that Natasha should better give her testimony to the law enforcement agents than going to the media.

    “If she was there when the incident happened, she should better go to the law enforcement agents and give vivid account of what exactly happened.

    “But if she wasn’t there, she isn’t fair to either Bello nor Ajaka by this accusation,” Fanwo said.

    Yahaya Bello escapes death as gunmen attack convoy

    The Convoy of the Governor of Kogi State, Yahaya Bello was on Saturday attacked by suspected gunmen, on his way from Abuja to Lokoja.

    He was blocked and attacked by people believed to be supporters of Alh. Muritala Yakubu Ajaka

    The incident which occurred at about 12.30 hours left many people injured.

    According to a statement issued by Kingsley Femi Fanwo, the state Commissioner for Information and Communications, the attack took place near the Naval Base, few kilometres from Lokoja.

    Fanwo noted that the convoy of Muritala Yakubu Ajaka, having sighted that of the Governor, blocked the road and Ajaka’s armed thugs started shooting sporadically at the convoy of the Governor.

    The statement reads: “A Tundra branded with the logo of the SDP and with SDP flags also blocked the Governor’s vehicle and occupants of the SDP branded Tundra were armed with Rifles and short guns. The Governor left the scene unscathed and there is no cause for panic as the Governor is in high spirit.

    “Some security aides and other aides attached to the Governor sustained some degrees of injuries and have been rushed to medical facilities for medical attention.

    “We urge the people of Kogi State to remain calm as security agents are in full control to ensure the arrest of the hoodlums behind the attack. The State Government will ensure that law and order are maintained as the attackers will be brought to justice.

    “The Governor has warned that no APC member should involve in any reprisal attack as insecurity from any quarter will be met with stiff penalties” the statement concluded.

    Governor Yahaya Bello of Kogi State has announced the reinstatement of five of his key government officials that resigned to contest for the governorship ticket on the platform of the ruling All Progressives Congress (APC), for the forthcoming election.

    Secretary to the State Government, Folashade Ayoade, made this known in a statement issued in Lokoja on Monday.The SSG said: “The Office of the Governor of Kogi, Yahaya Bello, has officially announced the immediate reinstatement of five key officials in the state.”

    Ayoade gave the names of the individuals approved to resume in their previous positions to include Jibrin Momoh, former State’s Accountant General; Pharmacist Jamiu Abdulkarim-Asuku, former Chief of Staff to the Governor; and Yakubu Okala, former State Auditor-General.

    Others were Idris Asiwaju Asiru, former Commissioner for Finance, Budget and Economic Planning; and Momodu Ozigi-Deedat, former Commissioner for Local Government and Chieftaincy Affairs.

    “The reinstatement of the Auditor-General and the commissioners was subject to the scrutiny and confirmation of the House of Assembly before they could resume their duties,” the SSG said.

    “We trust that the reinstatement of these officials will further enhance the efficiency and effectiveness of the state government in delivering its mandate to the people of Kogi.”

    Court strikes out forfeiture suit against Gov. Bello

    A Federal High Court in Lagos on Wednesday, struck out an interim order of forfeiture, seeking to forfeit properties linked to Kogi State Governor, Yahaya Bello.

    The suit was instituted through an exparte application brought by the Economic and Financial Crimes Commission, (EFCC), seeking a temporary order, forfeiting 14 properties associated with the governor.

    Delivering a ruling on the motion, on Wednesday, Justice Nicholas Oweibo, held that in view of Section 308 of the 1999 constitution, the EFCC lacks power to initiate a criminal suit against an incumbent governor or President.

    Recall that Justice Oweibo jhad, on Feb. 22, granted an interim forfeiture, following an exparte motion filed by the anti-graft agency, seeking to seize 14 properties located in Lagos, Abuja and the United Arab Emirates (UAE).

    The Court had also directed EFCC to make publications in two national dailies for any interested parties to show cause why the order should not be made absolute.

    Meanwhile, following publications of the preservative order, Gov. Bello had filed a Notice of Intention to oppose, as well as an application seeking to vacate the interim forfeiture order.

    Bello premised his application on the grounds that the properties listed were not proceeds of unlawful act, as they were acquired long before he was elected Governor.

    He had further stated that by Section 308 of the Constitution, the EFCC is prevented from instituting any civil or criminal suit against him.

    Besides, he contested the illegality of the suit by EFCC on the grounds that the case was in flagrant disobedience to an existing order of a State High Court.

    He averred that the order had restrained the EFCC from investigating any account of the Kogi State Government, pending the determination of the Motion on Notice

    On the issue of jurisdiction, the applicant stated that the properties listed were in Abuja, Kogi and UAE, while the personality involved is based in Lokoja.

    He, therefore, averred that the suit ought to have been instituted either in Abuja or in Kogi State and consequently, urged the court to vacate the order for want of jurisdiction.

    Responding to the applicant’s averment, counsel to EFCC, Mr Rotimi Oyedepo SAN, argued that the applicant had brought nothing before the court to convince the court to vacate the order.

    He argued that contrary to the submissions of the applicant, the Kogi State High Court or any other court in Nigeria had not stopped the EFCC from carrying out its constitutional duties.

    He argued the properties which includes “Hotel Apartment Community, Burj Khalifa lying, being and situate at, Plot 160 Municipality NO 345-7562, Sky View Building No 1, Property No 401, Floor 4, Dubai U.A.E.”, were suspected to have been derived from unlawful activities.

    Oyedepo had also asked the court to order the forfeiture of N400 million, which he said was also reasonably suspected to have been derived from unlawful activities.

    In his ruling, however, Justice Oweibo held that, given Section 308 of the Constitution, which provides immunity to a serving governor from any civil or criminal prosecution, the court lacked jurisdiction to adjudicate on the matter.

    The court consequently, struck out the suit for lack of jurisdiction.

    Section 308 of the constitution provides: “No civil or criminal proceedings shall be instituted or continued against a person to whom this section applies during his period of office”.

    The Economic and Financial Crimes Commission (EFCC) on Tuesday urged Justice Nicholas Oweibo of the Federal High Court sitting in Ikoyi, Lagos to dismiss the application by Kogi State Governor, Yahaya Bello, seeking to vacate the forfeiture order in respect of 14 properties and the sum of N400m.

    The court had, on February 22, 2023, granted a preservation order of the properties linked to the Kogi State government and reasonably suspected to have been derived from unlawful activities, pursuant to Sections 9 and 10 of the Proceeds of Crimes (Recovery and Management) Act, 2022.

    The properties including “Hotel Apartment Community, Burj Khalifa lying, being and situate at, Plot 160 Municipality NO 345-7562, Sky View Building No 1, Property No 401, Floor 4, Dubai U.A.E.”, were reasonably suspected to have been derived from unlawful activity.

    At the resumed sitting today, the EFCC counsel, Rotimi Oyedepo, SAN informed the court that the preservation order had been published in the Punch Newspaper, in line with the court’s directive to advertise the same in one of the national dailies.

    Oyedepo said: “We were directed to make a publication of the said Order and we have complied with the order of the court.

    “There is an affidavit to the Order dated 22nd February, 2023, which was complied with on the 24th February, 2023.

    “Sequel to that, we have received a notice of intention to oppose the making of the preservation order and we have equally responded”.

    Responding, the Kogi State Governor, through his counsel, Abdulwahab Mohammed SAN, sought to vacate the order of the court, saying, “We have an application subject to your lordship’s convenience.

    “We are ready to move the application. It was filed on March 9, 2023. The application is seeking your indulgence to vacate the order of the court made on the 22nd of February, 2023.

    He argued that most of the properties sought to be forfeited were acquired by Bello before he became the Governor of the state and that the Commission lacked the power to proceed against the governor as he enjoys immunity under the constitution.

    “By virtue of the position of the applicant (Kogi State Governor), you cannot proceed against him under any law, according to Section 308 of the Nigerian Constitution.

    “If you want to prosecute or forfeit his properties, you have to wait till he no longer enjoys those benefits of a Governor,” he argued.

    He, therefore, urged the court to grant his client’s prayers and vacate the order

    In opposing the application, EFCC counsel Oyedepo relied on depositions in the 12-paragraph counter-affidavit and a written address dated 28 March, 2023, stating that the applicant failed to reply to the counter-affidavit made by the prosecution.

    “In Usman against Garke, it was reported in 2003, LPLR 3431, Supreme Court, and our submission is that failure to reply to the counter-affidavit has a single legal consequence that the respondents are agreeing to the application. We urge your lordship to hold that the failure to respond is deemed admitted.

    “We have cited authorities to this effect, one of which is Patience Jonathan and the FGN, in paragraph 1.08 of our submission. The Proceeds of Crime (Recovery and Management) Act, 2022 prescribes the mode of challenging the preservation order of the court and the steps to be taken by the party challenging the making of the preservation order.”

    Oyedepo submitted that one of the requirements that the application must contain is that the applicant must show his interest in the property concerned.

    “Apart from Paragraph 4H and I of the affidavit in support of the notice of intention, there is nothing before this Honourable court showing, by way of credible evidence, how the properties were acquired.

    “In our counter-affidavit, we have established how the properties were acquired and there is nothing challenging how the properties were acquired.

    “What was deposed is that, most of the properties were obtained before he became Governor of Kogi State and the properties were not acquired through illegal means.

    ‘”Without establishing the interest of the applicant, the application is bound to fail.”

    On the immunity clause as contained in Section 308 of the 1999 constitution, Oyedepo said: “the Provision of S308 will not and cannot be construed to a ridiculous extent of preventing the state from investigating the beneficiary of the section.

    “As far back as 2002, in the case of Fawehinmi and IGP, the court mentioned that a person protected under S308 can be investigated; and the fact that someone is under immunity does not prevent the state from investigating.

    “Where a state governor is reasonably suspected to have committed a financial crime, the state can investigate for evidence that will be used in prosecution when he no longer enjoys the immunity.”

    Oyedepo also argued that the steps the prosecution was taking “is a step for preservation and it cannot be stopped.”

    He further told the court that, out of the entire assets that the EFCC seeks to preserve, only one asset was declared in the applicant’s Declaration of Assets Form and that nothing had been said in the affidavit to challenge “the reasonability of our suspicion.”

    He, therefore, urged the court to dismiss the prayers of the applicant and order him to tell the court how the properties were acquired.

    Justice Oweibo adjourned the matter till April 20, 2023 for ruling.
