  • How Zamafara Gov-Elect, Dauda Lawal scaled many court cases to win guber poll

How Zamafara Gov-Elect, Dauda Lawal scaled many court cases to win guber poll

It’s no longer news that the incumbent governor of Zamfara state Bello Matawalle has been defeated by the candidates of the Peoples Democratic Party (PDP) Dauda Lawal Dare.

Recall that the Independent National Electoral Commission (INEC) Returning Officer for the election, Professor Kasimu Shehu, while declaring the final results, said Dare scored 377,726 votes to defeat Matawalle, who polled 311,976 votes.

Lawal’s victory has been celebrated by many PDP supporters who described his victory as God’s will considering the many legal battles he faced prior to the March 18th election.

However, Lawal’s victory did not come on a silver platter. The road to success was pretty rough for the former First Bank director, who fought four legal battles up till two weeks to the poll before he was finally affirmed as the PDP governorship candidate.

    Lawal’s road to Victory

Initially the Federal High Court in Gusau, Zamfara State capital, nullified the primary election that produced him as the PDP candidate.

Recall that Alhaji Ibrahim Shehu Gusau,  a former federal lawmaker, , had approached the court to nullify the primary electio  that produced Lawal, saying the election was marred by irregularities.

Justice Aminu Bappa nullified the May 25, 2022 primary and ordered that a rerun be held.

The governor-elect had to seek legal help to have the Federal High Court judgement’s nullified.

Although Lawal won the rerun, his victory was put on hold as Gusau went back to the same court to contest the exercise.

Again, Justice Bappa nullified the rerun and even added a shocker: PDP would not field any candidate for the 2023 governorship election in the state, he had ruled.

The rerun was nullified on the grounds of irregularities and non-compliance with the party’s 2017 constitution as well as its electoral guidelines for the conduct of elections.

Lawal didn’t give up. He, Adamu Maina-Waziri, the Chairman Primary Election Committee and Col. Bala Mande (retd) approached the Appeal Court Division in Sokoto to seek redress.

    Reprieve came in 2023

After many back and forth, the appellate court in a unanimous judgment read by Justice Abubakar Talba nullified the Federal High Court ruling and reinstated Lawal as the PDP candidate for the 2023 guber election.

The respondents in the suit were Gusau, Alhaji Wadatau Madawaki, Hafiz Nahuche and INEC.

Justice Talba held that the appellants succeeded in proving all the seven grounds of appeal canvassed by their counsel and that the court resolved all in their favour.

The presiding judge held that the lower court was wrong to discountenance documents submitted by INEC, adding that it (the trial court) did not stipulate the period of conducting rerun election and notices of participation.

Supreme Court Came Through For Governor-Elect

Not done with the Governor- elect,  Gusau again appealed the ruling at the supreme court but the ruling came out in favour of Mr Lawal when the apex court upheld the Appeal court’s ruling.

The court, in a unanimous decision by a five-man panel of justices, dismissed Gusau’s appeal, challenging the legality of the primary election. Justice Inyang Okoro who read the lead judgement said the appeal lacked merit.

“The court resolved all the issues for determination against the Appellant and held that the appeal was unmeritorious and the same was dismissed. Parties were ordered to bear their respective costs,” Okoro said.

  • Kaduna, Kogi, Zamfara Govts sue FG over Naira redesign policy

Kaduna, Kogi, Zamfara Govts sue FG over Naira redesign policy

Kaduna, Kogi and Zamfara states have instituted a suit against the Federal Government seeking a restraining order to stop the full implementation of the Naira redesign policy of the Central Bank of Nigeria (CBN).

In a motion ex-parte filed before the Supreme Court, the three states are praying the court to grant an interim injunction stopping the CBN from ending the timeframe within which the old N200, N500, and N1000 notes will cease to be legal tender.

They submitted that the 10-day extension is insufficient to address the challenges plaguing the policy.

The plaintiffs also filed a motion on notice to abridge the time within which the respondent may file and serve a counter-affidavit for an accelerated hearing.

The states are seeking a declaration that the demonetisation policy of the CBN is not in compliance with the extant provisions of the constitution, and the CBN Act, 2007.

The plaintiffs said since the announcement of the policy, there has been an acute shortage in the supply of the new naira notes in Kaduna, Kogi, and Zamfara states.

They added that citizens who have dutifully deposited their old currency notes have increasingly found it difficult and sometimes next to impossible to access the new notes for their daily activities.

Asides from the unavailability of the new notes, the plaintiffs also submitted that the notice period given by the federal government was inadequate.

They are also seeking a declaration that the three months notice given by the federal government through the CBN is in gross violation of the provisions of Section 20(3) of the CBN Act which specifies that reasonable notice must be given.

They also want the court to declare that by the express provisions of Section 20(3) of the CBN Act, the FG through the CBN has no power to issue a timeline for the acceptance and redeeming of banknotes issued by the bank, except as limited by section 22(1).

Consequently, the plaintiffs want the court to direct the immediate suspension of the demonetisation policy until the relevant provisions of the law are complied with.

No date has been fixed for hearing.

TERRORISTS: NAF Jets hit Zamfara enclave, scores of bandits dead, armourer escapes

Scores of bandits have been killed as Nigerian Airforce (NAF) jets hit the enclave of notorious gun runner, Mallam Ila, at Manawa Village in Shinkafi Local Government Area of Zamfara State.

According to a defence operative, the gun runner was the major supplier of sophisticated weapons to the notorious terrorist, Bello Turji, in Zamfara.

“The NAF aircraft under Operation Hadarin Daji carried out the strikes on the enclave of Mallam Ilu in the evening of 18 November 2022.

“Mallam Ila remains a high-value target due to his closeness and association with terrorist leaders Bello Turji and Dan Bokoyo. Their foot soldiers have also been responsible for attacks in the Shinkafi general area of Zamfara State as well as parts of Kaduna, Niger, Kebbi, and Sokoto States.

“After the airstrike on the location, multiple explosions were observed with huge fireballs, indicative of other highly inflammable materials hidden in the location. Scores of terrorists were eliminated during the operation,” the operative said.

Another source explained that Mallam Ila narrowly escaped but sustained critical injuries following the hit from the NAF jets at the Zamfara enclave of the armourer.

When contacted, the NAF spokesperson, Air Commodore Edward Gabkwet, confirmed the strikes and maintained that the military operations continued to curtail the excesses of bandits and terrorists in the states.

“The NAF and other security agencies remain on track to seeing the ongoing counterterrorism effort to a conclusive end.

“We call on Nigerians to continue supporting the security agencies with information on activities of criminal elements as solving the current security impasse requires the involvement of all,” Gabkwet added.
